Although my contact with him was brief, he stuck in my mind as he was easy to talk with, and was just a nice guy and appeared to be a great cop as passersby would beep and wave "Hi Mike" while on duty and that community bonding is what policing is all about. Yes, it is. However, any business can lawfully ban guns from being carried into their building or onto their property altogether. Let's just say that this is not the case in this event. Let's say that this guy open carried a gun legally. However, if anyone, I mean anyone, calls in to the police about a gun inside a business, the police must respond. The police have no choice but to send an officer to the location. At some point, this encounter went in the wrong direction. But why would a sane person legally carrying a gun decide to pull the gun and shoot a police officer? No matter how correct that person feels about their right to carry that gun, they must comply with police directions during an investigation. Obviously, there's a great possibility that this could be an erroneous call by someone who doesn't know gun laws. But, we see the result appears to not support this, since this gun carrying person was very quick to pull out his gun and shoot this police officer. Let's all keep in mind that this person did everything correct to indicate a criminal and not an upstanding citizen. Just my opinion.

The police don't have the right to detain you just for lawfully possessing and openly carrying a firearm. It's your 2nd Amendment right. If the officer attempted to subdue or disarm this individual based on him exercising his 2A rights, then that would be unlawful and the citizen would have the right to defend themselves. I am interested in knowing what the reason for the actual call was? NC is an open carry state. If the man was an Instacart driver I would think he passed their numerous background checks which detects felonies and so forth. So, it would stand to reason he was legally carrying the firearm both from an acquisition and open carry standpoint. It also makes sense that being an Instacart delivery driver he would want to have a firearm to protect himself. In the South many people that work as Uber Drivers, Locksmiths, etc. carry a firearm whether it be open or concealed. Here is what I am surmising occurred. A Black man with dreads was open carrying a gun in Food Lion. I didn't hear any reports of him threatening other customers are attempting to rob the place, but if anyone has knowledge (verified) that says otherwise let me know. People see the man with the gun and become scared. They call the police out of concern. Sadly, even in states with very liberal gun laws like Texas certain groups get treated differently when exercising their 2nd amendment. Also, with the mass shootings that have been in the news a lot of people get spooked of open carry in general. The cop shows up to confront the man. We don't know what was said during this confrontation. We don't know how the cop acted or how the suspect acted, but it stands to reason maybe the cop may have wanted to handcuff/restrain the man to take his firearm, run a background check and make sure everything was kosher. The suspect not be being a felon (until his recent action) became defensive because he knows he has a right to open a carry. The suspect (indignant) refused to be arrested. A struggle ensues and the suspect in a fit of emotion with the situation (cops being called, people running and screaming) shoots the officer and kills him. 1st degree is not because he did some deep planning, which is a mistake most people make when they envision a first degree shooting. In NC first degree means if you had a SECOND-- anytime at all to think before you shot it is considered first degree. There is a lot of unknowns in this shooting. Did people call because the suspect was actively threatening people with a firearm or was he just shopping in the store but just happen to be carrying a firearm? The latter of which is perfectly legal. Was the suspect the legal owner of the firearm in question? What was the suspect's criminal (if any past)? Being a Instacart driver he had to pass background checks. So did he have a clean background or was something faked? What is the police officers past? Did the police officer have any patterns of a particular complaint type prior to this? What exactly occurred when the officer first approached the suspect? Did the officer attempt to draw his gun on sight so that the defense can argue the suspect had a reason to fear being shot, or again was the suspect doing something like waving the gun around the store and pointing at people versus just shopping? I don't know if this trial will be shown on any television network (I doubt it) so we may never know the answer to these questions. Either way essentially two lives were lost in this encounter. The incident makes me sad.
