Just seeing this now. From a hospitalist point of view. You can make people stay - BA 52. Also inability to make own decisions -lack of capacity therefore unable to leave AMA - against medical advice Unfortunately the man in question had a stroke, but these may be permanent deficits Would never discharge a patient who is unstable. Absolutely would not happen. Patient with a CVA with a recovering or permanent mild deficit would be released to rehab if needed. There are criterion to be met. Now, depending on funding, this individual may not have the ability to go to rehab or home with home health with physical therapy. Be assured, if you are stable for discharge and you refuse to leave outside of Medicare appeal, you will be trespassed. That is to say if you are discharged and you are disruptive and/or threatening one will be trespassed.

Dan is quite correct of course in that even a first- degree relative actually does not have the right to receive answers to their questions pertaining to the patient’s health. Need POA/surrogate or permission from the patient
