The former federal judge J. Michael Luttig, who counseled then-Vice President Mike Pence's team in the days before the 2021 U.S. Capitol attack, spoke to FRONTLINE ahead of his anticipated House Jan. 6 committee appearance.
“The plan was to overturn the election through the exploitation of what I've called the institutions of democracy and the instruments and instrumentalities of our democracy,” Luttig told FRONTLINE in a May 25, 2022, interview - his first for television.
Luttig served on the U.S. Court of Appeals for the Fourth Circuit from 1991 to 2006. Prior to his time on the bench, Luttig was assistant counsel to the president under Ronald Reagan and clerked for then-judge Antonin Scalia and for Supreme Court Justice Warren Burger. He also served as assistant attorney general in charge of the Office of Legal Counsel in the Department of Justice under George H.W. Bush. After leaving government service in 2006, he entered the private sector, where he has worked for both Boeing and Coca-Cola. He is currently retired.

What is a great concern to me is McConnell’s attitude towards our democracy and the way he has manipulated the power he wields in the senate and his manipulation of the appointment of the judiciary and the blatant language he has been using for example during the Obama’s presidency how he said he would oppose any of the actions of the president and now that he continues the same attitude with the Biden’s administration, he is the real danger.

He’s torn my family apart, such a tragedy. I have a handful of family members that are so entrenched in conspiracies and the demonization of people who support “liberal” or “progressive” ideologies.

I am a German citizen and know very little about all the details what happened at these events. This interview is one of the most outstanding interviews I have ever seen and I am deeply impressed by the humbleness of Michael Luttig and even more impressed to watch him how he considered every single word while answering the questions. The story he tells is heroic and this man literally saved America that day by tweeting his words and not even knowing how to tweet, so he had to read the instructions first. What a fascinating story and in the same time I am deeply worried now about where this political theatre is navigating. After hearing Michael's explanations I believe that there is an urgend need for America to wake up and sort out this mess. We are now in very difficult times of an imminent danger for a thrid world war and the political leaders in the leading nation of the western world have nothing better to do, than conspiring for personal and political reasons. Anyone who can should take all necessary risks, if it can provide possibly any hope to resolve this situation. What the former president did was more than obviously not ok and ist must have consequences, which are of equal gravity.

Judge Luttig is such an honest man. I'm laughing so hard just hearing what he had to go through in opening a twitter account and sending it out. He called his son desperately, to help him, with great objection. Until the judge threatened him to leave him out of his will. I am still laughing while I am writing my comments. I love you Judge, and God Bless You. Take care.

I just watched this for the fifth time. In 50 years this video will be a good source for a movie. It would have been great if Judge Luttig & Richard had recorded their phone calls. The sheer terror in their voices would have been good for future generations to hear.

Back in the day, Scalia was the sworn enemy of the left. Luttig was seen in a similar mold. Little did anyone know that it would get much worse. The Dems would have confirmed him in a heartbeat if they knew what was coming down the pipe.

They told people to go home and a few stayed and dragged out boxes of ballots and put them into the machines , also someone saw a truck outside a voting place shedding ballots and this person witnessed this and called 911 and the operator said no one was available to come and eventually the truck drove off and they called 911 three times, once they said they were on there way but nobody came.

He is undeniably a man with a brilliant mind, an extremely accomplished Judge and he has a wealth of knowledge. He had esophageal cancer mixed with his age which likely has affected his ability to speak as well as he used to. Although I fully see your point it's a bit hard to listen to for sure.

I wish every American would watch this. Although I am a lifelong Democrat, I have nothing but respect for Judge Luttig. I’ve heard so many negative statements about how “boring” his testimony on the 1/6 panel was, and I’m trying to convince everyone that this man is very important.

Some people think the person who “entertains them more” and has “bigger rallies” makes a winner. Angry, unhappy people have been directed who to hate. Who to target with violence and harassment. Who is to blame for their unfulfilling lives. Who they must fear and why. The “I alone can fix it” strategy.” It’s the result of consistent daily gaslighting and misinformation. Politicians pay people to post comments supporting their side all over social media. I have great respect for Judge Luttig. He is clearly a Republican/conservative, but has done what we expect of judges and taken party affiliation out of his legal analysis and actions with respect to the law. He wasn't doing or saying what Trump wanted like 90% of Republicans regardless of if they are judges or not. He is clearly able to be impartial and loves the country enough to do so. I don't have to agree with who he votes for to see he's a decent man of integrity and I respect that immensely.

He’ll be the first judge to be taken down in his own courtroom at gunpoint by Secret Service. All it takes is Donald J Trump to point his finger and say end him! As a non-native English speaker and writer for decades, I am heartened by Mr Luttig’s words about words. I too check and recheck even though I’m instinctively sure of their meaning. I assumed I did that because of a hidden insecurity about my command of English, though in my heart I know that I want to convey the precise meaning of my thoughts. Words are so important. I listened intently to the full interview. This wonderful judge is very clear and a great teacher for anyone who wants to learn about our democracy and what it takes!

