Everyone nowadays knows what DNR means, but this guy could have got a medical bracelet that has dnr on it, but he is owed something because this emt disregard the dnr I have one on me but here in America they don't check for it so I got a medical neckles and bracelet that says dnr and the bracelet has a dnr paper inside it when opened up

@Overitlogically Incorrect. A DNR is *NOT* a court order. It is an advance notice by the patient that is placed in the patient's medical records notifying providers of their wishes and desires in the event it becomes necessary. The court is *NOT* involved in issuing it in ANY way, unless the patient lacks capacity to execute the order. There are NO end-of-life planning decisions that involve the courts BEFORE death. And, overall, the only time the court ever gets involved in end-of-life matters is with a will ("Last Will and Testament") involving real property (land and/or buildings). This “judge” is a (pretty low-rate) actor, and has NO legal background.

Not if he had a DNR filed and a tattoo stating the same. The attending personnel could say they don't see the DNR but this guy had it tattooed. I've seen doctors ask the patient if they still wanted their DNR to be in effect and if no response was heard, they went to work on that person anyway. I know, some people view death as the enemy but others do not. Like this plaintiff, like me and hundreds of thousands of other people. Respect our wishes. The family's suit would likely have been thrown out.

@pamt3915 actually spelling it out is legal in some areas specially if the patient at that time is unconscious and can't rescind the "do not resucitate" order. and Also the judge is actually wrong in this you don't need a court order for a DNR however it is specific that an order verbal or written or even in video is given prior to any incident needing the dnr and the patient has to say or put into writing "do not resuscitate me" it has to be this exact or similar words to be legal not just a 3 letter acronym DNR.

Specifically what situations/states/areas would it be acceptable? As a former hospital RN I’m not aware of any in which a ratio is a legal medical request. I don’t know of any state where a tattoo is legal or recognized by EMS. Advance Directives or in some states a home DNR is recognized if a patient is unconscious. EMS will resuscitate & doesn’t follow a verbal refusal by a family member. A patient has the right to rescind &/or amend their Living Will at any time, same for a Physician’s order. You don’t need a court order regarding resuscitation unless there’s an end of life lawsuit in progress.

D.N.R. on your body is NOT a legal way to tell medical personnel you do not want to be resuscitated. It has to be in your MEDICAL DOCUMENTS. You do NOT need a court order saying D.N.R. All you have to do is put it in your medical records

After Emergency personnel arrived after I found my husband unresponsive and not breathing they asked me if he had a DNR. I told them he did. they walked out of the room and then they made the necessary calls to get him transported to the funeral home.

However if they don’t notice it and I am resuscitated they won’t be hauled into court with a lawsuit hanging over them. I have taken responsibility to outline my care as discussed with drs, family and a social worker. My children know my wishes and will follow the legal document outlining my wishes.

Even with a DNR paperwork, how would it work in an accident? Paramedics and EMT’S are responding to an accident and have no time to search DNR paperwork or think about it, especially for a young person. That’s ridiculous of him to sue someone for doing the job right. Ungrateful.

I’m an EMT and there is a such thing as implied consent. What that means is, if we find someone laying on the side of the road, implied consent would say that this person would want to be saved. Even if they had a valid DNR we as medical providers would be protected by that law. DNRs are usually used for people who are in their death bed at the end of life. It’s unlikely a medical provider would get into legal trouble for resuscitating a wreck victim who is young and otherwise healthy, even if they have the DNR. This just happens to be a very rare and odd case. It’s actually displayed very well here because the motorcycle driver talked about how hard it is for him to get the DNR

@LilT2o00 I do understand what you are saying. You have a valid DNR, and it would be irresponsible for medical professionals to save your life. I understand people thinking. "Why do you want to die?" It is not necessarily that people want to die, but they may have a terminal illness, an extremely painful condition, or even a severe physical injury that makes them decide to get a DNR. There are definitely other reasons, such as yourself, and while people may not understand it, they should just accept it. My father, who was a very healthy and strong man, after a major stroke that left his limbs useless, bedbound, and using a diaper decided on a DNR. It was kind of hard to accept, but I respected his wishes.

