I remember a case from about 10 or 15 years ago that was similar to this one. A man got over a million in his account by accident. He did nothing and it sat there for almost a week. Then the bank took the money back. The man filed suit and told the judge that they had a right to get their money back but he should be allowed to keep the interest; which was quite a bit of money. The judge ruled he had a right to the interest and he kept it.

If the bank felt that it was an error, she should have made them go through a series of hoops, speak with several of her representatives, placed on hold for an hour before being disconnected and require them to fill out whatever paperwork according to the guidelines she's set. After review, she should reject the claim and if the bank disagrees with her decision, they can send a written request to have the case reviewed by a supervisor. Just like they do.

Happened to me! Many years ago I was closing an account in a bank in California because "they just made too many mistakes." So the teller was counting the $ and she kept counting and counting...about $1,000 over my balance! I stood there in amazement a watching her and let the cash sit on the counter. Then I was asked why I was closing the account. I then asked to see the Manager...and reported..."this is why I am closing my account..too many mistakes...I then showed him the correct balance and asked him to count the money. You should have seen his face!!! Priceless. Honesty is the best policy. Always. God is watching!

Completely different circumstance. But if you hand them a hundred dollar bill for a 5 dollar purchase and they hand you 5 dollars change (mistaken change for a 10) you are going to want your correct change (your money not theirs) returned to you and the law plainly states you are rightfully due it. But better yet if you are a patron at a restaurant and you pay your bill but the waiter mistakenly brings your card and change to a table across the room do you think that your possessions are theirs now because it was mistakenly placed there? That money came to her in error a clerical banking error and she was and is in no way entitled to a cent of it. The law and her signed contractual agreement with the bank read quite plainly. She knew she was stealing when she appropriated the first penny of that (now stolen) money. The multiple offenses she committed are unlawful in every detail. She is a common worthless thief.

A gift defined in law is the offer and acceptance of items of property money or other valuables, that means it must be offered unconditionally and in definite terms and accepted likewise. That did not occur in that mis deposit to her account! That mistake of the clerical error mis deposit was in no way a gift, she knew it, you know it and so does everyone else. The law and her signed contractual agreement dictated what was required of her and which she not only failed to perform but actively thwarted. She is a common worthloewss thief, she was arrested, jailed on trial and assessed harsh fines, and punishments which she more than earned.

I had a refund given to me by my credit union for an overdraft fee, but they ended up giving me 2 refunds for the overdraft by mistake. I was in school at the time and extremely hard up for cash, but still made the call to tell them there was an error (I believe in karma). The customer service rep thanked me for being so honest and went back over the last 6 months and reversed 3 more overdraft fees and I ended up with 3x the amount I would have if I hadn't called. Still banking with them to this day.

I feel like it's one thing if you don't have a steady string of deposited weekly checks from your job and they charge that fee, but if you have a check deposited from your job every week for the last several years on the same day, I don't see the issue with going negative in your account. It's not like the bank really loses it anyways. And sometimes it's really not your fault because the info on your phone banking app can be wrong or different companies charge their business with you on different days. I usually just yell at them on the phone and they reverse the charge.

Ok the banker accidentally pressed a couple extra numbers, not a problem happens all the time in data entry! It was a mistake that would of been easily solved by just recalling the money back, after all, its supposed to be in the "lady's" account right?..... Ow what's that? the "lady" fully knowingly this wasn't her money, and an obvious mistake decided to transfer the money to another bank....... now something that could have easily been fixed, turned complicated because the lowlife "lady" try to be sleek... This is more like someone taking bills from their wallet and putting them in yours, or like bills put in an envelope and then mailed to you with your name as the recipient meant to receive the mail. Let's not ignore that the bank had her details because she had an account with them, they hired a fool who didn't double check. With the charges brought up against her, she should keep the money for them making their problem a her problem and causing her stress, not forgetting tarnishing her image calling her a thief because of their negligence

The defense attorney is off the mark.. As soon as she discovered the money, she moved it into another account so the bank couldn't recover it and started purchasing assets that would be hard to liquidate if and when the error was discovered. That is criminal intent.

It happened to my stepmom, she took out a loan for 10,00 and they gave her 100,000 and she gave it back because she was told she would get arrested. The bank didn’t even notice it until weeks later, only because my stepmom told them. She never went over budget so all the money was still there.

💯 Correct. But since they have all the money and power. Even if they make a mistake on their end, doesn't give you the right to steal it. There was a case here in Florida just like this womans but just under a million. Even though the bank made the error the judge sentenced him to 5 years in prison for it, because as the judge put it. You knew that money wasn't yours to take despite the error made by the bank. You stole that money, so he got 5 year in prison.

@@ITIsFunnyDamnIT I totally agree it's theft, I am just saying when the boot is on the other foot the banks are VERY slack in getting your issues sorted out. We get letters in the back of the financial section of the weekly paper where people are at their wits end trying to retrieve funds the bank has misplaced, sometimes people have been fighting for years to get the money located. Some years back one chap paid his quarterly VAT dues via bank transfer and the bank paid the money to the wrong Gov't bank account. it ended up lost in the system and the VAT people chased the chap like hyenas and in the end they BANKRUPTED his company because he didn't have the funds to pay the VAT a second time. He actually sued the bank in the end, not sure how that turned out.

I went to an auto salvage yard about 15 years ago and purchased an alternator and some door trim for my van. I stood in line outdoors with strangers all around me and when it was my turn to pay I pulled my wallet out and laid it on the outdoor countertop as I received my receipt and parts, then walked away. I had just gotten outside of the salvage yard gate, heading into the huge parking lot, when someone was shouting to me in Spanish, "senior..." I stopped looked back and an older gentleman along with 2 employees flagged me down. To my shock and surprise, I had left my wallet sitting on the outdoor counter with $4000.00 cash in it. This Hispanic man could have easily stolen my wallet. But with a big smile he handed it to me, "thank you" I said! He said, "de nada" and just walked away... I stood there dumbfounded he restored my faith in people, a complete stranger had more character and honesty, and class than the current president of the US, Joe Biden has ever had. I was one lucky SOB that day. OK, I need to add to the story. I am getting a lot of rude comments assuming I am a cheap bastard... Fair enough... But I would like to preface, there are some people who don't want rewards. The act of returning my wallet was his reward. He didn't want anything I offered.

The bank made a clerical error mis deposit, which as everyone (especially her) knew and knows is no gift to her and conveys no right of possession. That money is and was the lawful property of other people, when she attempted to move the first cent of it she commited multiple felonies, among them THEFT, she is a common worthless thief.

I can remember when I was a teenager and came home to tell my father they had giving me more money back then was owed. It wasn't alot of money even back then in the beginning of the 80s but he lectured me about how it was wrong that I had kept it. I felt so guilty I drove back to the fast food restaurant to return the extra money. The cashier was so grateful and manager was too and had given me my next meal free. The feeling of doing the right thing was way better then the feeling of disappointment of my father. That stuck with me till this day!

This happened several times to us growing up. In those days there were a lot of walk up windows rather than drive throughs and most of the time us kids would go up and pay and get the food. I remember one time in particular they gave us back 20 dollars over the amount we should have received. Being kids, we were excited. And it was the 70’s so while not a lot of money, it was much more than 20 would be today. Mom scolded us and told us to take it back.’That money may have to come out of her paycheck’...mom said. All these many years later, we have a cafeteria in the building where I work. Just a few weeks ago one of their employees was fired over his cash drawer coming up 20 short. I strongly believe that employee should not have been fired and that it was an honest mistake...but I wasn’t the decision maker. It amazes me how many times moms little lessons seem so relevant even this many years later.
