I learned this lesson when I was 19. Cops showed up at my place to talk to me and my roommate about an issue at a party. We cooperated because we had nothing to hide and ended up in a holding cell for 12 hours. When we went to court the judge thank God told cop they had no right or evidence to have brought us in and released us. Ever since that I've said i will never cooperate. No warrant, have a nice day. No warrant, nope you can't look in my car.

Way I see it the bad cops have ruined it for the good ones and this is just how it's gonna be. No warrant, no cooperation. So when people say just cooperate it's easier i just laugh.

Indiana supreme Court ruled a couple years ago that during a consensual encounter if an officer puts his foot across the door without a warrant or exigent circumstances he is violating the Fourth Amendment and trespassing. They ruled as well that repeatedly slamming the door on the cop's foot is a perfectly acceptable use of force to prevent unlawful trespass by an armed individual even if that individual happens to have a badge.

Never trust a cop. I was with friends on my motorcycle and we were taking a break at a gas station when 4 cops showed up. (They were patrolling the road we were riding so it was kinda expected.) They were just being all friendly and chatting with us asking about our bikes and if we did track days, that kind of thing. One cop asked me if I ever tracked my car. I told him "no." He asked, "Why not? What kind of car do you have?" I told him what it was and he lost interest. One of the other officers told me that the one cop was asking about my car because the day before he had a guy who looked like me run from him in a BMW. Lesson Learned: Even in a seemingly innocent conversation the cops may be trying to hem you up and you shouldn't talk to them.

Besides civilian life and as a motorist in general, after 6+ million miles as a professional driver and the correspondingly high number of LEO interactions because of the statistical probability that goes with it, I can't remember EVER having a conversation with a cop that didn't immediately involve a series of stupid unrelated questions by the cop. They are absolute professionals at leading you verbally into entrapment. Even if you've done nothing nefarious whatsoever.

I had four kids. I trained them to NEVER answer the door, period, from the time they were little. If someone we invited was in the driveway, we'd get a call and let them in. My kids (all in their twenties) still have never answered a knock or doorbell ring. Of that, I am proud.

Its meaning is “I am infringing on your liberty” If someone is ACTUALLY endangering officers they don’t utter that phrase, they take action to address the danger. You're thinking too logical and rational. Whatever the call claims is almost incidental. It's technically entirely subjective. What is objective is that there was a call placed. That's how it appears to work. "We got a call purple monkey dishwasher xyz 123." Everything past "we got a call" is just window dressing for them to claim RAS, with the end goal of establishing probable cause to lead to escalating consequences. The call could've said anything at all about you. They dont care whether you are or not. That is irrelevant and immaterial and is acttally hearsay. The details are "hearsay" but the call is an objective fact. It's very backwards thinking but that seems to be how it actually works. They got a call, so now they have RAS and they're there to "investigate" "ask a few questions that will only take a few minutes of your time". To see if they can escalate to detainment, probable cause and hopefully arrest. Because they got a call. And no one would ever make anything up when talking to the police, except when the police want to talk to them, then they suddenly the cops don't believe anything they're hearing.

Here's a good one, police knock on your door, open door. We got a request to do a welfare check on Charlie, we need you to step outside. Um, no, everything is fine here. At that point, close the door and lock it. Lock all doors. They will try to come in anyway possible, right or not. Officers will also cover their badge or hold one hand up high. The reason is to have a hand higher is so they can reach inside the door and grab you quicker. Then they grab the edge of the door. If you happen to close the door on their hand then its "assault on a leo". Or they hit their hand on the door jamb or edge of the door. Any excuse is justifiable. Like this guy says, "don't answer your door". Make them show you any paperwork through the glass or slide it under the door. Law enforcement are not your friend. They are just collection agents for the city, county or state. Anything they can do to rack up fines.

