Asalam o alikum. As per my knowledge, LLP is the body corporate as per LLP act and in sec 80. of ITO 2001 body corporate falls under the definition of the Company therefore, LLP taxation is similar to company taxation, not AOP taxation. what's your take on this

Yes, this is confusing , but FBR has internally decided to treat LLP as AOP, and we are registering LLPs as AOPs with FBR.

Yes, there is no such restriction on it. It will be a decision of the partners.

So far as company's are concerned they are treated as withholding agent from the date of incorporation. However, based on my discussion wth FBR Officials LLPs are treated as AOP.
