There are few marriage acts in india, one Islamic only for Muslims and another Hindu act( include Buddhist, Sikhs, Hindus etc.) And more.. Non Muslim cannot marry more than once, while Muslims men can marry upto 4 wives, and could divorce any of em without legality. Others can only remarry after a legal divorce by the court

Yea, just say you can't comprehend English bruh. It'd make more sense. OP literally said "There are a *few* marriage acts in India" Ie. In English, a few means roughly three or more. Then goes on to elaborate about the Islamic and Hindu marriage acts and then literally says "*and more....* Ie. There are more than the two they elaborated on. Your comment is ironic because you clearly didn't read. @@yashaswinikrishnan1878

Those clamoring for a Uniform Civil Code and taking up issues with polygamy in the comments will clam up like oysters if the other storyline from this episode is addressed under a new UCC. All fine and okay to call out polygamy under Muslim Personal Laws but heaven forbid if the rights of other citizens to marry a partner they love gets covered under the UCC. Same sex marriage is still not legal in India. In fact the Supreme Court of India just a couple of months ago passed the buck to avoid any backlash on them from the government by lobbing it right back at the Parliament. Essentially, the same situation as Thailand where too the Supreme Court recently passed a similar judgement last year. Also, Mona Singh as Bulbul was fantastic in this episode. And Tara knows what she wants and goes after it. Her personality type is a portrayal of a character. She isn't a perfect heroine. She is a complex individual. I love her arc through the entire season and especially at the end of episode 7.

UCC rights is for a act that equals "religion". LGBTQ is something that has nothing to do with religion. I mean they can follow certain religions for sure, but the main issue is with gender. That comes with more valid questions as who will be the wife and who will be the husband because each gender has different laws attached to them and provided to them after years of societal pressure as well as the evolution of laws. India still follows British laws to a larger extent, which has had no regard for this community. In short you are comparing 2 different spectrums. I support LGBT , but we do have to agree that our laws are not something that cant just be passed without following and prior laws , its just not 1 sentence that forms the act.
@saurabhvashist4051 Жыл бұрын
@@swatisikhadas6651 UCC is not meant to be religion specific (unless the current government in power thinks it to be) Special Marriage Act is an act that is part of the existing Constitution that covers individuals who do not follow personal laws of other religions - for example atheists or agnostics. Marriage laws in India also exist outside the purview of religion. And the concept of husband and wife to define a marriage has even changed in Britain (since you mentioned India still following British Era laws) as in the UK marriage is now defined as the union of two individuals or citizens so not gender specific. Please gather correct information and knowledge before writing uninformed diatribes.

@geisha-12 Жыл бұрын
Both are completely different abd cannot be compared. However I agree that both UCC and LGBTQ+ marriage law should be brought in. The problem is India is a conservative country as a whole. Therefore the preferances given to women and various law surrounding it cannot be used for LGBTQ marriages. Like in case of dowry or even children's custody, a mother is always the preferred party. They should add a special marriage act for gay and lesbian marriage and give equal rights and status. Gender law in India are kinda screwed, like rape case of a men against a women. I don't think sexual assault against an adult men is even addressed. So yeah, I am someone who wants UCC and also legal marriage status to LGBTQ community, especially for adoption. It is really sad that both cannot adopt legally as a couple.

Achara, while it might help some people to think what if that was my sister/mother, that still only drives the narrative that a woman is valuable if she is related to you or is a mother/sister of a man. They should be valued and respected because they’re a human. Period. If someone doesn’t have a mother/sister, the lesson should still be the same, so lets get rid of this saying because the broader one still applies exactly the same

I like how Zoya Akhtar's version of India is not lawless. I mean, often male filmmakers are tempted to show only the currupt police officers handling such cases in order to highlight the messiness of the situation as if the case, itself, is not enough.

India decriminalised homosexuality in 2018. This year we had a 4 month long supreme court hearing on same sex marriage but it was rejected by saying the parliament should make the final decision. A review petition has been filed but i don't think it's gonna make any difference. Transgender and intersex people can marry if they are in a heterosexual relationship. By that logic bi or pan people can marry too if they are in a "straight seeming" relationship. Adoption rights are denied for all queer people.

The crazy thing about this episode is when you realize that it’s normal and acceptable for a man to marry two women but not for two women to get married. 🤯 Btw that was a Muslim family, which is why he was able to get married again. The first wife says “I am a citizen of this country and I will fight for my rights” because in India marriage laws are based on religion, and it’s being exploited. There are men changing their religion solely to be able to marry more than once.

I think as the maker is herself from a Muslim family she would know. And it is rare but legal, that is the issue. And it is nothing special, even among other religion polygamy was pretty common among the royal and rich - eg Maharani Gayatri Devi. But it isn't legal anymore, giving the women atleast legal power. Same is the case for marital rape, it should be illegal but is not yet.

Seriously, once they revealed she specifically had sex with him so it would be on security cameras and leaked it herself to torpedo his engagement and entrap him, she became irredeemable as a “good” character. They are all jerks - Tara, Adil, Faiza - and that’s what makes it interesting.

This episode didn’t fully make sense except as a description of reality. If polygamy wasn’t allowed then the husband would just divorce the first wife and marry again - what exactly would be the difference? Dia Mirza’s character would still be stuck fighting for custody
@geisha-12 Жыл бұрын
I think she could file for divorce on basis of an extra marital affair. Which could give her more leverage in divorce (like Tara has). But because it is legal it wouldn't even be in the consideration maybe? I didn't really enjoy this episode anyway. It felt like a commentary on both social issues rather than an actual progressive storyline for me.

@vidushichaturvedi6248 Жыл бұрын
This video is plain ignorant. Achara is usually quite aware of these things and it's okay if she in the begining thought that this was a Hindu family, but at the hospital scene the actress explicitely says that she is not just a Muslim but a citizen of this country (but the first half of that sentence was just cut here). You should have clarified it later on instead of letting people just believe that polygamy is legal for Hindus in India, because it's not.
@sunshine921992 Жыл бұрын
Polygamy amongst Indian Muslims is extremely rare. It's more common in the Arab states. The only episode in which they show a Muslim family and they chose to show the most contrived storyline that doesn't even connect with its audience. They could have told so many other stories, an inter religious marriage for instance.
