Then Harvey and Louis would be in serious trouble. Furthermore, they'd have to go into case with a judge that already doesn't trust them.

You lie to a judge you will immediately get disbarred, an attorney speaking to a judge is always under oath. If a lawyers lies under oath it's instant disbarment. No attorney would ever risk lying to a judge, cause it's their whole career.

They had to show they tried to defend her to the best of their ability, but they knew Mike would call their bluff, they were counting on it so that Faye would know they tried but it didnt work. They knew Mike/Samantha wouldnt drop the suit so their plan was to force the trial to start ASAP, with a judge that would alrdy be prejudiced against their defence.

Don't forget: Harvey and Louis are NAMED partners of a MAJOR New York law firm. Their reputations and accomplishments precedes them. Mike Ross was a Senior Level Partner of their firm (by virtue of Harvey offering him the post before he and Rachel married and left for Seattle) whose only known client is Podspace. Ouch. AND MOST LIKELY, Louis wrote those bylaws. The very definition of "eat your own words" To quote words of Cameron Dennis: Ross- 1, Specter and Litt- 0.
