Good evening sir, I have a question I was in a hit and run accident on july 29th 2023 I was rear ended and I was injured with a concussion, shoulder injury and head injury. I received work loss payments from September 2023 until they cut me off after I seen their doctor which was April 2024, I’m still out of work due to shoulder and vertigo from injury I have 250,000 in UM and 500,000 could I still go for compensation? I’m in Michigan btw

I was rearended by an uninsured driver, I was diagnosed with a concussion, whiplash and separation in my left shoulder, my SUV was a total loss. I had physical therapy, and I am still experiencing vertigo. I got an offer in the mail today, for $1800. 00 without justifying the offer. I have 100/300 UM/UIM. this is ridiculous. I know there is a formula to calculate the worth of my claim. Any suggestions?

Hi Cherie, yes UM and UIM is really important. Can't tell you how many calls I've gotten from folks hit by an uninsured driver. Not all states require insurance. I only practice here (and also CA). But I think off the top of my head that FLA does not. Yes, your child would likely be covered by your UM and/or UIM coverage if he/she got hit as a pedestrian or bicyclist. Hi, so neither party had insurance at the time of the accident? The fact that you got insurnace after the date of the accident has no impact. Its what you had at the time of the accident. Sounds like the only option you have is to go after the individual who caused the accident personally. But if she or he doesn't have insurance they may not have any assets to go after.

I was in a accident with a friend in Florida , he has uninsured motorist insurance and we were hit by a careless driver (who has no bodily injury insurance & was driving a company car) causing the front of the car to be smashed in . No one in my house wanted there insurance bill to go up because of a claim and I have no car nor car insurance ... would I still be entitled to recovery funds in this situation? Thanks for your time

Hi. We have UMBI. My husband and i were involved in a pile up with over 25 vehicles involved. I have multiple injuries: broken tail bone, needed surgery, broken spine disks, hospital stay. Can you give me an example on a commercial auto policy where damages or bodily injury caused by an Uninsured Motorist or Under Insured would not be picked up under another policy. My employees injuries would be picked up by my WC policy. My damages would be picked up by my collision, and because it’s a not at fault accident, my rates wouldn’t be affected. I’m told that because my company assumed the liability of a third party, I now leave myself open to a $1mil lawsuit from my own employee on top of the WC benefits he’s already getting. Am I paying more to invite more liability than I otherwise would?

Hi, I recently got an accident by someone who is in fault and do not have good coverage/under insured. I claimed to my insurance about this accident. My car got total lost, and I was not injured. By the way, I have UM coverage. My insurance company pay me only the damage of the car after deductable. Now I have few questions to ask. Why is my insurance keep the deductible when I have UM coverage? Why I didn't get paid for the wages I lost even though I wasn't hospitalized? Hello, I'm not entirely sure I understand. But in general, if the driver who hit you and you use your insurance to pay the property damage, you will not get your deductible back. As far as your lost wages, you may be entitled to that from your own auto policy but I don't normally see that.

Hi, I'm not sure i entirely understand what you're asking. But perhaps you're asking about the effect on your UIM claim if you sign a release with the defendant. If that's what you're asking, what you should do is get approval from your UIM provider in writing to accept the 3d party offer. At least in IL ...

Sorry to hear this. First, you can try and go after the driver's boyfriend's insurance if he has any. You can go after your own uninsured motorist coverage to get the car fixed if you have that coverage. Second, the woman your daughter ran into could theoretically come after you but I don't think that's feasible. She did nothing wrong = was not negligent. Maybe your state law says something different but unless your daughter was somehow at fault, I don't see how that woman could come after her. If in the end there is no insurance, your only option would be small claims court against the defendants. Sorry. Barry