I am rather shocked he openly said they were all passing around longer pieces about him refusing to leave office prior to the election even taking place. How was everyone so certain Trump was going to lose a month prior to the election ? That they are contacting judges and asking for the legal framework for possibilities ? But the security for the day of the actual contest has lack luster security and feds breaking windows ? Sounds like the whole legal community completely understand the possibly constitutional crisis that would have occurred if a few states had been denied and neither emerged victorious !

An astonishing interview with a conscientious and reticent man who facing a crisis summoned up a courage and integrity which exposes the extent of the crisis and the weakness that are inherent in a system in which a party leader, chief of the executive and head of the state were concentrated in one individual,. I saw a interview with Luttig over twelve months ago. Like every country the men and women whose integrity is not media centric, not bound by or to ideology are the essence of national identity and Integrity. During the four years since this nefarious monster was removed, against his will from the Office of President he has embarked on what is risiibly described as his campaign, and this campaign and this self announced candidature ante-dated the election for which he is 'campaigning' by some three years. During which time we have learned of his multifarious delinquencies and their criminal intent, their civil infractions, his incipient treachery, his misuse of state documents, any one of which would have landed a non-candidate in prison for years but this campaign holds the media in thrall rather as mesmerised birds witnessing the predatory dance of the Weasel. Just to itemise the delinquencies of which he is either sued or indicted; molesting [rape] a woman slandering and libelling his victim, and denying her very existence extensive tax evasion and fraud on a grand scale organising an insurrection detaining and then concealing classified documents organising a silencing of hostile information issued eventually by an adult actress' [Porn Start' I love the term 'adult' It adds piquancy to the infantile career of a petulant, ill educated, ignorant, stupid mendacious delinquent who was actually elected to the office of President of the USA. To try to prevent his leaving the Whitehouse he attempted various schemes, most illegal and incited a riot of his fans. The details of these activities are well known, and incite a riot utube seems concerned with little else than the career of this petulant, criminal irresponsible liar about whom further details emerge every day. Innocent Europeans except the English, whose governing party lend succour to the monster, may be surprised to learn that this 'man' liable to tantrum and patent lies and denial of Truth is not in prison for his insurrection alone, but this fiction of his being a 'candidate' and this fiction of a 'campaign' hold justice at bay by exploiting the absurd system of justice that the USA has, State courts, state appeal courts, supreme courts, and at the pinnacle of this The Supreme Court, and here is another disturbing circumstance that should cause European hair to be raised in fear, the Supreme Court is nominated by Presidents, yes! That is right, nominated by presidents. Outside the Mikado by Gilbert and Sullivan , this president nominates Supreme Court Justices, he is head of State [The Civil Society] he is the head of the executive branch which h is overtly party political, and he is party leader in so far as the spinless, the gutless, the cunning and the ambitious do his bidding with abject and pusillanimous obedience. Part of the 'entertainment' offered by the media is an interesting facet of this enthralment of party, justice and media and cretinous supporters who dull eyed lack jawed, cretins wearing red caps from under which they observe the world in total incomprehension, but they will vote for the idiot.. This Media entertainment centres on two patent absurdities, or rather three, the first being that this liar, rapist, and traitor was President and is a candidate instead of a felon serving time. This candidate, according to the constitution should be disqualified. It says so in stark and clear terms in article 3 of the Fourteenth amendment. But the tension of this 'drama and although ' lies in the fact that although the facts are known and the article explicit the lawyers outside the supreme court are not confident that the supreme courtesans, [they are kept men owned in three proven cases by a coterie of billionaires] cannot be relied upon to draw the only conclusion that would save the world from disaster; they may nuance it, they may finesse it just as they seem unable to conclude after four years that a past president is not immune from criminal prosecution. Facts and language which is explicit are not the stuff of justice for this gang of at least three suborned justices owned like courtesans by rich, self indulgent criminal billionaires. And so we hover on a precipice unless this cluster of courtesans dig deep into their despoiled integrity and conclude the obvious. That he is disqualified, and he is not immune for criminal acts committed personna propre in his own interest. Of what does his campaign for President consist? denials of patent truths attested by justices in 50 states; mendacity, lies patent lies easy to refute; claims credit for the successes of his successor; his the brass necked effrontery to accuse his successor of all the crimes of which he and his hideous party are guilty; refuting science and denying climate change; overt misogyny; patent racism. promising retribution on his opponents; promising to be a dictator and rubbishing democracy; But what about policies? Oh no! There was no policy ,only a conspiracy to return the USA to yesterday. That is to say the slogan MAGA means that it was great for white males and their amenable wives and family and a group of crooked, spineless men and trickster women aided and abet him in this crooked enterprise; Despite knowing this conspiracy,established facts and testimony there seems to be some doubt in some unscrupulous ,shady minds that he has disqualified himself,and there is still some that flirt with the notion a president is immune from prosecution, and there are some MAGA republicans that are still prepared to put a more 'favourable' complexion the episodes leading up to, including, and subsequently to this traumatic assault on the constitution by a gang and its leader. That call properly indicted and convicted felons 'hostages'. and' political prisoners' And denying this,,and obstructing his successor to solve problems they allege none the less are suffered to put these this systematic obfuscation forward in their campaigns in the country and in the House of Representative ,and do all within their power to resist ,prevent or delay the administration of justice but he has evaded justice because he is a candidate in an election not declared and so justice in this labyrinthine system is held at bay on this fatuous pretext If your grand children face adversity from climate if democracy is laid waste everywhere this man claims the credit. Just so you know what you can tell your grand children in the name of God and minced Jesus. Your Grand children's children will not survive long enough to tell the story. Donald Trump is the most disreputable man ever to stand as a candidate of the USA .It is a shame on their constitution ,on elements of the people and the power structures of the Republican Party that they are so derelict of judgment, as to have connived at his election, and seek ,irresponsibly to connive t his re-election or even to prevent his incarceration in prison. Actually everyone is a politician when trying to stop your kids from fighting. No serious 😀. As a manager with employees vs customer I have to mediate between profit and repeat business. The US Senate has cowards in it who sign laws that benefit corporations that fund their states jobs or other money coming in. The ethics of law has become bribed by monied interests. What’s the solution? Vote. Run for office.

