Because it's not only unprovable, it's false: Leonard was at the ambush, and _admitted to firing shots._ That alone would put him, in most jurisdictions, at the same level as those who killed the agents. But most people are ignorant of the law, and think that if five bank robbers go into First National but only one shoots then the other four are innocent of murder. Doesn't work that way.
