It never will, it’s essentially a remix in a way...it’s just him rapping over a 10yr old instrumental. He’d need to get permission and/or pay to have used said instrumental as a sample. Also patterns in songs are quite common and this pattern and the "a real diamond in the rough" intro are different enough in structure that it could be perceived the artist is a fan of their music and created a song without realizing the similarity... Similar doesn't always denote copyright infringement. Again, this is purely speculation and therefore best to leave it to copyright lawyers, which I am not.
