Legally speaking this Mod is a huge problem for Nintendo, if they were to allow something like this to exist without taking measures to enforce their intelectual property rights, there is the possibility that they lose their rights over some aspects of the intellectual property in Breath of the Wild. Since this Mod was made via commission it's no longer in the gray area most mods can be found that make it so property holders can safely ignore the mods without having any real risk of lossing their intelectual property. Check the history behind the guys that made Miss PacMan, for one example about what happens if you don't enforce intellectual property in situations like this.

A lot of japanese companies take copyright extremely seriously. Modding a game without explicit permission from the publisher IS a copyright crime since it illegaly modifies copyright protected code. And no the "They didn't have the source code" excuse doesn't fly since anyone with half a brain knows that that is just empty words that don't mean anything. Unless they 100% remade the entire games code from scratch they illegaly modified copyright protected code. Which is a crime. Most companies ignore that because it's free advertisement, some companies explicitly permit it by releasing modding tools. But it's entirely within a companies right to go after breaches of their intelectual properties.

Unfortunately the copyright system in the US is extremely outdated and abusable. Video game publishers are within their legal right to claim or strike any videos that contain their IP. But all other publishers have realized that content creator is a healthy and beneficial thing for the video game ecosystem, so they allow it to happen unrestricted in most cases. Nintendo is an archaic corporation who somehow does not see it that way.

For those of you saying nintendo's actions are illegal: theyre not. Fair use wouldn't necessarily apply here, because breath of the wild multiplayer... Is still breath of the wild, you can just do one extra thing: add friends. Most likely the mod wouldn't be viewed as transformative. Does it suck that Nintendo is like this? Yeah, it does, it would be really cool if we just had a breath of the wild multiplayer mod to use without worrying about their concerns. Thats just not the reality of the situation.

Actually their actions are illegal. The mod doesn’t contain any of the games original source code. You need to actually buy the game from Nintendo in order to use the mod.

@@wadewats2278 you might be confusing Nintendo documents around. To my understanding, the Nintendo KZbin guidelines don't say anything about mods, but the actual terms of service declare that modding Nintendo switch games is not allowed. Point crows explanation of the KZbin guidelines modifying the TOS is false, and was probably just an attempt from his lawyer to claim that crow didn't know any better.

Well almost bought a Nintendo Switch and the game so I can play this with my girlfriend until I realized that this was gone. Seriously losing the ability to make families 2 or 3 switch homes instead of one. Fools... everyone wins

@Crazy Comments That could very well be a possibility and if it is he can. Disregard some of my comment but the main point still stands. He has no real reason to lie. And there's a good chance it's probably true. It's alot safer to dump your own games than to find them online. I mainly do that for that very reason. The only thing I pirate are new switch keys and firmware (which shouldn't be something I have to pirate anyhow given how I can download a PlayStation/Xbox update file for free legally.)

@@baconboi4482 No it's because illegaly changing game code is an actual crime and Nintendo doesn't like that. Most companies tolerate it because it's basically free advertisement, but legaly speaking, the game is copyrighted so making changes to the game without permission is in fact a copyright infringement.
