Question: Lawyers often say do not let the police into your house, even if it they state it as can I come in from out of the rain or cold or sun, because even under that pretense they have more legal "authority" to look around inside because you did agree to let them in. So what if they are on your curtilage (ie your porch) and you don't tell them to sand on the lawn by the curb? Does this then give them more legal "authority" to come inside merely because one didn't tell them to get off the porch?

Right? What they are saying is that because he reasonably believed that the innocent man was the suspect that fled a traffic stop, that made it okay to shoot him dead. So the court is saying it would have been fine with this cop becoming judge, jury, and executioner of the actual suspect? Wtf kind of logic is that? There was a trial. Joseph Johnson in Idaho. There is body cam footage that was used in court, IDK if it's released anywhere. He was armed in his yard, cop went in his yard, there was a standoff of some sort that was very very short where the cop never identified as LE and shot as the man was yelling "this is my yard" or something to that effect. He was in grey sweatpants and either barefoot or in slippers, whereas the guy getting chased has tan pants and shoes on. The cop had a trial. You know that he got 100000% benefit from being a cop. What he did was outrageous. It wasn't as cut and dry as a guy in a lounge chair getting shot in the back by a sneaking in cop, but it wasn't what I would consider justified.

Why didn’t the officer confirm the identity of the man in his own yard? If the man was unarmed why would the officer fire at him without making sure he had a weapon and was an eminent threat? Why didn’t the officer confirm he was the person they were searching for? Did he give any commands to the man in his own yard? It sounds like he crept in and shot the man without any intention of an arrest. The officer having a right to be in the man’s yard because of exigent circumstances does nothing to explain or justify what he did once he was there. It sounds like it was a terrible lawyer that represented the family of the victim and made a stupid argument the basis of his law suit. What kind of corrupt judge would allow an officer to get away with something like this.

Since 2015 going through my divorce I have found that after the installation of my 6-foot fence, a locked gate with a hot wire on it along with a camera system and two big dogs, are a pretty effective deterrence from police messing with me anymore.

My court case for growing and possession of cannabis was thrown out after county cops ignored my trespass signs, breached my perimeter fence and caught me harvesting a dozen or so 6' plants blooming inside my well house. They arrested me, confiscated my lights & well equipment, stole my crops, and claimed I was trespassing on uninhabited land. Sure, I won in court, but it was a big loss financially that I never recovered from because my "win" pissed off the corrupt sheriffs and put a target on my back and before long they came up with new fabricated reasons to bust me with sheer vengeance ...

To the cop killing the guy in his back yard... according to testimony, a "male" fled a traffic stop. The officer gave pursuit checking various properties, saw Joe Johnson and automatically ASSUMED "It's him! I got my guy!" And without a word, murdered him in cold blood. Not one "Freeze! Place your hands where I can see them! etc." No, he just shot the guy automatically. And then he gets a free pass by claiming "I was in hot pursuit! I thought it was him!" My questions... did Joe Johnson appear panicked? Was Joe Johnson sweaty, out of breath, etc? Afterall, the criminal had fled (running, evading, jumping fences, etc). If Joe Johnson was the suspect, he would be nervous, fearful, tired, out of breath and sweaty, NOT sitting comfortably, cool as a cucumber in his own backyard. Did Joe Johnson look like (similar) to the fleeing criminal? Did the officer know what the suspect look like? Did the officer see the suspect personally or was he going off a general description? Did any of this come up at trial? According to "cop logic," ANY male in their backyard that day WAS the suspect and was fair game to be murdered without prejudice. This cop's attitude was "I WILL get my man and NOTHING is going to stand in my way!" and it didn't matter which man (male) it was. A man was killed over a traffic infraction (don't know the circumstances). I don't know about anyone else but the police's response seems kind of disproportionate to me. Someone fled to evade a potential arrest, and that justifies a death warrant for the suspect. Fleeing a cop = automatic death? Like OJ, this cop needs to be tried in civil court (if he hasn't already). Joe Johnson NEEDS justice and criminal thugs with a badge NEED to be held accountable.

By the by: You also can't fence many front areas, at least not with a privacy fence. There was a video with someone who had a locked gate in Texas? (southern state, Republican led) where the police officers were responding to a call. They heard something in the back yard, smashed open the fence gate, which had a sign on it: DO NOT OPEN GATE - CALL FOR ACCESS (#) - DOGS IN BACK YARD Then they shot the dogs, looked until they figured out nobody was around, and left. They didn't get in an ounce of trouble. The courts will play twister to give police an exception and eliminate liability.

