@Cant_Touch_This well its very hard for rent a judges to get in trouble they are voted in is why and it takes lots for them to be in trouble the key then is to out smart them and it fact that fake rent a judge has limits on what he can do and is not over real criminal its civil court and i even call them rent a judges bc you pay to see them you go down and file a civil order and bam your there and a real judge one that handles criminal cases can over rule the civil court and i even told the civil court judge he sould have tried harder in college then he would be a real judge lol

Even this kid, on his own terms, (or words) wants to show people how jury duty isn't something to sleep on. You may not care because you are making $12 an hour, if even that. You are supposed to show up. Seems like you have never gotten a jury duty summons. It states that you have to show up, and only people with medical (age) conditions can send a request to be exempt.

In Singapore, if you skip national service without reason, you will be jailed for 3 years and $10,000 fine. It's the same "didn't do shit" but got massive jail time. Law is law I guess..

You give a young black man a criminal record that has never been in trouble before, you just made his future monumentally harder. What is the reason for putting this kid in jail? Spite? To "pay his debt to society?" 45 minutes is about $500-$1000. Lawyers burn days, file a motion and reschedule. Your comment wasn't ridiculous, it was boneheaded.

I blame ABC for putting that way at the end after they'd worked everyone up by showing the, (admittedly way too harsh,) sentence.

@@thisisaname5589 but that's not is duty to explain to 1st time jurors or anyone doing jury duty. It's the courts/judges responsibility to convey what will happen if u miss jury duty. And his punishment was harsh when all he should've done told him to pay a fine and move on.

@@thisisaname5589 He didn't say anything about letting him off, the judge said he would consider expunging the contempt of court charge. Expungement only means that once you complete your probation, jail time, fines it will be removed from your record.

Penalties for missing jury duty can result in contempt of court, which may be punishable by: Fines (sometimes up to $1,000) and/or Jail time (usually up to 5 days maximum). These punishments may vary and will depend on state and local laws, as well as the nature of the way the person missed jury duty. For instance, if the person intentionally deceived the court in order to miss jury duty, penalties might be greater.

tdenai - Awful and good people are every where. People who make mistakes are everywhere. Big issue could be that judges have a huge discretion in contempt cases, but since the contempt case affects the judge’s courtroom directly then the judge could be too close to rule objectively.

Mr. Doomtastic he was not... he held up everyone. If you were sitting in that courtroom after showing up on tome and a juror didn’t show up and now you have to sit there and sit there you’d be pissed. You are judged by a jury of your peers and the law requires 12. So yes it’s the law and they give all the facts and info on a slip of paper of what to do if you can’t make jury duty and even if you follow those rules they don’t like the fact you are missing. He’s young starting out in life and he’s over sleeping and what not. He will go to his job being this way. I work with enough young people to know, you let them slide on something they will keep pushing your buttons.

Having worked 8 years in law enforcement and 2 of those with the juvenile probation unit with the county sheriff's office, there should have been no probation issued at all, and there should have been no more than a 3 day stay at the 1 star bed & breakfast issued. 10 days is excessive and any amount of probation is excessive. The judge has failed to show where this man is guilty of anything other than misdemeanor contempt of court due to oversleeping and then a poor decision to brush it off and go to work. Yes, the man was ignorant in how the justice system works, but he is also just a man who has had zero experience within a court house/system. That alone should speak on the man's behalf as credibility that he is not a careless or problematic citizen. All I'm seeing here is that this judge wanted to give this man a criminal record as opposed to a misdemeanor contempt of court. He instead shafted him with criminal contempt of court: "criminal contempt of court is a serious breach of a court order that a judge deems as criminal in intent or behavior." and I'm not seeing criminal intent or behavior, and doubt most judges would see that or be able to articulate that either.

I'm sure the judge has overslept; I'm sure the judge has been late to many different places throughout his life, and I'm sure the judge was forgiven many of those times and paid a dear price once or twice but I'm more sure than anything else that the judge did not face a penalty as great as a type of penalty he issued to that gentleman

Many Americans do not get enough sleep and the body can rebel to get it. I do not see the reason in ruining this mans record over jury duty in the slightest. I've known one person that has missed jury duty and they didn't even get half of all that. Most people don't care about jury duty and think it's stupid whether you think it's a duty or not. It's also not hard to get out it, especially if it impacts your income, because they only pay you a little bit of money.

I get jury duty requests yearly usually I don't end up needing to go. But I somehow missed one sent to me from october. I found it in January called right away. And the lady was rude and said next time I'll face the judge and get jail time. I have never gotten a ticket or been to jail. This is ridiculous.

