that version of scarlet spider is ben reilly not kane. during the clone conspiracy story arc a few years back he was brought back to life by the jackal which he then, killed him and took over his operations bringing back everyone anyone ever lost including spider-man's losses as well. it's how doc ock got his mind back in his own body. ben reilly survived and started in his own series for a while called ben reilly the scarlet spider in that series he did die again. but, came back fully restored. his girlfriend is hallow's eve and reilly is now chasm.

wow thank you! obviously i know of the characters but just didnt read all the stories. hehe it was during my many year comic hiatus LOL i did know ben is now chasm.