I have a long driveway that looks like a dirt road, cops used to sit on my driveway to set up a speed trap even though I had “no trespassing, violators will be shot” sign and a locked gate. They would “accidentally” break the lock and say it was open so they didn’t know it was a private road. When I added “badges are not exceptions” to the sign they suddenly stopped showing up

A cop did this a couple blocks from my house and killed the dog in the backyard. Some mom called the police and said her kid is missing. The cop started checking the neighborhood and that's when he went into a random backyard and killed the dog. The court ruled on the police siad. The kid was eventually found sleeping in his own closet, never left the house.

A person with common sense would understand that sometimes backyards have dogs and sometimes those dogs are large. The problem is many areas do not allow a solid fence to be built, and height restrictions often make such a fence technically not a privacy fence. Plus, we live in a delivery society. Even remote locations have weekly deliveries. It's ridiculous that we have to wall ourselves off, not have an Amazon, or UPS or FedEx deliveries, just to keep police from violating our privacy.

Fire Dept can still get through this or the driveway with some force using FD rated break away bolts and hardware. Since when is an open door assumed under any law to be an invitation for anyone and everyone to just enter the home? I have never known anyone who opened their front door with the intention of allowing any stranger to walk on in. Was the officer honestly and credibly concerned for the safety of the kids, or was it more likely that he was afraid he wouldn't be able to catch them later?

Guitar player here. One night a few years ago after too many beers I had my music blasting through my PA system. It was too loud no doubt. I didn't answer the front door because I never heard the knock. Then I see a cop standing on my back deck out the kitchen slider (my backyard is fenced and gated, no lock, no sign). I turned the music down or off and opened my back slider. I greeted the cop politely, I walk over to my PA system to make sure it was off, and the cop just walked into my house through the open door. I didn't pay too much attention at the time because I was half in the bag, but my cop buddy tells me they will do this because you "invited" them in. This was a turning point in my life. I absolutely HATE the police. You can blame me if you want but I saw the cop and turned my PA off. I didn't realize I lost my Constitutional rights just because I was a bad neighbor. I detest all cops! And btw, I won't play my music that loud anymore. I will freely admit I was a bad neighbor.

I have always advocated the hardening of not only dwelling and other structures, but exterior property as well, to include ANY property to the property lines. Exterior property can be protected by heave gates, tall and secure bar fencing, sally port-style entrances to include roadways and walk up gated aisles. Denying physical access to your property and residence will in most cases prevent criminals (state sponsored and freelance) from going further. Yes it can be expensive to do this, but it is one way of helping to reduce interaction with law enforcement.

Automated machine gun turrets come to mind wih anti personnel mines (like the old bouncing Betty's) So do RPG launchers. And a splattering of anti tank mines. Oh a wide deep moat helps. You can install an EMP net too that emits EMP coupled with high powered automated lasers. Of course no fortress would be complete without those infrared cameras. Far too many rights are violated in the name of public safety. Inside the house instead of water sprinklers, have flamethrowers that will destroy everything. Chasing a jaywalker or speeder or 'driving' without tags, into a house does not warrant trampling of anyone's rights. Founders were very clear about the need to legitimately obtain a search warrant. IMHO, no seizure warrants allowed if only searching. Cops love to STEAL your electronics and violate your privacy, even though such things were not on the list of the warrant. And judges just love to footnote those things into every warrant.

In 1982, the local teenagers, mostly aged 14-18, had a tradition of hanging out in their cars all night in the parking lot of the burger joint next door and drinking. They also enjoyed coming over onto my front yard and relieving themselves, girls included. When I mentioned this to the cops, they told me they could only take action if the owner of the burger joint called the police. Can you imagine this happening in 2024? Somebody would be doing hard prison time for allowing something like that today.

A case has made it to the supreme Court of a woman suing city of McKinney Texas, for swat team doing over $50k damage to her house while apprehending a suspect who broke in. City refused to pay for repairs, we'll see if the court agrees to hear her case.