That goes for Pence even more given that Pence would be one of those in the WH. You may not think either man did much, BUT they did enough to keep our Constitution intact... for now. Btw, I find your statements accurate with the exception of the capital murder cases. He was never involved in a bench trial of a capital murder case. He presided over jury trials, but what you've stated he did, is not possible for any judge to do in a capital murder jury trial. Perhaps, you need to fine tune your statement a bit b/c your point is not being made as it currently is.

After 40 years as a lawyer who applied the Constitution daily, and daily ,lives were at stake. I was a trial lawyer specializing in criminal law, as a prosecutor and as defense counsel. I served 16 years as a judge. I applaud Judge Luttig for his knowledge and for his courage. Like a Minuteman at a moment as our Revolutionary War began, he stepped up.

A compelling interview with a man who claimed by intention to have never publicly expressed a political view, and who despite the extraordinary political events at the core of this interview, managed to express himself with absolute clarity on all these matters without departing the slightest from his stated principles. At such a critical moment in our history, could the nation possibly have been afforded the services of a more reluctant or more capable servant of the public good?

I have lost all hope for our democracy after listening to judge Luttig. When he said our country is in a war for the morals of the country that we could not win I began to cry. I cried for all of the americans who've sacrificed so much including their lives for this country, our democracy. My heart is breaking. How did we come to this? Why are our elected officials so evil & immoral? Why have we elected such terrible people.

But witness Liz Cheney, one of the bravest souls in the US--and even though I have voted Democratic the last 20 years, cursed her father more times than I could count and didn't agree with her on most substance, she is a person, or the type of person, we desperately need as a President. Too bad most Republicans have decided to chase Trump, a cult figure, down a rabbit hole to hell. Because if they had any brains, they'd realize that Liz Cheney, or Kinzinger, or people like Judge Luttig would win most independent votes, and probably a lot of Democratic votes, because they are leaders of principle.

People of integrity, of fine moral character and able to courageously speak their truth are to be celebrated. Social media give the focus to a lot of second rate attention seekers but in a crisis one good person can lead many in the right direction. Ghandi. MLK etc. That’s worth remembering as we look to strengthen hope, diminish mistrust and cynicism.

But the outside actors now able to influence other countries are the big issue. American extremists spread pandemic misinformation and hysteria to vulnerable groups in other countries. And in politics outsiders get access to this great democracy. Putin and others have weaponised social media. Russia and Trump. Big problem.

I appreciate the time and care the judge took to explain the constitutional complexity so that people like me could understand fully what was at stake. I think most people, and I'm one of them, take our democratic institutions for granted, assume they will function to ensure the stability of our democracies (I'm in Canada). But like Americans I'm witnessing a movement of "fringe" right wing elements seeking to upend it in my own country. Trump is horrifying but he's one man who would be nowhere without enablers. When we visualize fascism, we usually think of it at its peak state and not its beginnings but it's the beginning that we should be focused on. "It can't happen here" isn't true and we're finding that out. Much thanks to PBS for producing this series and let it be known the right wing of America wants the public broadcaster suppressed just like they do in Canada.

