#MuddaApka#मुद्दाआपका# आज हम बात करेंगे सशस्त्र बल विशेषाधिकार कानून की यानी अफ्स्पा की। सशस्त्र बल विशेष अधिकार अधिनियम को लेकर समय समय पर सवाल उठते रहे हैं। दूसरी ओर आतंकवाद, नक्सलवाद, अलगाववाद जैसी चुनौतियों भी हैं जो देश की एकता अखंडता के लिए खतरा है। इसलिए सशस्त्र बल विशेषाधिकार कानून के पक्ष में भी तर्क दिए जाते हैं। सशस्त्र बल विशेषाधिकार कानून को लेकर कई पहलू हैं इसलिए हम बात इस कानून के विभिन्न पहुलओं की करेंगे।

AFSPA: Empowers governor of any state, or administrator of UT or central government to notify parts of or the whole of a state or a union as disturbed area if they consider that the condition in such areas is so dangerous or disturbed that the use of the armed forces is necessary in aid of civil power. The Act allows the armed forces to: • arrest and search of any premises without a warrant in a notified area • the recovery of any confined person, or any arms and ammunition stored unlawfully. • Destroy any hideout, or arms dump or fortified area or shelter from which armed attacks are being launched, or any arms training is being carried out. • No person can be prosecuted or subjected to any legal proceedings for action taken under the Act, without the Central Government’s previous sanction Need: • It claims that the Armed Forces personnel require legal protection in disturbed areas, for it to operate effective and preserve the security and integrity of the country. • Separatism in NE - NSCN(K) attack, Manipur - get support from China. No border fencing on Myanmar side like India - Bangladesh. • Last yr, 35-38 insurgent related cases - 50% reduction in cases - similar in Manipur • Manipur people supported assam rifle - don’t want to withdraw - difference local situations. There are cases of human rights violations by armed forces. It is demoralizing for citizens living under the fear of the gun in democracy which violates there Article 14, 21. AFSPA act needs to be amended & made modifications based on local circumstances which balances the sovereignty & integrity of our country along with minimizing human right violations.
