Your last sentence is EXACTLY why it is EXTREMELY important to know a candidate's goals/intent for the position they are running PRIOR TO VOTING FOR THEM. We the People, while lacking critical thought, voted in the people who passed laws which currently grant special treatment to the self admitted criminal. The public not being educated as deemed mandatory under a yet to be enforced federal law is the actual joke. The system works when the internal gears are not metaphorically rusty. Until we enforce the aforementioned federal law, we can not expect to fix that which is seriously broken.

They simply messed filing paperwork in time up, because they didn't understand the type of trial requested and the documents required to request a different type. This is on the lawyers of T***p, and given how he can now rally around that specific point, you would almost be able to say that it would be deliberate so he can target the whole process because T***p's followers believe without any doubt anything he says, but given how many lawyers are doing superdumb things you should know you should not do as a lawyer, we need to take the fact into account that they are just stupid and literally didn't know what they were doing, or what possibilities they had. This is on the lawyers of T***p, not on the judge, who basically laid out to them: "This is how you can avoid that" and they simply didn't.

On the surface, it doesn't look like Trump is getting much punishment, but below that, it's really all just a waiting game. The easy bit is knowing that Trump is in the wrong. The hard bit is building a solid precedence (not evidence) for someone like him, that would ensure he truly doesn't get away. Look at it this way, by being lenient, it makes it easier for Trump to dig himself a grave, and harder to appeal due to bias/unfair treatment. A lot of the "Trump trials", are also new unprecedented grounds (e.g. no ex-president has ever been under trial for an attempted coup), one wrong move can easily kill someone.

The more things that restrict the presidency, the more methods a political institution would have to play a dirty game. If being charged with a crime stopped you from running for president, there could be a future where political parties in power used their criminal investigation arm to prevent their key opponent from running fairly-the exact argument currently being used by the Trump team as a smokescreen for why he's being accused. It of course feels crazy in this circumstance because of how obvious and numerous his crimes are, but by principle it should be a tightrope to walk in giving accusations (or criminal charges) a limited power to interfere with people. Convictions, on the other hand, are used as a standard to limit privileges and rights. And currently, there's nothing that stops anyone who was criminally convicted (or even still incarcerated!) from holding the office of the President.

He is totally hoping one his supporters will be inspired to use violence. If any of us said the things he had about the court, there is no doubt we would be imprisoned. He has been shown a great deal of leniency thus far, but hopefully he will actually face some consequences soon... but I doubt it.

But of course, the irony of your statement and the hypocrisy of Trump and his supporters, is lost on Trump and his supporters. :-/ For their benefit, here is the definition of Hypocrisy: _Hypocrisy is the practice of feigning to be what one is not or to believe what one does not. The word "hypocrisy" entered the English language c. 1200 with the meaning "the sin of pretending to virtue or goodness". Today, "hypocrisy" often refers to advocating behaviors that one does not practice. However, the term can also refer to other forms of pretense, such as engaging in pious or moral behaviors out of a desire for praise rather than out of genuinely pious or moral motivations._ -- Wikipedia

I am all for free speech as an idea, but sometimes as a foreigner from a country without free speech specifically and broadly codified into law (to be clear we have many speech protections, but not a broad "free speech" law as such), I often times can't help but think its a mistake to make such a broad guarantee in law. So many cases exist where speech is directly harmful to others or at such great risk of causing harm to others that I am uncomfortable with this constant struggle to show direct effects and what not. In my view Trump should have been taken into custody as a clear and present danger to witnesses and court staff long ago.

This sadly isn't an issue with the laws, it's an issue with corruption and rich people getting to pay thier way out of anything.
@dgmarie

The issue isn't when speech is harmful or has a risk of causing harm, that's far too vague and would lead to serious censorship, I think that saying things for the purpose of harming others should be illegal (like defamation, a violent threat, organizing a crime, etc.) Also saying things that you agreed to not disclose is wrong, like if you signed a contract, but there should probably be more rights for whistleblowers. Excessively limiting speech doesn't help anyone except a corrupt government, especially not in the US because these changing attitudes towards the constitution have been terrible for the people living here.