No complaints from me about the length and slowness of this interview. What a lesson in making your words have integrity. Yes, the Tweet had the resonance of Divine inspiration, and I am so thankful for what Michael Luttig did to support Mike Pence in his moment of need. I look forward to hearing from him in the Congressional hearings on Jan 6th.

Why do the dems hate the electoral college when they lose but when they win they are the first ones to say it’s in the constitution so you can’t challenge it they only like the constitution when it helps them but saying that I know Mikey p could not turn over the elections but considering it was the most divisive election in history and it was during a pandemic where there were a lot of mail in ballots and also the way it was covered on election night that was saying trump was winning then the next day or in the middle of the night it changed what’s wrong with congress taking there time to look at things and make sure there was no cheating since democrats have absolutely been known to cheat in local elections what’s the big deal about proving to the American people that there votes were counted but I guess now it doesn’t matter because now we have Biden and the housing market is a mess inflation is thru the roof and gas is 5$ a gallon what a mess in just 2 years for the guy who was supposed to bring the country together 😂 Scranton Joe showing he does not care about middle class

As a registered Independent since the late 70’s, I’ve always voted for who I felt best or more closely represented my views and opinions, not only party. I respect this man and his wisdom. I imagine he feels quite sad to contemplate what has become of his party, particularly the last six or seven years.

I completely understand where you are coming from. It is disheartening to see this country become a laughing stalk to many. This was a country that I REALLY wanted to come into and be a Citizen of! I am proud to be an American 🇺🇸. But come on, I wish this guy was the US General Attorney. He strikes me as a trustworthy, loyal individual. We may differ in politics, but we are still humans and right is right, and wrong is wrong! Anyway, I have loved this interview and for that, I am grateful to PBS’ FRONTLINE program. What has happened to his party did not happen overnight and did not start with Trump. The GOP has been edging toward lunacy for at least 2 decades now. I totally understand this great judge’s difficulty of tweeting at this critical moment in his life. It may be the most important thing he did in his life but technology was what he had to struggle with. I am 81 and too struggle with these technologies and understand his reluctance to face the 21st century technology. He must have been shocked when he found out that his tweet was on the front page of the New York Times! I love his sons opinion of his fathers capability with this technology and his father’s threat at a critical moment, may have been the thread that saved our country from a grave injustice and a constitutional crisis. Glory to this judge for that simple tweet!

This so humanizes the Judge which makes me really respect him even more than I already was. Where he said to his son to help him with how to tweet, or he’d cut him out of the will made me laugh. As a parent I’ve never said it out loud to my kids but I sure have thought it now and then. This is a remarkable interview and I thank the Judge for his openness to “tell all.” The world needs to hear these back stories to understand the agony conscientious people in govt. of various levels were going through trying to save our democracy. Thank God they prevailed. Now we have to strive to keep it.

I have listened to many people talk about the threat to American Democracy and there is none like this.This honorable judge is thoughtful , insightful, measured and intuitive. This is absolutely the best telling of the January 6 story. He appears to be that, but he is still a Republican who thought that the Impeachment process functioned as it should. This is a highly questionable assertion considering US Attorney General Bill Barr's machinations of the supposed independent investigation into Trump and the blocked reports, plus the US Senate's refusal to even convene into deliberating the articles of impeachment of Trump. I do applaud the fact that he appreciates the danger posed by Trump in his lust for power and the destruction of our government and our country. I also applaud that he recognizes the lack of courage and morality of the Republican leadership in their enabling of Trump just to maintain their own power.

This former Judge has been the perfect Judge who never interfere with politics and this is the closest he has come, he had to come to the hardest decision of his career and choose his country over his normal decision making democracy was at stake and when good men do nothing then evil men can do harm. As a judge, people will weigh his words with careful consideration. He prevented the insurrection from having lawful justification despite another law scholar Mr Eastman offering the former president incorrect advice on electoral election interference. Now he is at another inflexion point and here he is again doing his civic duty for this democracy and I hope enough USA citizens listen to PBS interview. I appreciate MAGA colt followers will not change their thought but he may be able to get through to the educated Repubicans who are still to decided what action to take to save this precious democracy. Many very brave people have died over the century to give this democracy to the USA and they would be all in now to fight for this democracy. Now it is time for those people who have sworn an oath to the country to be prepared to defend the country again against foreign and domestic actors who would seek to take it away from their families. Not sure if he did during the Trump nightmare but he would be a hero if he would have spoken up - over and over and loudly - to anyone who would listen about the the danger to the conspiracy of which he speaks. It’s a bit too late now. It’s done. This interview is interesting and educational but is just that. So. No medal for him.

He did! (?) Not sure if you mean on the Capital steps (?) but, he did! Once it hit tweeter it's all over the world. Newspapers grabbed it. I still receive notifications and references of and to it. And I'm not a tweeter freak.
