Explanation of Istisna' and Istisna' Customs (equipment)
Istisna' is removing a lafadz from another lafadz by using an exception device.
Pillars of Istisna':
• Mustasna Minhu
• Mustasna
• Istisna' customs
So Istisna' is removing Mustasna from the law that happened to Mustasna Minhu with Istisna' Customs
Istisna' customs (equipment):
• It is in the form of a letter sentence, namely إلا
• In the form of Isim sentences, namely غير / سِوى / سُوى / سَواء
• It is a Fi'il sentence, namely ليس / لايكون
• There are those who think it is Fi'il and there are those who think it is a letter, namely خلا / عدا / حاشا
• Ulama' Basroh is of the opinion that the word خلا / عدا / حاشا is a jer letter, so the ism that comes after it is read jer. In its use, it should not be preceded by ما Masdariyah
• Kufa scholars argue that the word خلا / عدا / حاشا is a Fi'il sentence which means إلا (except) and its use must be preceded by ما Masdariyah