It can be seen how easily the cops can LIE about having a "license" and simply try your front door, and if it's UNLOCKED, just go in and claim that (1) you LET them in, voluntarily, and that (2) the door being unlocked constituted an INVITATION for ANYONE to just go right in. That's why you record, Record, RECORD all encounters with law enforcement, and have something like a RING camera that'll alert you that they're there, especially, if, say, you're in the back yard. Oh, but how often do the cops simply knock the Ring camera OFF the door jamb and CONFISCATE it? It seems the Court went to torturous lengths to justify why the cops could disregard the "No Trespassing" signage, and once the subject answered the door, simply BARGE IN for what they were after in the first place, sans warrant. IMO, that, more than their knocking on the door in disregard of the signs, should have sufficed to disallow the drugs, paraphernalia, and firearms discovered, provided the Court would believe that the subject, a convicted FELON, had refused permission to enter. HINT: he won't be believed at all. Furthermore, in most states, a felon on probation or parole is subject to having his premises, vehicle, and person searched at any time, WITHOUT notice nor a warrant, as the terms of their being released from custody include that. But if the subject is simply a felon, but has served his sentence, then, AFAIK, his 4A rights must be respected, though indeed, if the cops know that he's a felon, they'll just do what they want, knowing the courts won't give a damn about a felon's rights. I doubt the privacy fence and locked gates that the counsel advises will really do that much good to ward off abusive cops. They'll simply climb over them, or kick the gate in (and not pay for the damage) and claim an "exigent circumstance" like "they heard a woman's scream" or "welfare check". Cops have so many ways to disregard the Fourth Amendment that, for all practical purposes, it's been de facto REPEALED.

In the Peoples Republic of California, the building code states that you must obtain a permit before building a fence that will be over 6 feet tall unless the top 2 feet of the fence will be barbed wire, and, for a front yard fence, the maximum height is 42 inches. For a backyard fence, the maximum height is 72 inches. So building and exclusionary privacy fence in California just isn't going to happen, and you can damn sure bet some cop is going to have a tape measure in his car, just to make sure.

I wonder if a sign that says "No Trespassing" on it, with language beneath that reads, "This sign shall be construed in all courts to create a Special Privacy Zone for the purposes of extra 4th Amendment protections as would any other form of tall barrier preventing entry or visibility into the property, and anyone bypassing these signs and their clear language shall have agreed to forfeit any rights upon this property except those expressly granted by the property owner. This expressly includes privacy from governmental agency 'knock-and-talks', which the property owner expressly forbids, and this sign serves as notice of" would, under the courts, grant exactly that Special Privacy Zone that the courts said that the particular No Trespassing signs mentioned around the 14:00 mark didn't grant?

You spoke about the “Implied Consent”, which I presume is the same as the “Implied License”. A court ruled that the implied license can be revoked, and you can do this by posting such notice leaving them no right to enter into your property unless they specifically meet the 4th Amendment criterias of exigent circumstances, permission, or a warrant. In certain states (like the one I live in) no trespassing signs are not needed as anyone stepping on your property is well aware that it does not belong to them and in this state passage easements for foot traffic are almost non existent. Having a good fence and gates can prevent intrusion unless the cops have a valid reason and for some reason they have never opened any of my gates and come in they just toot the horn and I come to the gate to see what they want. No they have never come to investigate just usually asking if I have seen certain cars going down the road. Nearest neighbor is about a quarter mile away. Sometimes they are looking for money for a police fund.

Cops will always have "Exigent Circumstances" as all they have to say in court to justify it is that they heard a scream, they thought they saw flames in the window, and neighbor informed them of something, etc, etc, etc....the courts have shredded the Constitutional Protections we are supposed to have. My property is fences, chained, and locked and does nothing to stop them we all know this. Its like the traffic stop where they simply say they smelled drugs or you were wandering in the lane and using DWI as a reason. You have no protection from them.

Two cops tased a man during the morning rush hour. The man was having a stroke. He ran up on a median, hit a road sign. So naturally these two cops thought they had a dwi. They ordered the driver to exit the vehicle. He couldn't respond because he was having a stroke. One cop pepper sprayed this man. No effect, cause the driver was having a stroke. Then these two geniuses, rather than talk to the driver figured let's step it up. So they tased there victim. Well, cooler heads finally prevailed, and paramedics were sent for. They finally determined the poor man was having a stroke. One of these doofuses, actually resigned after realizing what he had done to his victim.
