Depends on the country. If a death(s) occurs probably yes here in the US. Each case is different. Coast Guard has jurisdiction I think and they don't play around. A captain could be held. If the captain appears under any influence (drugs or alcohol) they would be arrested just like on land.

6:35 The cruiseship is controlled by at least one tugboat, likely one more on the back too, secondly was there not an Italian pilot on the bridge?? So how come there is no consequences for them, after all they are the ones to prevent exactly this from happening!!
