In Ghana’s democracy, sovereignty is fundamentally rooted in the people. This principle is enshrined in the 1992 Constitution, which asserts that all powers of government derive from the will of the people. 1. Popular Sovereignty: The Constitution of Ghana declares that sovereignty resides in the people of Ghana, who exercise this power through their elected representatives. This means that while Parliament, the President, and other institutions hold authority, they do so on behalf of the people and are accountable to them. Elections, held every four years, are a primary means through which Ghanaians express their sovereignty, selecting their President, Members of Parliament, and local representatives. 2. Separation of Powers and Checks and Balances: Ghana operates under a system of checks and balances among the executive, legislative, and judicial branches. Parliament has legislative authority but must operate within constitutional boundaries, and the judiciary has the power to interpret the Constitution and can check any unconstitutional actions by Parliament or the executive. 3. Constitutional Supremacy: Although Parliament in Ghana has legislative power, it is bound by the Constitution. Unlike parliamentary sovereignty systems (such as the UK), Ghana’s Parliament cannot pass laws that contradict the Constitution, and such laws can be challenged in court. This reinforces the idea that sovereignty lies with the people, as the Constitution, created by a popular referendum, is the ultimate authority. In summary, Ghana’s democracy aligns with the principle of popular sovereignty, where all government power is derived from and accountable to the people, with the Constitution serving as the supreme law that guides and limits parliamentary and executive powers.

Exactly Parliament doing his job constitutionally and you having to interfere in his business is abuse of power.

What right does she have to reject?? Me I don't understand why we're even "susc" her "so". If the Speaker's actions were unconstitutional you've the right to interpret the law accordingly but if he acts accordingly to the laws of the land what right do you've to reject his application? Ah😂

The more I listen to those reading other meanings into these two clauses and siding with the CJ, the more I am convinced these NPP party have no good intentions for Ghana. They have turn black into white and white into black. But we will cast them out. We are not stupid

Ghanaians forget soo soon, remember when akufo ado loose election case in 2012,he disagree with the rulling of supreme court, buth he accepts the verdict, buth he predicted the law of this nation will never be the same again, these are the results of what he said 14 years ago

Kwaku Paitsil , wabon papa! Your law school must be worried about you. NPP has it that a person's move to contest against its own part amounts abdication of membership. Automatic Dismissal! What are you talking about. The MPs have crossed carpet already with their names on ballot as party opponent. This is not expression of intention. It is actual departure and alienation

Why should Supreme Court involve itself in the Parliament issue ???? Infact all wht is going on in our Country, looks like one party government so whtever the Speaker says will not be use.

Herrr! Kwaku, a similar issue happened in 2020 and the then MP for Fomena(NPP) was made to vacate his seat as soon as he decided to stand as an independent candidate. How about that?
