@xoxsilentrealmxox Absolutely yes. Kohbeeger's attorneys are so bad that part of me wonders if they're setting up for an appeal based on ineffective assistance of counsel. The judge sounded like a law professor more so than a judge, "Isn't that probable cause every day and twice on Sunday." Seriously, they're that inept
@Seashellsbytheseashore217 күн бұрын
@@hpytwobme ashley jennings imho was terrible. too much "at the end of the day" and "i just cant wrap my head around" and "even if the state did" and so on. she literally said "uhhh yeah!" she just doesn't seem like she's really all there.
@Romina1907.3 күн бұрын
Too bad the prosecution asked the magistrate not to consider the DNA when determining probable cause because they knew it wasn’t holding up. That means Hippler can’t magically revive it now, no matter how hard they try. He has to work with exactly what the magistrate had in front of her when she signed the arrest warrant. He can’t retroactively shove the DNA back into the probable cause equation just because the case is falling apart. The state made their choice, they knew the DNA was too weak to rely on, and they didn’t want it scrutinized at that stage. Now, they’re stuck with that decision, and no amount of legal gymnastics is going to change it. And as for the “inept” defense? They just presented a proffer strong enough to put the PCA under serious scrutiny, to the point where a Franks hearing is now highly likely. That doesn’t happen unless there is actual evidence that law enforcement misled the magistrate. If that’s “inept,” the prosecution should really start panicking. Because no amount of courtroom posturing is going to save them from the facts.

His car caught on CCTV driving around the neighborhood at the time of the murder, his cellphone pinging off towers around the location of the murder, his cellphone conveniently being turned off at the time of the murder, and a knife sheath found under the body of a murder victim with his DNA on it that just happens to match the same Ka-bar knife he bought of Amazon is a crap load more that "teeny tiny DNA" now, isn't it, you disingenuous, NPC? I’m not from the US, and I’m so glad I’ll never have to be in a situation where people like this decide my fate. I’ve watched countless trials and know there can be differing opinions, even in the most straightforward cases, but what’s happening here is just a disgrace to everyone involved. The victims and their families deserve to see the actual perpetrator(s) convicted. The defendant deserves a fair trial, and that means being able to face his accusers and the evidence against him. This whole circus undermines the justice system entirely. To everyone cheering this on, maybe it’s time to return to school or start using the internet productively to learn about your justice system. Even the basics would suffice.
