Forgemasters need to put Lee on a final warning or sack him. He's probably cost Forgemasters millions in lost business through potential customers viewing this video. Although I agree, It baffles me why these places have such fear of a camera, It was a perfect opportunity to come and explain the memorial was for former employees, and to advertise their craftsmanship and even advertise what the site is like as a work place. Instead of engaging in a positive way with the community they instead try and eject them for no other reason other than because they feel empowered to do so. That to me advertises an unethical company that not only has something to hide, but that probably does the same "big dicking" tactics to their own employees and is probably an awful place to work.

Here's an idea... What would happen if Marti and his mate walked onto the site, and claimed it as their property. Therefore the security guards are the ones trespassing? Marti could then use reasonable force to remove the security guards. The only way to settle who owns the land would need a day in court waaaaaaaaaaaay off in the future. In the meantime, you can do what you want on that land! Wow i'm a genius!

I am aware that should someone start to leave then security went hands on that would be assault. Could you post a link stating that a trespasser cannot be held. Also I think if an assault had taken place Marti would have been straight on the phone to the police as he did in the car wash incident.

I'm afraid not. As soon as you reach the boundary of a property/premises, you must release your hold on an alleged trespasser. If you go over the boundary/curtilage and still have hold of them, reasonable force then becomes Battery.

I think Marti has completely lost out on this one and needs to keep going after the bigger fish in bent coppers and public figures. Dont agree with this clear signage of private property so its an offence to not leave when you are told you have been trespassed trespass becomes an offence when it becomes agrivated trespass which is when you won't leave after you have been notified it is private property and to leave. "accidentally" walking into private land then the landowner asks you to leave and you do its not an offence

13.21 - Clearly shows private property no public access or right of way. Yes under the s33 Crim justice act the land may be classed as open to the public BUT you passed one sign saying it was private and were told it is private in person and asked to leave and you agree you are trespassing. its clearly defined land. As you correctly state trespassing is a civil matter but you can be forcefully removed if when asked to leave you do not. Reasonable and proportionate force can be used against you. Im unclear why you say in the video they cant remove you? A breach of the peace (PACE) may ALSO occur if you resist being removed which is then a criminal matter for the police. Marti - I like your videos but think on this one you are overstepping the mark as you can be removed from their land.

5:40 Twathead is wrong. It does not become a criminal matter when a trespass refuses to leave. It's still civil. Aggravated trespass requires *active* disruption of activities on site, or the committing a criminal act whilst trespassing. And breach of peace just means the police remove you from site but it's that doesn't lead to criminal charges either.

Criminal justice and public order act 1994 Section (4) a constable can arrest without a warrant if he suspects an offence has been committed. Marti house is private property. If Marti was right he would have waited for the police and let them explain the rights he thinks he has . If you listen to him just before he ended the video he said he was running away something that someone who said they were in the right according to law would not do .He would get the police to get them to let him back on the property and not be worried about getting arrested which would be impossible if section 33 of the 1972 criminal justice act he quoted was correct in this situation .

A landlord/occupier can exercise the common law right of a land owner/occupier to remove the trespasser themselves. This "self help" remedy consists of a person using "reasonable force" to remove trespassers, BUT they must ask you to leave first before they can use any force.
