Handing a jet ski to a teenager is like handing a knife to Jack the Ripper. You can tell yourself that he is only going to use it to eat his steak dinner, but with Jack's record, it is always risky, and as JJ points out, if Jack uses it to kill another woman, the law comes down on you for handing over the knife.

@@Dayserking Your reading comprehension needs work. I was comparing being an enabler of things, not the actual incidents. It is exactly the same with bank robbery. The getaway driver thinks they are not culpable for the robbery itself, because he/she never entered the bank and carried out the crime. Incorrect. The law holds the getaway driver equally culpable for whatever happened in the bank because the getaway car enables the crime to take place. In this case it is just a less serious version of the same doctrine. The woman is legally deemed at least equally responsible for the irresponsible actions of the teens because she allows them to use the jet ski's without supervision. She enabled the accident by her actions. While much smaller scale, the law applies the exact same sharing culpability doctrine whether to a foolish accident, a bank robbery getaway driver, or someone who might have handed Jack the Ripper the knife to kill someone. So yes, in order to illustrate the general legal doctrine, it is possible to use a more extreme version of the doctrine, because it is easier to understand why JJ ruled as she did. At no point did I make any claim of equivalence between a silly accident and a hideous crime. However it is interesting to note that the underlying legal doctrine when apportioning fault is the same. This is why we have laws in which someone can be charged as an accessory to a crime. There was no crime in this case, but JJ was apportioning a significant part of the fault to the plaintiff. Had the teen been injured, the parents could sue the granny and win because of the exact same legal doctrine.

I sort of agree with you because the defendant strikes me as an entitled brat. The grandson is no prize either. I do however have to agree with J.J.'s rationale. "Quit while you're ahead". Granny's lucky she wasn't sued.

I always wonder what happens after the accident but before the lawsuit. Did grandma try to get them to take some responsibility and they refused ? Did they agree to reimburse her for the $500 deductible and then reneg? Were harsh words exchanged during the process of negotiating a settlement ? I mean really, it’s pretty hard to believe that filing the lawsuit is your very first move.

This case is an excellent example of why I'm unwilling to transport individuals I'm not the primary care giver for not even a quarter of a block anywhere. You can become liable for simply doing a favor.

The law in this country says you are held to adult laws and punishments once you hit 18. Americans are very well known for wanting to keep their children as children as long as possible. Other cultures encourage growing up like Jews with bar mitzvahs or spanish culture with the daughter getting her high heels, but not Americans.

I used to play paintball. My friends father owned the land we played on. If any of us got injured we could have sued while playing on his land. My friends father met each one of us and lectured us on the rules. I don't know this grandma doesn't know she's at fault when my friends father was well aware of the risk.

I completely disagree that the plaintiff would be responsible if the defendant was badly injured. The defendant is a 20yo adult man, and he was using the jet ski incorrectly. It's his fault.

it's not about his age, it's the law. If you allow people on your property or to use machinery that you own, you are responsible if anything bad happens to them.

And I am saying that law is stupid. Laws often change over time as people decide they are stupid. What if you permit someone to drive your tractor, and they intentionally decide to run over people and kill them fun. Is the farmer at fault? That is basically what happened here. She said you can use the jet skis, and then he drove it from the passenger seat and intentionally rammed into another ski. It is ludicrous.@@citytrees1752

JJ is right but this should never have gone to court. You don't sue friends and family, you work it out. That said, long before I was that kid's age my mother had taught me not to borrow or use other people's things unless I was prepared to repair or replace them in case of damage. I can't imagine just saying I'm not paying, thanks for the free recreation. Youth is no excuse. It's a matter of training and character.

My mother also taught me to not use others people's things but more because she knew how people could flip from kind to mean in a heart beat. I also cant imagine breaking something and not paying for it, however we dont know what the plaintiff said to the defendent after the incident. Maybe she felt responsible and told him to not worry about it but then figured she could use the extra and another extra money? In this case, character also includes fighting against people who are trying to take advantage of a situation on your back.

Feel bad but the kids parents should at least pay half of the expenses if they want the family to stay close because at the end of day it’s not worth it missing holidays or everyone looking side eye hope they get it together

You can't trust teenagers to be responsible. That's like parents going away for the weekend, while their teenage kids stay home. Do you honestly think that they WON'T get into mischief? My little brother was living proof of that. He and his friends threw the monster of all parties, and by the time it was all over, the house was completely annihilated with the mess that his friends and guests left. Fortunately, no one got seriously injured or worse.

@@citytrees1752 My folks grounded him for a month, and they never let him stay home alone again whenever they went on vacation. Once he was in college, he was on his own.
