My wife was in adultery relationship with an another person, hence she has gone to her parents home and put 498a and 125 case against me.She is a graduate in commerce and has done a beatycian course and is doing a job in a parlor and earning.But husband is 10th, +2 and diploma studied and doing a govt job.But both the petition stories are different for a single event.Hence how I will fight this cases.

Very complicated case.. 1. Maintenance not applicable in this case because she is a earning woman. 2. Adultery is not criminal offense. 3. 498A Cruelty... Evidence will provide it. If you are not torture her mentality & also physically then you will be not punishable. 😎

yes why not if she has got the decree of section 125 Cr.P.C in her favour she can file execution petition otherwise she has to file maintenance petition to get maintenance

She has got decree of sec 125 cr. pc in her favour. It is now known that she is employed for last 12 yrs, and has not disclosed that information to court. That is why she did not approach the court so far. Now how to proceed?

@@LawGuruOfficial Thank you very much for reply. Ours is very peculiar case. It is true that even earning wife is given maintenance from husband. The husband has 4 other dependents. She got order claiming to be not earning at all. She did not disclose about her employment for long 12 years. Can she approach court after 4/5/6 years? In view of Supreme Court's guidelines, will it be in order not to disclose her employment? It appears she has been suppressing and wants to suppress information about her earnings in order to misguide court.
