Misinformed Manager - Library Audit - Warren Ohio

In this video a majority of the staff were great! The only issue was a single manager that misunderstood what a limited public forum was. He has even watched other auditors! Hopefully my follow up will not be ignored and we will have a good resolution.

All Americans should respect each others constitutional rights and hold government servants accountable at all times.
My goal is to educate everyone I come in contact with on our constitutional rights, starting with our 1st amendment in a peaceful way.
I am not seeking any reactions and simply want to exercise my rights as a normal citizen would, with a camera to document my experience.
Not everyone has to understand the need to film in public or agree with me, but this is one impactful way that will help to trigger conversations beyond what we can witness in these videos.
Below are some of the topics I want others to learn or fully understand.
#1 - ALL AMERICANS are the free press and we can film/record whatever we see.
#2 - ALL AMERICANS have the same rights and the government must be held accountable when violating rights.
#3 - ALL AMERICANS are subject to the laws only. No policy, executive order or feelings can deny our rights.
#4 - ALL AMERICANS no longer have privacy in public. Cameras are everywhere and we cannot expect others to go out of their way to make privacy for us when in public.
#5 - ALL AMERICANS have a right to be secure in their papers/identity from the government. We do not have to hand over ID without suspicion of a crime.
#6 - ALL AMERICANS can record government servants in the course of their duties. For the entirety of the business hours if we want.
#7 - ALL AMERICANS have access to public information and should regularly request that information from their local/state/federal governments to keep them transparent.
#8 - ALL AMERICANS have a right to film and exist in public without getting assaulted, harassed or intimidated. Regardless of how they look.
Like, share and subscribe! Help all good 1st amendment auditors spread the message and bring good education back to the free people of America.
NOTE: I am not advocating for call flooding, or any form of disruption to governmental services.
People should address their grievances, or make compliments, to let Our government know how they are performing.
That is the only way action will be taken for any change.

We don't get to see many videos from Northeast Ohio. I'm not an Auditor myself, but I've watched a lot. Both good and bad. From this one video I'd say you are doing it right. 1) Know the law better than they do. 2) Don't break the law. 3) Stay quiet and respectful. This can be hard to do and many fail at this. But not the best ones. This ties in with #2. They can't argue that you were disorderly or disturbing the peace for quietly recording in public and only speaking when approached and spoken to. I can tell you know this. I'm just saying it for some of your viewers who may not. Good luck. I'm looking forward for more.

I was arrested while recording in Library in Akron, OH and threatened with a Trespass because Library Policy prohibited use of cameras, trying to remember what city that was, done so many audits over the last month it is all blending together.

He was, but at least they didn't refuse service. Hopefully they had a good talk after I left. The county did update their policy after I reached out to their executive director. The policy is now halfway decent. Still half illegal because it specifies who we can film now that filming is allowed.

@MrBadjohn69 Twice you have dishonestly slandered me, but I can infer it's normal for you do that based on your actions. I've proven through my actions that I'm someone who is professional and proud to remind others of our rights, even if they do not ask. No insults, posting complete and honest reviews of my experience. I do not wish for any "rise" and would rather post calm and boring videos as an example to other auditors that I believe create situations for those extra clicks.

Many libraries train their staff that they are a limited public forum and as such that allows them to prevent filming. If you are not already aware, I’d encourage you to become well versed on explaining the differences between traditional, limited, and nonpublic public forums. Keep up the good work.

Thanks for the compliment! I have been around for quite some time myself and I'm sure my grey hair is a good testament. Since you're clearly interested: I read every day and use modern technology to order the books that I'm interested in rather that waste my time driving to a library browsing a limited selection. I enjoy both fantasy novels and history (reprints from the 1800s have been very enlightening). Since my career pays so well, I've decided to enjoy a new hobby while very politely educating others on something I'm passionate about. At the moment I'm visiting facilities open on the weekends like libraries. I did visit the city hall, legal and IT offices across the street first, but apparently this town isn't open on the weekends or outside of normal business hours. I also visited the local police station without a mask and camera before filming anything to review their policies and to meet with them like an everyday citizen.

The public library is one of the most valuable protectors of free speech, seems like you were just being a bully.

Different groups have regularly removed books and materials or plugged propaganda and it is a growing movement. My goal is to prepare staff for patrons that may demand information about those changes and can also be upset where they will possibly record their interactions. Auditing is akin to training for professional government employees where they have now dealt with a scary masked man/camera and know how to help deescalate while still serving the public.

A limited public forum means a public entity can legally restrict our rights based on time, place and manner. The 3 tests have been used in many legal cases forming what is known as common law, where the courts create law based on case opinions. 1) Time: Business hours or reserved/restricted hours for specified areas. 2) Place: Lobbies are the primary example, but conference rooms, different departments and places clearly marked with signage or locked doors would be a limited forum. 3) Manner: The common parroted excuse is you must have business to be there. Filming in public has been confirmed in the below courts to be protected free speech as an active expression. Simply filming in order to disseminate information is protected business. The act of filming by itself has been confirmed in the supreme court to not be disruptive, harassing or disorderly. Criminally trespassing someone from a public building requires suspicion or witness of a crime after being asked to leave. Unfortunately, in the state of Ohio I can be verbally trespassed if asked to leave by a public servant and refusing to leave. I will be fighting to change that policy with our governor. Citizen's United vs FEC & ACLU vs Alvarez protect the right to film. First, Third, Fifth, Seventh, Ninth, and Eleventh Circuit Courts of Appeals have recognized a First Amendment right to record. The Eleventh and Ninth Circuits have recognized a broad right to film matters of public interest, while the First Circuit recognizes a right to film government officials engaged in their duties in public spaces. The Third, Fifth, and Seventh Circuits recognize a narrower right to film law enforcement officers engaged in their duties in public places. Several of the U.S. Courts of Appeals analyzing a First Amendment right to record the police have found that the right “may be subject to reasonable time, place, and manner restrictions.”

(time = open for business) + (place= publicly accessible) + (manner = non-disruptive) = legally invincible is a formula that makes intuitive sense, but like so many things about our legal system, it's just not that simple. Time, place, and manner (along with the type and intended purpose of a public facility) are factors by which a facility can lawfully restrict or prohibit certain non-criminal or, in some cases, even explicitly constitutionally-protected activities. They are NOT a list of criteria that, once met, make a given activity unrestrictable. The clearest and most recent example of this principle being upheld in federal court is US v Cordova (10th Circuit), in which well-known auditor Denver Metro Audits was found guilty of willfully violating a Social Security Office lobby's prohibition on filming. His argument on 1A grounds failed decisively.

It's a tough one because there can easily be other issues like you said. I've watched several push the issue until they're in jail. In Ohio the trespass law (ORC 2911.21) is specific that I cannot use the defense that a place is public and I must leave if asked by their staff. One of those things I'm fighting to change by contacting the governor's office and my reps.

The recently coined term by the courts of "limited public forum" is a tough one for some to understand. Just like the manager in this video. I've written a more detailed explanation in the comments and hopefully when I file my complaint with the details, he learns the proper definition and way to apply it's meaning.

Update: The county has now updated it's policy on filming. After reviewing with their legal counsel, they now allow it in their buildings. There are a few minor issues to address, but I'm continuing to follow up and will post a video.