That sentiment is more common than you might think. Life is harder than it has been for decades, and especially among the younger generations it’s easy to start wondering if life is worth it. Realistically in this case, I suspect it has less to do with not valuing his life and more to do with not wanting to participate in the ridiculous cost of healthcare in this country. But the solution to that isn’t DNRs for everyone, it’s fixing the broken system so that being the victim of a hit and run (or any other accident) doesn’t cost you $40K in medical bills. That nonsense happens nowhere else is the “developed” world.

Given it’s not a real court, I think it’s safe to say it’s not a waste of tax payer money or court time. A simple google search says “in court TV, like judge Judy, the parties have agreed to arbitration where a neutral 3rd party (like Judge Judy) will make a final legally binding decision. But here is the catch, both parties are paid to appear on the show and neither pay any restitution.” The show producers make money by having someone appear as a judge does (although they’re not an actual judge with a law degree like your local one is) and televising it. That being said, the tattoo and the injuries they showed in the video look fake [4:03], so I believe it’s likely that the whole thing is fake and just for entertainment. Just edited this comment because I looked this up further and this isn’t a TV show, this is a KZbin channel. It wouldn’t surprise me if the only and single thing that was real is the fact this is entertaining 😂. Either way, it isn’t a real court. If it were, the Plaintiff would have to pay court costs, and potentially legal costs for the Defendant, and the matter would likely quickly be thrown out.

There is no way of knowing what a tattoo DNR means anyway. Maybe it’s the initials of his wife or kid and you just let him die. I’m not going to jail for something like that.

@@damarismontalvo7281 granted that is true, we require documentation in this age of law and litigation. In EMT school I was told if you don't document it, it didn't happen. Even if me and my partner know it was done, documentation is the key to everything. Not to say that people can't falsify a patient report. Circumstances and other factors may be spun by good lawyers that we were negligent. It's a risk we take to do the best we can, but some people just see $$$ signs. Damned if we do and damed if we don't. It's the reason a lot of people are leaving the healthcare profession is due to people trying to find fault or negligence in any little thing out there.

I have seen DNR tattooed. But in full words. There was a case where the victim was not resuscitated, and the first responder was sued by the family. The first responder won the case. You have to have the full words tattooed. Do Not Resuscitate.

@Judge-Porter excellent ruling Judge Porter! This case was a simple open shut one be it at that. OMG so this case was brought to your court room by a low down "IRRESPONSIBLE & NEGLECTFUL" man child because he refused to deal with the responsibilities of moving on in life. He basically attempted to sue the defendant just for doing his job. He wanted to take the easy way out and refuses to accept the fact that it wasn't his time to pass in life yet!

@@dominicwithREALITYtse I don’t think that I have the patience of Judge Porter to even listen to the unreasonable complaints even if I am qualified to do it! The EMT personnel saved his life from an accidental death. Instead of being grateful and personally thanking him for his services he chooses to sue him. He still can avoid this bill by just choosing not to live anymore by doing it in a way that involves no medical attention if he really wants to seriously leave this earth and get rid of this beautiful gift of life that isn’t taken for granted. If he even wants to be remembered in a positive way he can choose to donate most of his organs to sick people that seriously want to live! I am confused!

My add on: The Mango Park Police Department was eventually able to find the person responsible for the “hit and run” that Alex was involved in, which resulted in the criminal paying a fine that was enough to reimburse Alex’s medical bill, and being sentenced to prison for 15 years. This helped Alex be more appreciative of life, and he reached out to Malcolm to thank him for saving his life, and to also apologize for suing him, Malcolm accepted both of them.

An EMT must know the meaning of DNR and honor it when presented. Hospice patients keep it on the fridge. It's a personal decision that doesn't require a court order.

This case was a waste of the courts time and an insult to the first responder that saved his life! As a health care provider, if I came across someone who was having a medical emergency and couldn’t communicate their wishes but had DNR tattooed on their body, I would still do everything in my power to save their life! Judge Porter is 1000% correct, unless the person has medical documentation whether it be issued by the court or they signed DNR papers that they had displayed, such as on a medical alert bracelet or tag, then the DNR tattoo is just that, a tattoo!!

Pretty much Mr Serrano assumed the person who caused his accident had gotten away with it, leaving him with all the bills to pay, which could still be the case if they can't get any evidence, but it's likely they'll catch the culprit eventually. Once they do and Mr Serrano gets his money back, he'll then realise he should have been more thankful to have been saved.

