अगर आप LL.B के फील्ड से प्रत्यक्ष - अप्रत्यक्ष जुड़े है तो आपको उस कानून की जानकारी होनी चाहिए जो इस नोबल प्रोफेशन को क़ानूनी मर्यादा में बनाये रखता है , मै बात कर रहा हु अधिवक्ता अधिनियम 1961 की जिसमे वो सभी प्रावधान है जो इस प्रोफेशन को नोबेल बनाये रखते है ! चाहे बात LL.B के बाद वकालत के लिए enroll करने की हो या वकालत के फील्ड में अपनी डिग्निटी को बनाये रखने की हो , यह अधिनियम अपने प्रावधानों में हर चीज़ का उल्लेख करता है ! साथ ही मेरी कोशिश आज के लाइव सेशन में यह भी रहेगी की Advocate (Amendment) Act 2023 जो की 30th September 2024 को प्रभावी होना संभावित है , उसकी जानकारी भी आपको दे सकू ! ऐसे कही सामान्य सवाल होते है जो वकालत के पेशे से जुड़े होते है जैसे : 1. क्या बार एसोसिएशन का कही भी अधिवक्ता कानून में जिक्र है ? 2. अधिवक्ता की दो केटेगरी (सेनियर अधिवक्ता व् अन्य अधिवक्ता ) लीगल है , ये कहा लिखा हुआ ? 3.अगर Seniority को लेकर कोई विवाद हो तो कैसे सॉर्ट आउट करे ? 4. एक अधिवक्ता एक से ज्यादा बार कौंसिल के सदस्य हो सकता है ? 5. अगर दुसरे राज्य में शादी हो गयी तो क्या दुसरे राज्य में वकालत कर सकते है ? 6. Certificate of Enrolment और Certificate of Practice में क्या अंतर है ? 7.whether Sr. Adv shall be heard first in court , then other Advocate ? (क्लाइंट , सीनियर अधिवक्ता को प्राथमिकता क्यों देते है ? ) 8. क्या एक स्टेट में enrolled Advocate , दुसरे स्टेट में प्रैक्टिस कर सकता है ? 9. क्या जब किसी और वकील के क्लाइंट को दूसरा वकील हैंडल करने लग जाये तो NOC लेना जरुरी है , अगर है तो ऐसा कहा लिखा है ? 10. क्या वकील जज के चैम्बर में जाकर मुलाकात (meeting) कर सकता है ? अगर आपके मन में भी Advocacy से Linked कोई सवाल हो तो , यहाँ कमेंट में जरुर लिखे !! Still main revision missing in Indian Constitution to protect innocent MEN 1. Why not mentioning He / She in beneficiary side instead of only She......for all act belongs to Rape / Sexual assault / Home Violence etc......right & protection shall be equal, not one side 2. Why no strong rule for punishment of fraud petisioner in case of fraud allegiance of Sexual assault / Rape / Home Violence. 10 yrs jail + 1 crore fine for fraud case filling shall mandatory. Because this fraud case breaking IPC basic principle of " Innocent never get punished even thousands guilty escaped". 3. Why Male shall Pay family maintenance after divorce, if this is the case why not no rule for Female shall pay maintenance to man if she demanded divorce or found as guilty. 4. IAS / Attorney General shall think about both gender....not only one side rule....be respect & protect Tax payer community also while drafts rules. No innocent shall get punished even 1000 criminals escaped.....Basics of our constitution, unfortunately no rule in India to protect innocent MEN.....shame for all taxpayer Men.