That’s an interesting aspect of the U.S. Constitution and its amendments - that it is written in broad and simple terms - and is probably a product of having mostly been written in the 18th century. Federal laws can be tailored more specifically, and beyond that it’s left to the SCOTUS to determine whether laws are permissible by the Constitution or how to deal with issues where constitutional rights are in conflict, e.g. to your point the right to freedom of speech (1st Amendment) vs. the right not to be deprived of life, liberty or property without due process of law (5th Amendment). The few US state constitutions I’ve looked at by contrast are much more verbose and tailored, though to be fair these generally deal with cases not covered by the federal constitution.

Right. There is absolutely no reason T***p should not be jailed pending trial. Unless....we agree that he deserves preferential treatment. Which, in so doing, means we agree that Justice is not equal in the eyes of the law and justice is by far not blind.

Throwing the a top presidential canidate in jail (whether you think he's #1 or #2 if the election was held tomorrow) before the trial is finished is a terrible idea unless he's running around killing people and robbing banks. Even if you think it's justified you'd be risking an actual insurrection when half the countries favored president gets locked up and stopped from campaigning. Most likely it would just be a bunch of civil unrest, but jailing any very popular political canidate from either side with a large core of ardent supporters would probably result in turmoil and even some deaths. Imagine if in 2008 we threw Obama in jail for possession of weed after he won the democratic nomination. These days with less trust in the government it would be even worse.

The issue with Trump is, while I've met moderate Trump supporters (Mostly those who voted for him as a political outsider and have since distanced themselves when it turned out he was just as much a swamp creature as everyone else), there's a *lot* of people who still hold fast to what he's saying and take everything at face value. No respect to any of them. When a normal citizen is in front of them they put them in jail and effectively force them to forfeit their jobs and family. When a politician is in front of them they blame freedom of speech and let them campaign on their crimes. No sympathy for a broken system thats happy to continue breaking itself.

Trump always gets so upset when he has to follow the same laws that we do. If he really wants the law to come down hard on criminals, he should just stop fighting. President-Law-and-Order all of a sudden doesn't like the rule of law now that he's not in charge. Tough.

The law exists to protect one group and not bind them, and bind their foes and not protect them. This is standard right wing legal theory.

Do you know what you're saying? Lets take orange man bad out of it, for a sec, A judge just told a man he couldn't criticize someone. The judge didn't say you can't can't kill someone, the judge told him he couldn't say words. You should really think about what you're cheering for. It might come for you one day.

@@BayonetRed there are known consequences for a man like him crtiticising another person (let's ignore for now how rarely his criticism is reasonable) - trumpo called out his VP & on jan 6th an angry mob assembled with the clear intent to hang him... there's legitimate political criticism, and then there's inciting your (cult-like) supporters to do harm. that trump never (rarely?) overtly calls for violence does not excuse him from the violence his words can incite. he has a responsibility as a massively public figure (and a cult-leader) & allowing him to act reguardless of the effects of his actions is madness. also & ofc: his accusations are rarely founded in reality, must we excuse the dangerous & untrue statements of a man whose followers are already found guilty of various acts of violence against persons & the state? yes, fine, i like the idea of the first amendment, but there are good reasons to find fault with speech that directly endangers others.

Poor or middle class gag violators would be jailed, but judges are not allowed to jail rich and powerful violators under our system.

By this point, it genuinely feels like Donald Trump is trying to go to prison to get martyrdom points from his base, and I hate that he'll most likely get away with it.

Trump wants to go to prison so that someone can write a book about him. A biography maybe about his personal tribulations, it could be called "My Struggle" or something.

And when he violates the order all he does is pay a fine. Which makes what he does is legal with the fee. Put him in jail for violating the order.

I can't help but wonder if it's even possible at this point to find enough people to make an impartial jury, given that it seems as though nobody has a neutral opinion of him.

It's flabbergasting that we are having this conversation about a person that should first and foremost have a hard time finding a lawyer willing to represent him.