Funny enough, cop just showed up at my door. I opened the window to speak through there, asked him what he wanted. He "just wanted to talk to me". He wanted my ID for some reason. Not happening. He kept saying he wanted to talk to me and I kept telling him we are talking. He said he wasn't going to play my games so I said "ok?" and shut the window. No clue what he wanted. Not even from my city. Not my problem

In fact, they're hoping you don't know your they will do everything possible to TRICK YOU into giving up those rights. I went to my boyfriend’s house one Saturday night. He lived with his mother but she was out of state for several months and his sister and her husband were staying there while she was gone. Unbeknownst to me, his youngest brother had thrown a party and there were about fifty people there outside. The police showed up shortly after, so I just stayed inside with my boyfriend, planning on staying the night. Everyone immediately left. The door was open and about eight officers were lining the steps up to the top step. They stood there for over an hour trying to talk us into leaving after I told them the situation. We were standing quietly in the kitchen. Finally after a good hour, I asked my boyfriend if he wanted to stay at my apartment. I wasn’t drinking and I didn’t do drugs. Just before we reached the door, they reached in and grabbed us and arrested us. I was shocked and scared. They still wouldn’t leave for another hour. They wanted his sister and her husband to come out too! We had to spend the night in jail, but the charges were filed, thankfully. Dirty Augusta, Maine cops.

To get to my primary front door you have to get past 2 gates and porch door. All should be locked and there is a door bell at the first gate. We taught the kids years ago to not talk to the police and to insist on mom/dad or lawyer. It costs us a little to keep a lawyer on retainer to just answer a call from the kids but its cheap per year when not used. This all started nearly2 decades ago when we were turned in to CPS for the kids playing in the yard in a sprinkler. They were 5 and 2 at the time and just in shorts/diaper. Some how that was a crime. Once we were on their radar we had constant issues with code enforcement. Being pulled over 'your tag light is out' 'you have mud on your license plate' and other harassments.

Got pulled over for speeding a couple of weeks ago. Rolled my window down about 2 inches. The cop asked me to roll it down all the way. I told him it wasn't going to happen. He reacted like someone had just slapped him in the face. He was so shocked. He asked me again, actually he demanded again that I roll it down all the way. I told him to give it up, it wasn't going to happen and let's move on to why he pulled me over. He said I was doing 90 in a 70 mile an hour zone. I told him the maximum speed limit on the stretch of road I was on was 60, and if he wanted to tell the judge there was somehow magically a 70 mile an hour zone that appeared out of nowhere he was welcome to give it a try. Then I pointed to my cell phone camera that was recording him. Once he saw that, he told me just to go on my way and be more careful next time. He never even got around to asking for my license or papers.

I love how Mr. Hampton is so comprehensive, in the heads-up forecast he gives you, into possible scenarios and events that could absolutely transpire, based upon his years of experience handling client cases. He talks alot more in-depth about all the in-between and little stuff, to give you a more complete picture, than other lawyers on KZbin, of what possibly could happen, in a real world scenario......better preparing you. Plus, he's very down-to-earth, and even strikes me comically, with his cander. Needles to say, I'm a fan. Having said the above, I however, do believe, there is one very big flaw in his advice, generally........a dangerous one: You can make all the legal statements you want to police, on scene, at your house, in your car, at a business, on private property, on public property, wherever. The big problem is: those environments are not a court room.......and the same dynamics and safeguards are not at play, as such ........your legal proclamations don't mean a hill of beans to those that regularily lie, set people up, beat people up, wrongfully arrest people, or otherwise, don't follow the law themselves. Do you really believe, cops routinely respect, take note of, and adhere to the requirements of your professed excercised rights, and even make the court aware, you made these statements to them???!!!! Do you really believe, they aren't going to turn their body cams on and off, to suit their needs and wants??!!!.....capturing what they want to capture, and making sure it's not on at key times, and expected events. As an example, do you really believe, the governments that empower these crooks with badges are going to safeguard body cam footage that potentially has millions of dollars worth of damaging police brutality footage recorded......making sure it isn't erased, lost, damaged, defective, or had experienced a technical issue, at time of recording??!!! The only flaw in Mr. Hampton's advice is the reliance upon the high degree of assumption, the police will follow the law themselves, MOST of the time, and acknowledge your verbal excercision of your rights, respect them, and allow it to guide their proceeding behavior. I think, most people know this is NOT to be relied upon, in their real world experiences with law enforcement, and can even serve to escalate potentially dangerous reactions in the police. At best, it shows not to change much of their behavior. It would be a better bet to say: you can more rely upon their likelyhood to lie, and ignore your rights. I think the proceeding statement resonates with more people as being true. Truth of it is: you don't have any rights, without a recording device running, that you own, recording your encounter with law enforcement, and recording the fact that you verbally excercised and invoked certain rights on scene.......and it was recorded by YOU; ideally, by a hidden recorder of some kind, i.e., camera, audio mic, etc., that you own. In general, I think, Mr. Hampton's advice is good........if you have a way of capturing what really happened, and how you really responded; and, it not being left up to a bunch of lieing cops to tell the court what you did, and what their suspect footage shows. When you're dealing with better cops, that uphold and adhere to the law, his advice is complete, and effective. Problem is: there are too many cops on a power trip, with personality disorders, psychological problems, or are thinly veiled criminals themselves, who got into law enforcement because of so little prior credential or accomplishment necessitated. Others just have low character, or are "small people", with little principals, ethics, or morals, restraining their behavior. Legal verbalizations won't protect you against all these bad apples......AND, a lopsided, bias, and corrupt justice system. Better take precautions of your own, to safeguard yourself and love ones; don't rely on others to protect you; protect yourself, proactively, using your own recording equipment.........hidden recording equipment.

