My company is facing a similar situation. Dell hired a law firm to force JIPO to de-register out brand in favour of Dell's brand of equipment with the same name. JIPO instead of protecting our brand and us or at least give us options, they decided to force a mediation based on claims, not only irrelevant, but false. We had to spend hundreds of thousands in lawyer fees to do what JIPO was created to do. The case is still on going and we haven't lost as yet, but it seems winning in this country depends more on how much money you have to throw at it. I know the Dell lawyers are stretching it out in order to bankrupt us, but luckily we're not quite done at yet.

I remember this very well. I used to patronize the local McDonalds occasionally because their food was great and reasonably priced. I also remember how much publicity and attention the case received in Jamaica and how much the finding in favor of the Jamaican company was welcomed by Jamaicans. The feeling was very much 'dem coulda bright!'. The US company, in my view, adopted the wrong approach in choosing to be confrontational and got their just deserts. There was no need for them to bring the case in the first place, I think. Despite the same name nobody was ever going to be in any doubt as to which company was which, so it was a wasted, expensive, divisive, self-defeating effort by a company that was looking to establish itself in Jamaica and this case, I think, was one of the factors that led to the downfall of the US company in Jamaica. Nobody likes a bully.

To be honest, I was of the opinion that USA McDonald had won the case. The verdict was not publicized or voiced as loudly as it should've been. I'm sorry that our McDonald went out of business. Each time I drive on Half- Way Tree round I look at the intersection of Cargill and Half-Way Tree roads and remember that our McDonald was once located there.

@@colinamadden1909 I remember it was all over the media at the time. I don't know why Vincent Chang decided to close the restaurant. My guess is it was probably because he had his hands full with Tastee. But for the time it existed that McDonald's restaurant served some great food.

McDonald's had a cheek though! The Jamaican company was operating before they step foot in Jamaica. So now they expected the Jamaican one to rool over and curl up and die for them! What a cheek! The audacity! Glad they ended up pulling out. The cheek of it😮!

So glad you addressed this; I was unaware of the outcome. The nerve and arrogance of these American companies to think that locals must clear the way and bow down to them! Kraft Foods put their powdered drink Tang up against D&G's Ting iin the courts n the 1990s and failed too. And that was in the USA! --Æ.

You're mistaking McDonald's (Jamaica) with King Burger (not to be confused with Burger King), that had 2 branches, one at each end of Constant Spring Road. MCDonald (Jamaica) is on Half-Way Tree Road and has no other branch.
@EliteJamaica2 ай бұрын
@winchesterlyon It's actually Constant spring rd, next to where courts is now, however that's McDonald's international, MCDONALD'S Jamaica was at Cargill Ave and hwt rd intersection across from Ruthven road