I feel sad that Mr Serrano values his life so little. DNR is normally applied to someone who is elderly and whose quality of life is already compromised, not someone who has every chance of recovering and going on to play a fulfilling role in society. I hope that one day soon, he will see that he was given a second chance. I also wish the Police dept well in their search for the driver who caused the accident and bring them to justice. To the EMT - thank you for doing your job in such difficult circumstances. You are my hero. xxx

Even the elderly deserve life! We elderly worked all our lives and we are valuable members of our families. CDA is actively killing people who cannot afford care in their old age and are nudged - pushed - by Social workers into agreeing to have themselves killed by the CDN Gov’ts M.A.I.D. Pgm which is the gov’ts way of getting rid of old people so it doesn’t have to fund Medical care - underfunding of Health Care & care in the Community is a huge issue in CDA. We worked like dogs when we could - I put my husband and myself through university, part-time for 7 years and never took one cent from the gov’t when I had our Daughter. I’ve been working since age 16. I worked as a computer operator, programmer, systems analyst tech spec & business spec writer. Now that we’re old are we to be discarded like garbage? I took care of my mother-in-law until she was 101 1/2 years old - for over 20 years - at the same time I took my own mother to all her DR and Hospital Appt’s and grocery & all other shopping. I served family selflessly for decades FOR FREE and now I am faced with this shite gov’t program that kills old people! Be careful what you do to today’s old people because you may face the same fate when you get old!

@@htmc2022 I fully agree with you. I was merely saying that, for some elderly, their choice is to have a DNR. My Dad placed one on himself - because his quality of life was diminishing as he had multiple disabilities and knew if he was revived, he would most likely be institutionalised. Thankfully he passed naturally, in his sleep. Mum had a DNR but passed within 5 days of a cancer diagnosis at the age of 91. If a DNR was forced on someone or they didn't understand what it meant, that's totally immoral and should be classed as a crime. You have my respect for the work you have done, with family and others. I am already classed as old - my husband is classed as geriatric (he's 84, I am 62). What I didn't agree with was the man who was suing the paramedic having a DNR when he had the potential to lead a meaningful life for a great many more years.

