So for them to have just divorced this year is very telling (unless they’d been separated for many years) but it basically said to me that she wasn’t down with “through sickness and health” so I’m siding with the daughter

He signed a legal document with no witnesses while diagnosed with dementia, present at a doctor's appointment on the same day and time of signing, and resides with his daughter who is the caregiver. If the daughter's statements are true and she has evidence, I don't believe the courts will honor that document. Absent a doctor's appointment, there would still be a problem with him signing a legal document with a dementia diagnosis. Someone might even push for fraud charges and lying to the court. You all should probably just hold the funeral and move on.

Once this father had to move in with his daughter she should have taken 10K and hired an elder law attorney. I'm putting this here for anyone else caring for a parent in their home HIRE AN ELDER LAW ATTORNEY. not just any old lawyer, you need one that specializes in ELDER LAW. They will prepare everything you need for any and all situations that may arise between current and former spouses and also your siblings. Best 10k I ever spent. Having said that, to the former wife... sis you divorced this man in the year he died... you gambled and loss... you should have stuck it out to the end but you didn't want to change an adult pamper... oops too bad.

Looking after someone with dementia is an awful task, at least the daughter did it… There’s two sides to every story and obviously we don’t know the all of it.. But this is terrible, your mother should let them bury him and attend in a dignified way and leave it to time… I think money might be involved, but sometimes it’s not worth it… It’s disgraceful and I’m sure if he could see what’s going on he would be ashamed of them all.
