Yes and no. The law that they would be enforcing is trespassing. Public entities are allowed to protect property for it's intended purpose. But any restrictions to do so must be able to stand up to constitutional scrutiny. So the questions here are what was the reason for the restriction (policy), what was the type of public forum, and does the restriction stands up to constitutional scrutiny for that type of public forum. If it does then the officers would legally be enforcing the law if they trespassed him.

I don't see a privacy concern that is relevant in that situation personally. However they may have had a debatable argument, but we didn't learn the reason for the restriction/policy. My point is that if they did actually have a valid reason that could have stood up to constitutional scrutiny then it would be perfectly reasonable for a good officer to proceed by issuing a formal trespass warning and going from there. I suspect there wasn't actually such a valid reason and hence why they didn't push the issue further.

I know for a fact that even though I am not a paying member, some of my comments have influenced those I've commented to just in what they have said in later videos and referenced some of my comment material. In this national police auditing, I am happy to help with no compensation as it helps us all. Since the DOJ doesn't want to do their jobs, we the people are left to do that. WE the people are the ones with the REAL POWER. But it does require those little people to get off their collective butts and actually do something about it like going in mass to their city government buildings like City Hall and protest, do some re-calling of government officials and remove those of a corrupt nature sucking on the nipple of the city treasury where all that sweet sweet hard earned tax money is kept. If someone wants to fully practice their protected rights to the fullest they absolutely can and no one can legally do anything about it. If you are recording from a sidewalk. Or a school event like if your child is performing in a school play or something. Recording in public can never be considered harassment or disturbing the peace. It depends on people's reaction every one has a choice you can either ignore it and let them do what they are constitutionally protected to do or people have a panic attack and make a huge deal. It's not the person recording disturbing the people it's the Karen or Daren who blew it way out of proportion. I personally don't Record or take pictures of others people's children but I do Record my son playing at the park If another child runs into my camera view sorry that's not my problem and that doesn't mean I'm recording someone else's child.

You may be the greatest 1A auditor of all time! I'm starting to grow tired of all the other auditors quoting the Constitution and saying they're "independent journalists." We shouldn't have to explain ourselves to public servants. When you think of it, it's not the recording that's making them go ballistic, but rather holding a cell phone on a tripod. They have no idea whether you are recording or not. I know other auditors might defend themselves or ask law enforcement to charge the Karen or Darren with assault (which technically it is). By remaining chill and using humor, you completely take the wind out of their sails - it's brilliant and unique! It also seems to work great with the police who often don't do the right thing if faced with an auditor condescendingly explaining the law and demanding names/badge numbers. When you joked about watching Netflix, it gave me an idea. What if you actually were just watching a video? You could wear a covert body cam and capture these Karens and Darrens assaulting you for holding a phone in public! This would make their behavior even more absurd than simply exercising your civil rights.