Hi me, my wife, my daughter got caught in an accident last week the other driver was at fault and T boned us on the passenger and totalled my frame but luckily my family weren't seriously injured although my wife was sent to the hospital. The police wouldn't give out the at fault drivers information other than he was driving a suspended license and everything else would be in the police report. Hi Barry, Question: Is there ever a good time NOT to buy this coverage as a Corp? I’m in CA and work for a large company, and a gal we worked with (driving the Company Owned Car) was killed. (She was not at fault, he was driving as an individual (with adequate limits) for CA. The Claimant I worked with and was killed - her husband was compensated for her death claim thru CA WC & the other driver’s insurance (about $100K). Apparently my company waived the UM/UIM due to a large amount of auto claims the fleet had. Does this save the Corp money? Because from what I hear they had to elect not to offer UM/UIM because the carrier wouldn’t offer it. (Should she have been compensated by our company further? Isn’t the damage to the company vehicle damage paid by the company Auto insurance policy? And any death or bodily injury - shouldn’t that be covered under the the work comp policy? Just curious why the lawyer went from the at fault driver - to the Company insurance. Then when the UM/UIM was waived,...the attorney seemed out of options. Isn’t that good for the company (sadly) because they don’t have to pay the husband of my co-worker who was driving a car that was given to her? Or should the company always carry it (if they can - which they couldn’t because their claims were really bad). Thoughts?

Hi, I can't really comment on a 'strategic' decision made by the company. Sounds awful to me personally though. However, in addition to the 3d party claim against the other driver, she has a workers' comp claim of course which I'm sure they've grabbed. Terrible situation. Really lousy that they denied UM or UIM for cost saving purposes (from the standpoint of a p.i. attorney at least).

LawFull Thx so much for the response! Apparently, they’ve had some tough losses in the past as well. They had a Hired & Non-Owned fatality (Corp was at fault). But this was before I got there,...so at least 7-8 years back. According to upper management it wasn’t an option on the large commercial Auto policy (which they said is included in their Prop/Liab, at least I believe it is). The entire thing is just really sad & always is when you lose a business associate. They’re like family. Even worse, the other driver in this instance who perished (and was at fault) had been celebrating his new job earlier in the day and was intoxicated. I guess when it rains it pours sir! Thx again for answering my questions. I’m not good with the law or know what you attorneys do. However, I know just enough about insurance to be a little dangerous! ;) But not much more than that! This guy was driving a company truck was not under the insurance not only that they only have minimum coverage, they are not gonna cover me I was hurt pretty bad three weeks without work, I had to return to work because I have to pay bills with a bad back. How is it that he was in the course and scope of his employment driving the vehicle but he was not covered under their insurance? You should get a local lawyer would be my recommendation. That doesn't sound right. You can turn to your insurance if you have uninsured motorist coverage. Did you file a claim yet?

LawFull it’s just a small landscaping company and the driver was a temporary employee according to the owner and was not on the policy he did not have a valid license and was taken by police, was let go because he had no record. I don’t have um didn’t think I needed it until now. I filled a claim with their insurance but looks like their not gonna cover me,neither will mine. I’m thinking about getting a lawyer but I don’t want to get one that is basically going to take 70% of everything how can I find someone that I could pay to file a law suit without taking all the benefit. I’m not seekin a lot of money I just want to be compensated for what’s right.

@@9erempire549 A personal injury lawyer will normally take a third of the recovery some take 40 percent if they have to file suit. I'm biased of course but I usually recommend if there are injuries involved to get a lawyer....

I was injured in Ohio back in September. Nothing broken just serious neck and back pains. Treated with steroids and muscle relaxers. Also 7 visits to a chiropractor. Current pain levels are low enough to where I think diet and exercise will eliminate. All State is offering $1500 in pain and suffering and I feel that is extremely low. @@kstutz81 Good morning, aside from sub standard carriers, I've found Allstate to be the worst company to deal with. So I'm not surprised to hear this at all. However, your medical bills are probably modest and 7 visits to a chiro is not something that will move any insurance company to compensate you for your pain and suffering. I think it's unlikely they will go much higher if at all I'm sorry to say. At least without an attorney. Did you see an ortho, get a MRI and/or have any PT or other treatment? Thanks for the note. Good morning. First, regarding the value of your car, you can fight that. Find out what the appeal procedures are in your insurance policy and get your own appraisal and appeal their decision. Sounds like typical ins co b.s. As far as the injuries, depends on if you have uninsured motorist coverage. If so, you can go after your own insurance for your injuries. I would speak with an attorney asap about this. If you do have uninsured motorist coverage, I might know someone in your general area who can help.

Hi, is your car a total loss? If so, then the insurance car will pay the actual cash value of the car and no more. . . Sounds like that is what is happening. If you don't like that result, you will have to appeal their decision. Ask them how to appeal and act asap.
