The Constitution in Section 178 is silent(moot)in this regard.The impeachment of Dr Hlophe was political and unfortunately and unfortunately the MKParty used a legal loophole in the Constitution to push a political matter. His impeachment made him not a judge anymore and section 47(1)of the Constitution provides that every citizen who is qualified to vote for the National Assembly is eligible to be a member of the National Assembly and if his party feels that he is the person to serve their interests in the JSC,why not? It is a matter of morality and unfortunately in Law,there's that thin line,as values,morality and religion are not necessarily embraces by Law. You have ZiZi Kodwa MP who is facing corruption charges in the same National Assembly!!!