I last time I did jury duty , I was two months out of the Hospital for "Open Heart Surgery". I could barely walk to the Court Room,Could not pay attention during Jury Selection. So many meds that I suffered memory loss. When the Lawyers asked me questions . All I could say was "What? I don't know. Believe it or not, I got selected. Now some poor soul life may be in my hands and I can't even think straight. Around two O'clock I passed to sleep. (Didn't know I had sleep Apnea). The Judge finally dismissed me when they could wake me for two hours.

Never going to happen. And financial hardship is not considered a valid excuse. Bankruptcy, being the only income, losing one's home or apartment, all not valid excuses. But these do ensure that jurors reach to fastest decision even I'd it is not the JUST decision.

I know several people who have gone to jail for missing jury duty.... but they were white "adults" and thus didn't get any media coverage. Yes I believe this judge's sentence was too harsh. A fine I understand, but seriously jail time? However this young man did fail to notify the court of his mishap, which further complicated things. If he had notified authorities of his mistake, this incident probably wouldn't have taken place. (IMO only violent crimes or crimes against society should be punished with jail time longer then a day or two.)

@@VIPK9 It's all on the judge. If he/she wanted to pursue it...they could legally. Usually if 1 or 2 don't show...they don't worry about it. But if they ask for 50 people to show up and only 30 do....expect to hear about your absence down the road. They won't come looking for you. They'll just wait for you to get a traffic violation to inform you on your missed jury duty and give you a new court date...but not for jury duty. Most judges work with you if you have a decent enough reason. Don't lie though...because sometimes they ask for proof of your excuse.

You don't ever want to cost the state any money....that's what judges are for mostly. To get the state some sort of extra income. He was sworn in as a juror. You can argue that you're unfit to serve in a jury because missing work will cause you severe financial problems and the judge will exempt you. But you do that during jury selection. Once you don't give any reasons for which you may not serve in a jury and you're sworn in then there's no turning back. You are bound by law to show up to trial or provide a reasonable excuse for not doing so. As for why he got the sentence, he simply went to work after missing his alarm as if nothing happened, instead of alerting anyone of his circumstances. That's paramount to evading his jury duty, which carries penalties that go way beyond a week or two in jail.

I was literally at a court hearing, the Judge came 35 minutes late. And he literally told me "And if you come late (to the next court date), a bench warrant will be issued" The entire American justice system needs to be overhauled.

I got my first jury duty papers about 6 months. In bold capital letters it states that if you fail to show up or don't present a valid excuse for absence you will suffer severe consequences. I mean if you don't get the message that this is pretty serious you deserve what ever consequences are brought to you. 1st timers mess up... wtf so if i kill someone for the first time i should get a reduced sentence?

Neil Smith missing jury duty and murder are two completely different ballparks my dude lol. So you’re reasoning is a little flawed. Murder is obviously murder. Tis a bad thing. But a young person who messes up their first jury duty shouldn’t have a permanent criminal record, especially if they’ve had no previous criminal history. I’m not saying they should be set free with no consequences, maybe just community service and or a fine to teach them a lesson. But these two plus 10 days in jail and one year probation is way too exaggerated.

I disagree. The original sentence was excessive, but the reduced one feels appropriate. Especially since he now has an option allowing it to be expunged from his record. Remember, the court system is extremely backed up. Having jurors not only fail to show up, but fail to even notify the court that they'll be late or absent costs both time and taxpayer money in a system that is strapped for both.

bmorefan5220 although I agree this judge was somewhat too harsh in the sentence, it’s bc once a person has agreeed to jury duty after being chosen by the court lottery u MUST show up. This guy failed to show up on time so he ended up delaying the trial, nor did he call to explain why he missed it. I think I a fine would have been far better, but he missed something that was mandatory (u need to do jury duty once in ur life if u r chosen)

Yet we have an off duty police officer in a crowded Costco in Corona, California shoot up an entire unarmed family - empties his whole clip on them - 4 shots in their backs - 6 total shots go into them - their 32 year old mentally disabled man dies and both parents are critically injured with bullet wounds of their own and the shooter Salvador Sanchez of LAPD gets away with literal murder and 2 attempted murders - all over what you ask? How many alternates did you have? When I was on Jury duty for a month, there were only a few alternates and we could easily have run out if people had started to just not show up. The length of the jail time seems excessive to me, but they likely wouldn't have held him in contempt of court had he called in and let them know that he overslept. Failing to inform them when he knew is really what the contempt was over in this case, not that he overslept as people keep claiming. I'm sure this judge has multiple people every year that don't show up due to oversleeping and other things that are only partially in their control and this is the one that's making the news.

The 10 days is not even the worst , 1 year probation mean , if he involves in anything or someone slap him and cops come , he is going back in jail.He has a criminal record now and will have trouble to find a decent job .
