My mother was involved in a serious car accident with a car salesperson who ran a red light, admitting fault. He was driving a dealership vehicle, leading to her car being totaled and her sustaining a significant injury, a Vertebral Artery Dissection. Further inquiry revealed the salesperson has a substantial history of reckless driving, with over 35 citations for various infractions. Despite the dealership's employment criteria stating a clean driving record is necessary for sales positions, this individual's employment raises questions. He's still employed there, and we've learned from a witness that a previous dealership restricted him from driving their vehicles due to his poor driving record. Could this situation suggest a potential argument against the dealership for negligent hiring or retention practices?

Isn't this a risky way of trying to settle as well, what if the defense accepted the $800K, and then the plaintiff left all that money on the table. Does it not make sense to wait to file any demand until you have all the insurance limits and know for sure there is no excess/umbrella?

Yes that is probably better. In this case they tried to settle for what they thought was a reasonable amount but when the insurance said no they brought in trial attorneys who helped get the max

Real story: I have a lawsuit against the department of corrections an the police department because a parole officer purposely stopped in front me causing me to crash my motorcycle into the side of his vehicle during a police pursuit from a no probable cause chase (officer admits in court) but the parole officer who has no jurisdiction over the public! decided after the cop lied an said I had a firearm over the radio to leave whatever task he was doing an join in the police chase in a unmarked car causing a crash that almost killed me ....then him an the police bodly lied in the police report an its clear as day on video from dashcam an people of the public were out recording now it's on the internet with millions of views I wonder will this case be settled fairly quickly because it's clear who's fault it is an its viral ???? What's your opinion

Defense agreed to mediation, with a mediator of our choice. However, they will only mediate with a hi-lo agreement of 250-1 mil. Policy is 3 mil. It’s non-binding of course, but is it even a good idea to do this? This is Manhattan, trip and fall, spinal fusion.

If their top is $1 mil they will prob offer much less so ultimately it’s up to you as to what you and your lawyer think your case should be valued at. Sounds like the defense is trying to whittle you down
