Repair /Addition / Alternations of Flats in Co- Op Housing Society
There is a lot of dispute and complaints about water leakage issues in housing society between the society committee and its members and committee do not respond to any of the complains of its members that who shall be really held responsible for it. Might it be happened due to lack of knowledge.
Or
Society Committee don’t want to take responsibilities? What members should be do?
As per Bye - Law No. 159(a) below issue solved by committee on society cost:
Repairs at Society’s cost:
(i) All internal roads
(ii) Compound walls
(iii) External water pipe lines
(iv) Water pumps
(v) Water storage tanks
(vi) Drainage lines
(vii) Septic tanks
(viii) Stair cases
(ix) Terrace and parapet walls
(x) Structural repairs of roofs of all flats
(xi) Stair-case lights
(xii) Street lights
(xiii) Outside walls of the building/buildings
(xiv) All leakages of water including leakages due to rain water and leakages due to external common pipe line and drainage line,
(xv) Lifts
(xvi) The damaged ceiling and plaster thereon in the top floor flats on account of the leakage of the rain water through the terrace.
As per Bye - Law No. 159(b) Repairs at member’s cost:
All the repairs, not covered by the bye-law No. 159(a) shall be carried out by the members at their cost. The expenditure for the internal leakage due to toilet, sink etc should be borne by concerned flat holders, with intimation to the Society.

Hello Sir, section 159 a mentions concerned owners does it mean bot the upper and lower flat meaning the lower flat where the leakage is happening and the upper flat from whose bathroom leakage is happening

Sir who has bear the cost of repair of slab in the flat at 2nd floor of seven story building. Part portion of slab concrete has came out due to old leakage from the upper floor in past. At the time of slab portion falling there was no leakage was noticed,but it was visible the marks of leakage which was attended at the time of leakage appeared in past.

Sir. Good guidelines. Same problems in my flate. Society secretary did alll wrong thing . He is a Politicians persone cheating to society. Even if misperceptions money also. Last 3years to complient to drt also not to take any actions against society. Even if my flate leckages from 3rd floor. . 👌👌👌👌👍👍

1. What to do if there is leakage between two flats internally, how to clear out the mess? 2. We have shops in our society and 2 common toilets for their use within soc premises, who will bear the repair cost ? 3. How much remuneration can be paid to Secretary, Treasurer , chairman and committee members of the society? 4. Sir i live on the top floor of my 3 storey building . There was some leakage from my bathroom which caused damage to the exterior paintwork of my building despite attending to the problem promptly. Society wants me to not only pay for the repairs in my house but also charging me rs 25000 for damaged paintwork to the building. Am i liable to pay for it even if there is no structural or plaster damage to the building? If yes then even my house paintwork is extensively damaged due to leakage from the society terrace & water tanks. Am i eligible to get reimbursement for the painting expense that i will have to take in this regard? Thanks in advance.🙏🏼

Sir, re external leakage responsibility of Society : A) whether byelaws can provide that Society shall not bear the cost & members shall manage & bear the cost ? B) whether the leakge rules are different for CHS in multi-storey buildings & for individual ground + 1 + terrace Row Houses (10 tenements per block) C) each rowhouse has overhead tank which may need to be extensively repaired after 8-10 years. Who will manage & pay for such repairs -members of that particular block or Society

yes as it comes under classification of internal leakages and the cost will be mutually paid by two parties.

Sir my society ground floor shops security grill doors and shade were destroyed during bulding repairs...i had to make new ones...who will bear this ..i had to make new ones because they were not repairable..

There is a leakage in 3rd floor ceiling in rainy seasons only, due to external wall cracks. As there is no leakage in dry season. Means, it is not due to 4th floor. Suggest, who will bear the cost.

society need to make inspection for this, society may appoint any civil engineers, or any other vender who do this job. After their report society will discuss this in managing committee meeting and decide, who will bear the cost, society or member.

MC is responsible for it because they failed to do audit before monsoon due to their negligence you are suffering.

Already explain in video ... check the Bye Law No 45 , 46, 47 mentioned there . Write application to society and ask them reply in writing .. if society not taking any action compliant to Dy Registrar and attached all letter which you sent to society. For fast action file case in Co-Op Court.

My query....society fixes drainage pipes in duct area and due to leakages in pipelines and leakages occurred from top floor ceiling due to rains n damages in pipes etc externally fixed by society. Due to above reason seepage or leakages occur inside the flats occupied by residents. Who will be responsible for this internal leakages,seepage etc occurred due to leakages etc in pipe lines drainage pipes n from top of building roof.fixed by society

It can be done if both are mutually agreed, otherwise its your responsibility to repair and maintain your flat in good condition as per Bye Law no 45. You can read Bye Law number 45 to 47 for same.

Hello sir, Hamri bulding 2017 ready hui thi hum 2018 mai rehne aye the Mere ghar mai july 2019 mai likage hua hai aur wo issue ab tak solve nahi hua. Mere hall mai 2 jagh bedroom mai ek jagh likage hai phir bhi koi society member dyan nahi deta aur kehte hai khud se kar lijiye. Secretary response nahi deta. A ground floor member in our society is complaining about the seepage through capillary action on the external and internal wall of the society. He demands the society should stop this by putting a concrete wall from the plinth level . Is it the society's job or individual members job ? Who will bear the cost.

Apne toilet ke diwaalo aur floor ke tiles ko ukhadwaake kisi acche plumber se jin jin pipo se leakage ho raha hai woh dikh jaayega unko bandh karwaake, saare tiles ke bich mein jo gap hai usme white cement dalwaaiye, niche waala naa kabhi pareshaan hoga aur naa hi kabhi aapko karega. Samasya ke jad mein jiska shrot hai wahi samadhan ki upasthiti hogi.

Neeche wala apse jyada pareshaan hota h. Jab upar wale neighbour ki wajah se Neeche walo ke yahan seepage ki problem aati h unke yahan daily unke washroom ka Ganda paani unki balcony mein aata ho, Jisse unhe roj clean karna padta ho, unki wajah se unki wall kharab ho Jaye toh Kaun jyada pareshan Hua. Apko is liye problem lagti h kyu ki aap woh face nahi kar rahe ho ek baar yahi sab aap ke saath ho tab b aap yahi kahenge ki pareshan karte h.par kehte h na jab tak woh apke saath nahi hota tab tak aapko uss cheej se fark nahi padta. Jab problem apke yahan se ho to Neeche wala solve kaise karega. Pareshani upar wale ko is liye hoti h kyu usse money kharch nahi karni h.Sirf isliye pareshan hota h.