There are also similar door bell/camera systems that are not connected to a provider, but records everything on a stand alone computer or disk. I agree that Ring cameras are accessible for cops in quite a lot of circumstances. I wouldn't install a Ring doorbell in my house neither.!

True in the past. BUT as of January 2024, Ring has disabled a feature in its Neighbors app that allowed police to request footage without a warrant. Moving forward, police and public safety agencies will need a search warrant to request footage from Ring cameras.

Ring cameras are not bad? You can use them without the paid subscription. The sub is just for storing your videos on the cloud for you. It's great when people can afford to install a closed circuit security system, but it is out of reach for anyone who is poor or renting. Ring cameras are now starting to come prewired in apartments. Use whatever resources you can to smite these pigs. (Edit: I have seen further down that Ring often cooperates with the police who want to access your video cloud storage :/ so ig don't commit crimes in front of your camera? I'm not sure if other brands like Google's Nest system also gives away our information.)

@@panicwithcompulsionYes. You are correct. Ring, Nest, Google all have fine print in their terms and conditions agreement that gives LEO full access to your footage with a warrant. There’s a case where a Ring customer who has interior and exterior cameras throughout his house where his doorbell camera recorded an incident across the street. Leo demanded footage and he refused. Leo obtained a warrant and got the footage, problem is that Ring gave Leo the footage from all his cameras including the interior cameras where he is walking around in his skivies. He sued but lost because in order to “use” the Ring camera you have to agree to the terms and conditions.

So, the bottom line is, if you do encounter an officer, you can either A) make sure you get on your phone and ignore them, then let that emotional cork pop! Scream, kick, fight, spit, yell, and always know that YOU are always far more knowledgeable about the law than the police. Especially if you watch TV a lot. OR... B) comply with lawful orders, exit the vehicle, stand over there, basically behave like an adult, and you'll be on your way within minutes. If it were not ALL the people who choose A, youtube would be boring!

in most states, police can not go past a closed gate (providing you have an accompanying fence) without a warrant, probable cause, or exigent circumstances. Same thing with a FULLY closed garage door.

I feel that for reasons like this, the courts were out of line when they started changing the 4A, back during prohibition. They changed it at that time to capture bootleggers transporting booze.

I'm a big fan of security screen doors. Heavy metal screen door that is locked. You can open your front door and freely talk to the anyone at the door (if you want to do that), but there is still a locked door between you and them. If you decide you don't want to talk anymore, you can close your front door and there's nothing they can do to stop you.

#1 If the cop has his foot across the threshold, he has entered into your home, the threshold is the dividing line between out and in. Without a warrant he has violated the law. #2 Curtilage. Your property outside has the same protections as your property inside WITH the exception that like anyone else, they CAN go to your door for the purpose of knocking and making contact. Once you direct them to leave, legally they must leave. We know they won't, they don't care about the law they are supposed to uphold or the Rights they are to preserve and defend.

@@Skipbo000 Any door can be opened with enough time and knowledge. I was a medic attached to army infantry. Their idea of a “welcome” was to show me how to do their job. Their door busting techniques showed me anything outside a vault door can be broken into pretty quickly. The idea is to slow the intruder enough to mount a defense. It may only take a minute to bust down your door(s) but that’s a minute you can get a gun and/or hide.

