You didn't ask for summary judgement though, you asked for anti-SLAPP which doesn't apply in Minnesota as it's been deemed unconstitutional. The judge has already said that the case is not frivolous and meets the standards of defamation per se, so even if you somehow got the Colorado anti-SLAPP applied in this Minnesota case it wouldn't matter as it's NOT FRIVOLOUS.
