Great speech and analysis.Deep respect to him. I think if Mr. Nariman would have been in the bench of Babri Mosque case, the verdict would be a different one. As a result, India would be freed from nowadays problems of excavation beneath mosques one after another. After Ayodhya, cases of Kashi Mathura, GyanbapVaranasi, Sambhal, Ajmer, Tajmahal and the list appears endless. The lower courts have been giving verdicts for excavation by ASI etc. The Places of Worship Act,1991 is of no use. Mr. D Y Chandrachud , the CJI at that time did not acted to restrain lower courts to move further.

He had the opportunity to decisively influence the verdict as a member of the bench, but he chose to recuse himself from the hearing. Had Nariman participated in the bench, he could have prevented, called out, or dissented against what he now calls a “travesty”. he chose to recuse himself then and is now speaking against the judgment five years later. The question is-why did he recuse himself? It is a convenient ruse. Recuse yourself from hearing and criticizing the judgment delivered! Unfortunately, we had such judges in our supreme court! Postretirement some judges become wise, now it is the turn of this so-called wise man.

It is a known fact that this judge is biased against Hindus, in each 1 of his judgement by selectively quoting what left/commis were saying. When he talks about secularism, is he trying to say criminals/law breakers and normal citizens are same, it seems only Hindus must be secular and should allow the illegals to continue occupy any place in Bharath. Worst is that his western obsession can be seen in each of his quoted judgements and the way he tries to talk about other religion in high but by skipping the believes of Hindus is not surprising. For ppl like him Yogi should not be a CM, but he can be a judge of SC, even when his own father was admitting that this man was similarly placed. Irony, Bharath n Hindus have to face not only litigants but even judges with apparent bias.

54:57 on wards: Not only reasonable doubts but with malafied criminal intentions, the Babri Masjid verdict was decided and given in favor of ramlalla, who wasn't even an original claiment on the plea. Travesty of justice in its clear form; criminals got free, a historical monument and a articulate piece of super architectural mosque destroyed, a disputed land of 5 acres given to the mosque trust never to be realized in getting it. Babri case is for the law history, a permanent black mark on the SCI for ever.

Well the bro might join congress. Off course the name of nariman sir elicilts respect for the level of knowledge possessed by him. But his questioning a judgement delivered by mejority of SC banch now is suspecious. As i recall , those historians (mainly leftists) or others who talked otherwise to the existence of the temple ,failed to prove or even submit a strong case in the hearing before SC. In such a scenario their utterances r just personal opinions and not tenable in the eyes of law. I am not a law professional but have been reading/discussing HC/SC case laws on taxation/financial matters while studying for CA. With due respect to SC's stand on this ,I think the places of worship act negates the right of a common man to go to HC/SC and seek justice based on maintenanable evidence on such issues. U can't deny a person his right to file suit/petition on any issue in HC/SC JUST because there might be communal disharmony. Off course the courts can deny and not entertain such petitions if they think it will be right in the delivery of justice. The law must stand on the right side without any fear whatsoever. The past mistakes must be corrected if there is maintainable evidence. Further even if his personal opinion is taken into account than shaivite/jainist/buddhist iteams were found underneath..this means that the mosque was not there originally. As per him the site can belong to either of jains/Buddhists/shaivaites but rules out it belonging to islam. The justice must be done ,even if it is delayed , wiithout making the judiciary a prisoner of any fear whatsoever.

Very good lecture on Secularism. But misses one crucial point. He should acknowledge that the dispute of Ram Mandir in India was approached through the formal justice system.