I have only had two clients that stepped back into their home where the police entered it without reasonable suspicion, and in both cases, the officers were disciplined, (one terminated) and the county paid a settlement. In one of the cases, I got the evidence of a crime (a minor one committed by the child of the home owner) suppressed due to the illegal entry and search. The advice to not wrestle a door away from an officer is very good advice. Simply tell the officer that you are not giving them permission to enter your home, and that you are ordering (yes you can use the word ordering) them to exit your home (the threshold crossed by their hand, foot, notebook, baton, or anything else that prohibits you from closing it, makes it a criminal trespass). If they do not remove themselves from your home. Walk into your home, call someone (preferably video) and tell them to start recording. Ignore anything further from the police UNLESS they order you to exit the home. And GOD help them if they do not have reasonable suspicion, or probable cause (close to the same thing but there is a difference) to order you out, or enter your home, if I am representing you. On the second occurrence I spoke about, I had just less than a year prior raked two officers, a sergeant, and a lieutenant over the coals for an illegal entry, and search. When I got to the jail, and spoke with my client, I went directly to the chief, and told him that if half of what my client said was true, the last encounter would seem like foreplay compared to this one. I told the chief that my client has multiple cameras inside, and outside his home that upload via a cell signal in addition to the hard drive storage in his home. The chief got on the phone and said (and I quote while censoring a bit) "I want those fu@king reports on my desk in five minutes". I went to my car and downloaded the video to my tablet, and in less than an hour, went back inside and sat with the chief (and the prosecutor he called) and showed them the home security videos. I told him that I had an associate getting a subpoena for the body, and car camera videos and if they wanted to mitigate the fallout, they might want to have them ready when the subpoena got there. While we were waiting the chief accessed the body camera from the lead officer, and before the subpoena arrived, my client was sitting with me in the chief's office. The chief prosecutor came in and advised that there would be no charges against my client and she had all of the items confiscated by the officers in a box for him to take home. She started talking about how their mitigation would avoid any further need for discussion. I told her that my client and I would confer AFTER viewing all of the videos, but if they supported even a fraction of what his security video showed, they better spend their time coming up with a compensation package. IT WAS BIGGGGGGG ! !

May I ask, in this video he talks about the officer pulling the driver from the car and that is almost always a pat down or search. I thought Terry set up a second benchmark besides the stop. Reasonable Articulable suspicion the specific person is both armed and dangerous in order for the pat down to be legal. The officer must articulate their reasonable suspicion to a judge, jury, and possibly their supervisor (if their local policy requires). Officers are NOT required to articulate anything to the suspect, or detainee. If the officer was required to articulate to the suspect, or detainee, the sovcits, and frauditards would simply continue to argue that they did not consider the officer's elements sufficient.

I have literally never had this happen and I am an old guy who has lived in major cities my entire life. The only time the police have knocked on my door was to tell me that my neighbor’s house had been broken into, a parked car had been broken into, or that there had been a car accident in front of my house and to ask if I witnessed anything that might help. I am not saying this never happens but, as a retired attorney, I will point out that a criminal defense attorney might have a skewed view of reality.

As for screen doors, I would recommend buying the best one you can afford, and always keep it locked, just like your entry door. I've seen videos where police will open screen doors to knock on the entry door. If you're stopped, hit the lock button before the cop walks up. And any time you park your car and put it in park, hit the lock button immediately. Especially if you own a Hyundai. All doors on this make unlock immediately when you put it in Park. I've seen videos of police walking up and opening car doors without warning.

I had an emergency situation where my blood pressure went way high and I could not breathe.. I called 911 for an ambulance.. I locked the door and closed the garage door behind me all locked up.. I also have a cat inside I did not want to get loose Will a cop showed up with the ambulance and told me I could not have the Spyderco knife which is clipped to my pocket in the ambulance.. so I took the knife and handed it to the cop and said put it in the bed of my pickup truck... The cop said oh let me put it in the house for you! .. I told him the house was locked and I did not want my cat to get loose... Just put it in the bed of the pickup truck it'll be fine... He then repeated AGAIN .. oh I can put it in your house for you 😂.. no just put it in the bed of the pickup truck please it'll be fine.... That cop was trying to get in my house and get my permission to go in so he could walk around and see what he could see if there was anything illegal in there believe me I know!