@@lizg5574 all understood but we have to be careful with DNR - I had to fight & could not get one removed from my mother’s medical files when she had a mild heart attack age 85, caused by her gall bladder pain & her consequently cutting out earth food item that she thought was causing her pain. A young ER Dr convinced her to sign the paper work before we, her children showed up - I was the one who stayed in the ER overnight at her bedside - no one told any of us that there was a DNR on her file (still a paper records hosp. then) - I read through the notes & found the DNR. It took hours to get the Dr who issued it to speak to me - he refused to remove the DNR - he said, flippantly, “She’s lived a long life”. I got him to stand by my mother’s bed to hear her answer when I asked, in as lain English as I could, because she is Dutch - English is not her first language - if she were to have another heart attack does she want to live? She said an emphatic and very loud, YES! He still would not remove the order. I explained that when he asked her earlier she couldn’t understand his medical terminology English enough to understand & answer properly. She reverts to Dutch when she is under stress and forgets I don’t speak it - I spoke it until age 5 but lost it - none of us speak it because my stepfather didn’t understand Dutch & forbade us speaking it. ER Dr had washed his hands of her & would provide no more care so I prayed she would get admitted soon - she spent a week having test after test (they found her heart was actually strong!) They finally found the gall bladder issue. Not eating enough food which provided the minerals Magnesium, Potassium, Calcium & Sodium, being the main ones which provide the electrolytes that keep a heart beating properly was her main health problem. She had restricted her diet so much that she caused her mild heart attack. I spoke to the Dr running the hospital floor - he said he couldn’t remove the DNR once she had signed it! So he agreed a compromise, to attempt resuscitation but not to the point of breaking ribs - apparently prolonged resuscitation efforts can batter a body. I just prayed she would get out of hospital - she did - she lived fairly independently 5 more years - died of a massive hemorrhagic stroke which I believe was a side effect of Plavix the anti-blood clot drug she was on because of that minor heart attack. Look it up on the FDA website. Years later My mother-in-law got similar treatment because she was 99 with pneumonia the Dr running that hospital floors didn’t even order a Cat scan to check how bad the pneumonia was. One day - trying to feed her breakfast I pulled a huge long greyish-white “rope” of phlegm out of her mouth - coming up from her throat - out of her bronchial tubes, I presume and up her esophagus - once that was gone she started to recover. She could speak again - I got her tests by loudly and angrily demanding them which made me persona non grata but got HER the help she needed - they wheeled a bedside CAT scan in - a dietitian visited her bedside to get appropriate sized food ordered which she could swallow - an occupational therapist spent time bedside, assessing her - that got her into rehab downstairs for the final 2 weeks where the DR in charge believed the elderly should get the treatment they deserve. Before we left that Dr upstairs had them move a Psych patient into bed 4 - the room had 3 women 90+ to 100. That woman was allowed to cough & breathe in that room & touch tray tables, etc. Next day she was moved to an isolation room - I asked nurse coming out what she had: Clostridium Difficile. My mother-in-law left hospital to applause from nurses & that kindly Dr because he said she was the only patient around that age to walk out (with walker) and not go out to ^ He pointed up - meaning Heaven. So be careful with your older relatives - many Dr’s want them out of the way and refuse care or deliberately stand in the way of care or deliberately infect them - MIL died 4 months later from horrendous C. Difficile infection. That’s how it works - catch it and it lies waiting in your gut, next time she was put on an anti-biotic for a UTI (urinary tract infection) the antibiotic kills the good bacteria in your gut which are keeping C. Difficile at bay, and it takes off causing the worst chronic diarrhea which kills you. There are few antibiotics that can kill these hospital acquired bugs - C. Difficile. MRSA etc. You ignore this a5 your peril - old people are being killed off. I’ve battled it on behalf of mother & mother-in-law & now have to battle for myself & husband. I just suffered 4 extra months of misdiagnosed heart failure last year FEB because ER Dr’s wouldn’t order tests - they assumed my gasping was bad asthma - got a puffer & sent home - back at ER (smaller city hospital) because had fluid swelling up feet, legs, & halfway up torso - that ER Dr ordered a simple blood test - BNP test = remember that name - my results were “off the charts” - she wrote me an “urgent” referral to a cardiologist - was tested & seen within 3 weeks which is a miracle in Ontario - those Dr’s 4 months earlier could have ordered a simple blood test & saved me 4 more horrible months of increasing suffering - couldn’t walk 30 steps - couidn’t carry 20 lbs of groceries from car into kitchen - couldn’t lie down to sleep - gasping for air - severe fatigue - increasing chest pain - my husband who was bent double with severe sciatica had to do everything in the house - so cleaning went by the way side. I’m still severely fatigued but the 7 prescription drugs I’m now on have helped rebuild my heart’s pumping strength. Meanwhile, before I was diagnosed with heart failure the Respirologist appt I had for “bad Asthma” was not until mid-August (and that was after begging a kindly clerk at hospital to move it forward from October because I could not live gasping like that anymore!). So you can see why I think the elderly are getting shafted when it comes to health care in Canada!

@@lizg5574 BTW - angiogram came back virtually clear so Heart Failure NOT caused by Plaque in arteries - Cardiologist thinks most likely caused by Covid - she says they are overwhelmed with Covid caused Heart Failure cases - Going by symptoms - I have had it 3 times 2020-2023 even with 6 vaccines - still catch it - so COVID IS NOT JUST THE FLU!

I doubt that even having a court-ordered DNR would have prevented an EMT medic from at least trying to save a life in an emergency after an accident. After such an emergency there is just no time to spend in trying to validate such a request. A court-ordered DNR would likely only be applicable at a hospital in limited situations, such as someone being taken off life support after an extensive validation via family, lawyers, and hospital administration.

The baliff is correct. In order for us to follow a DNR it must be completed, current, and signed. Signed by you and your doctor. It must be a physical copy. We often suggest placing it on your fridge or other obvious location. Unless I have the physical copy in my hands, there are no other options. By law, we are required to start resuscitation efforts.

A Do Not Resuscitate order only applies to hospital personnel, not EMTs. EMTs are not going to go through a bunch of paperwork to determine who to not save.
