I don't know where you people are getting your information from, I don't even live in California but I took the time out of my day to research your laws and definitions used by the California Penal Code, and this does fit the description given under CALIFORNIA PENAL CODE § [SECTION] 187 + 189 - that's why they have different degrees for murder, what you people in the comments are referring to is first degree murder but are for some reason ignoring all of the other degrees. And... in California, you can be charged with first-degree murder that was not premeditated if you were doing something illegal at the time that led to those deaths. This is called the felony-murder rule.

@@JenelleD12 Well, you took that response better than I expected. I was expecting a really mean response given the harshness of "you people" but I'm glad to have assisted in some way. The felony-murder rule can be applied to almost anything, and this rule is in almost every state. Like if they were driving recklessly, if they have some kind of evidence to that, they can turn that reckless driving into a felony and apply it to the felony-murder rule. To be fair and honest, I did not know this information either before I clicked on this video. I learned a little bit more about the legal system.

That's not true: the DA doesn't up charges strictly due to pressure from victims' families. Additional evidence figured into the reassessment of the original filing. A plea deal closer to trial is always a possibility, though - and that may or may not occur based on several factors, including the viability of evidence. They will probably present their most powerful findings later today in court, but that 8 million dollar bond is quite telling.

Going to respond to myself and put this information here for those who want to learn more about the felony-murder rule which MAY be applied to this case. From Justia- "The felony murder rule is a rule that allows a defendant to be charged with first-degree murder for a killing that occurs during a dangerous felony, even if the defendant is not the killer. The felony murder rule applies only to those crimes that are considered “inherently dangerous,” as the rationale underlying the felony murder rule is that certain crimes are so dangerous that society wants to deter individuals from engaging in them altogether. Thus, when a person participates in an inherently dangerous crime, he or she may be held responsible for the fatal consequences of that crime, even if someone else caused the actual death. The felony murder rule is an exception to the normal rules of homicide. Normally, a defendant can be convicted of murder only if a prosecutor shows that the defendant acted with the intent to kill or with a reckless indifference to human life. Under the felony murder rule, however, a defendant can be convicted of murder even if the defendant did not act with intent or a reckless indifference; the prosecution must show only that the defendant participated in a felony where fatalities occurred." - Justia

Another idiot behind the wheel drunk or 420'd. $800,000 to get get their darling son out of county before waiving time as long as possible & high profile lawyering those charges down to a suspended sentence & community hours...?! May those grieving families exact their wrath upon him with a long, long sentence in prison Being compensated in a civil case that will leave his family struggling with only a 7 figure lifestyle - well below the Malibu poverty line.

As many others said - it's NOT murderer if he didn't voluntarily or knowingly do it. More than likely involuntary manslaughter. Whether it was planned to charge him to be let off who knows. Either way needs to be punished. Sorry for the families.

@victormihai3929 - he can be charged with murder despite not having the intent to kill if there are exigent circumstances, i.e., drugs, alcohol, a history of similar behavior, etc. He was initially charged with gross vehicular manslaughter, then the cops upped the charges to 2nd degree murder, so I'm guess there _were_ exigent circumstances that haven't been made public yet.

The DA is doing this guy a huge favor by charging him with murder instead of reckless homicide or vehicular manslaughter. A murder charge requires a specific set of circumstances which this will most likely not meet. The same as when they charge a cop with murder instead of negligent homicide and its a not guilty because of the specific requirements to prove a murder charge.

Murder is such a specific charge. In all likelihood this kid is guilty of some major things, but murder is not one of them. I don't care how the legal system modifies well-understood terms; you simply cannot accidentally intentionally kill somebody. Rather than modifying the concept of murder, the legal system should seek to add qualifiers and additional sentencing to appropriate charges: "hyper-negligent manslaughter", or something like that.

If this kid had a history of drugs and/or drinking and driving, then I can see why the charges were upped. The other thing I want to know is what was the speed he was going. 100mph+ could be the "intent" they needed to charge him with murder.