This seems like an excellent explanation. Description of what to do in your home is very good. In the car make sure your doors are locked and your window is only down an inch or so. In most states you only have to display your papers not hand them over. Say you invoke your fifth amendment right not to speak and then clam up. Stay in your car for "everyone's safety."

Talk to them through the door, this really annoys them.😂😂😂 Also make sure that you have a video of them on the outside and you on the inside, this way they can't claim oh well they cocked a weapon. And make sure both video cameras also have audio recording, so they can't claim you said something that you didn't. And above all make sure that these video cameras are recording to the cloud so they can't just destroy the camera. Cuz you know police are so trustworthy when it comes to evidence...

I had this happen to me in Oregon. Our former daughter in law went bat chit crazy one morning and broke a laptop over our son's head. I went upstairs to find out what all the fighting was about and when I got into their bedroom she bull rushed me. I pushed her off of me and told her "you aren't gonna play that crap with me!" She went into their bathroom and called the police and said I assaulted her. The cops show up, do their thing, then they tell me "whenever we get a domestic disturbance call SOMEONE is going to jail, and today that someone is YOU." As my father, a former Deputy Sheriff, once told me, "son, we dont have a justice system, we have a legal system, and there's a big difference!"

If a cop stops you, you are UNDER ARREST, the first statement you make is "Am I Free to Go?", if he says yes then go! If he says no then you say "From this point forward I will be exercising ALL of my rights and do not consent to any questions, searches, seizures, and any actions!" You dont need to roll down the window at all. In many states, you only need to present your license and documents to the window, not surrender possession of your documents.

Great video. I think if you are in your car, a speaker should be placed on the roof of your car and you can keep all of your windows rolled up! With the speaker , you can talk and listen to the officer. That sounds totally legals to me.

I do not talk to law enforcement for any reason. I lock the doors and crack the drivers window 1/4", enough to pass any ticket through and no more. I turn off my vehicle, and place my keys upon the dash. I already keep my license and insurance in a clear document holder in my consol, which while I am driving I place on my dash. I place that holder up to the window so that they can read it and/or photograph it. I do not surrender either into their custody. I keep my right hand on the wheel while my left holds up my documents. Most importantly, I record everything with my dash camera, rear camera, and my phone camera with is facing me. A cop got sassy with me once, but when I slowly pointed at the phone with my right hand and back to him he shut up real quick. Wrote me a warning and let me go. I should add that my document holder has 3 slots. One for my license, one for my insurance card, and a third for a small card that in bold capital font clearly states that I reserve my 5th Amendment right to remain silent and I will be not be answering any questions.

As a matter of law and fact, if the police or any other citizen have crossed the door's threshold, to grab the door to hold it open or even put a foot into the door, they have made an unlawful entry into the home. That is a felony. Also, anything that is said by the citizen at that time should not be admissable in court.

11:13 When I lived in Rhode Island... my reflex action was to hold my license and registration out of the window... effectively showing my hand, and sparing the cop from having to ask me for them, as I would just assume I was being pulled over for a tail light, or minor speeding.

In my experience, being courteous will get you out of minor tickets when pulled over. I've been pulled over a few times for having a taillight out, expired tags, etc, and everytime, I roll the window down all the way, am very polite, hand over driver's license & insurance right away, call the officer "sir". Each time I've had them not only thank me for being polite but they've all just given me a 30 day fix it warning instead of a fine. One officer even told me "because of your courteousy I'm just going to give you a warning today ma'am." Giving a nasty attitude right off the bat is a bad idea like you said.

Your suggestion of having a ring camera or similar device is excellent - I think it’s even more important to have one in case of a house invasion. That way you can see who’s out there and talk to him without getting near the door. You should never open the door door if you don’t know who is there - friend OR foe!

I don't answer the door for any unexpected visitors. I have long since installed barricade brackets on all entrance doors. I have also reset my irrigation system to cover the front porch and front walk up.for persistent trespassers who won't take a hint.

I have had cops try to open my front door which I always keep locked. They vigorously bang on my door but I don’t ever answer. They start screaming and I call 911 and say that I have men in uniform that appear to be impersonating officers and have guns. The state police come and they are arguing with each other
