LIVE: Supreme Court rules in favor of Jan. 6 defendant in dispute over obstruction charge

The Supreme Court has ruled in favor of a former Pennsylvania police officer charged for his alleged participation in the U.S. Capitol attack, throwing out an obstruction charge against the alleged Jan. 6 rioter.
The 6-3 opinion came from Chief Justice John Roberts.

This is why time and care is important when bringing high profile cases like this. The prosecutor cast too wide a net with the charges, therefore making this an inevitably. Many visitors to the Capitol on Jan. 6 were charged with interfering with an official proceeding although they were walking in the hallways and other common areas. Official proceedings take place in hearing rooms and not in a common area. For that reason, if a visitor is in a common area then they cannot be disrupting an official proceeding. Remember, an official hearing takes place in a hearing room and a gavel begins the proceeding and a gavel ends the proceeding. It has nothing to do with what goes on in common areas. If someone is acting out in a common area then they could be cited with minor infractions like disturbing the peace, littering or that type of minor infraction which does happen.

They did dismiss the charges because the “Law” you were citing wasn’t meant to be used in such a broad manner. It was made for “Financial Crimes”. The supreme court’s ruling is correct in their decision. The prosecutors were stretched to try to make the law all encompassing. It’s not the law that should have been made.

These judges were placed on the bench to serve the people. We pay their salaries full benefits, and expenses. If they don't want to honor the contract, they need to resign or be impeached.

When these people were charged under a law that was created to address events in business, I wondered how they were charged with a law that has nothing to do with Government or Government proceedings. Businesses and the Federal Government are very different and are governed by different laws. For example, an employee who steals a company's proprietary technology is charged with theft. A Government worker who steals National Defense secrets is charged with espionage.
