Because some liquids (mercury, for example) withdraw away from the glass due to repulsion, then the volume is measured from the meniscus as it curves upward (a convex curvature). Do a search on Google for "Meniscus of Mercury". It is still measured at eye-level, but it is the upper curve in the middle that is considered as the meniscus.
