The distribution of marks as submitted by NTA in its affidavit is heavily skewed towards right which means there is presence of strong outliers. NTA or IIT Madras can not say there is no abnormality.

17-That the above also proves that the number of Top Rankers resultant of adding Grace Marks to their Subject Test Marks including Devesh Joshi is 7 and hence the following statement of Public Notice dated 6-6-24 is incorrect. “Out of the 67 candidates who got 720/720 marks, 44 are on account of the revision in one Answer Key of Physics and 06 are on account of compensatory marks for loss of time”. 18-That like Devesh Joshi , there may still be many more candidates whose total marks of 720,716, 715m 712, 710,708 707 etc has been obtained by adding Grace Marks and the same are hidden from the lost of 1563 candidates listed by NTA . 19-That NTA in its Public Notice dated 6-6-24 further informed that 44 candidates out of the remaining 61 candidates of 720 marks were those who initially had secured 715 marks but due to change of answer of one question in Physics they became 720. This statement of NTA is not acceptable as discussed hereunder: 20-That 715 marks can be obtained only if a candidate has opted any one incorrect answer out of 180 questions and hence if 44 candidates opt one single answer wrongly then the number of candidates with 715 mark may be 44*180=7920 whereas the actual number of candidates with 715 marks including these 44 are only 261 .The number of candidates who opted wrong answer for that particular question whose answer was changed shall be far less than 44. 21- That NTA has not revealed if these 715 Marks for some of 44 candidates also included Grace Marks . . 22- That in view of the above it is quite clear that serious fudging has been done in preparation of the result of NEET-24 and in awarding Grace Marks and numerous hidden candidates who received Grace Marks like Devesh Joshi may still exist but are not included in above 1563 number revealed by NTA 23-That NTA conducted the Re-NEET on 23-6-24 for some selected candidates with 4 number repeat questions of Test dated 5-5-24 and as many as 28 most trivial/trivial questions in Physics and similar questions in Chemistry and Biology with an intention to help those who were given Grace Marks. 24- That as per Standing Policy of Competitive Test for Entrance 50 % Questions should be of normal level with 25 % of moderate level and 25 % of tough level but NTA is solely dependent upon some chosen Paper Setters who dot apply their brain to observe the above rules and every year they include several wrong questions and for several questions they declare wrong answers. 25- That Leakage of Question Paper in various states and allotment of examination centres to candidates of various parts of the country in Godhra and like places not yet investigated cause a serious doubt over the integrity of modus operandi of NTA 26-That under quoted provision of National Policy for Education -1986 very clearly mandates strict integrity of examining body but NTA with the above hoch poch of awarding Grace Marks by violating the orders of honourable apex court has demonstrated total unreliability and lackof integrity. “ Conduct of Examinations: (c) General: (i) Integrity of the examiner is crucial to the credibility of the examination system. This credibility can be established by the openness of the examinations. It has to be recognised that students have the inalienable right to scrutinise their answer scripts and its evaluation and also compare them with those of others”: 27- That as per above Law the candidates have the inalienable right to scrutinise their answer scripts and its evaluation and also compare them with those of others but NTA has been hiding everything except the student’s own marks. 28-That New Education Policy -2020 vide underquoted Law envisaged NTA to provide National Testing Service with a Quality Control Mechanism but the facts brought under para-1 to para-25 above clearly prove that NTA has utterly failed to maintain the integrity of the Examination and to control the Quality of examination. “(d) National Testing Service A National Testing Service will be established and developed as a quality control mechanism to organise nation-wide tests on a voluntary basis so that norms can be evolved for comparability of performance and also for conducting independent tests. 4.42. The principles for university entrance exams will be similar. The National Testing Agency (NTA) will work to offer a high-quality common aptitude test, as well as specialized common subject exams in the sciences, humanities, languages, arts, and vocational subjects, at least twice every year. These exams shall test conceptual understanding and the ability to apply knowledge and shall aim to eliminate the need for taking coaching for these exams. Students will be able to choose the subjects for taking the test, and each university will be able to see each student’s individual subject portfolio and admit students into their programmes based on individual interests and talents. The NTA will serve as a premier, expert, autonomous testing organization to conduct entrance examinations for undergraduate and graduate admissions and fellowships in higher education institutions. The high quality, range, and flexibility of the NTA testing services will enable most universities to use these common entrance exams - rather than having hundreds of universities each devising their own entrance exams - thereby drastically reducing the burden on students, universities and colleges, and the entire education system. It will be left up to individual universities and colleges to use NTA assessments for their admission” 29-That for full Justice to the aspirants, Re-NEET need to be conducted afresh because the old saying “रहिमन बिगड़े दूध में मथे न माखन होय “is quite relevant in this case. 30-That in case the honourable court decides not to reconduct a fresh NEET then the re-NEET -24 of 23-6-24 be cancelled and the discrepancies of the result of NEET-24 as brought out above be removed and thereafter subject wise Marks and Percentiles of all the candidates be placed in Public Domain of NTA site as per National Policy of Education-1986 quoted above. WHY RE-NEET IS REQUIRED Because: 1-That NTA Declared the Result on 4-6-24 with 67 Candidates of 720 Marks and two with 719 and 718 Marks 2-That it is impossible to secure 719, 718 marks and in previous years there were rarely any candidate with 720 marks and further there were 6 Candidates securing 720 from the same examination centre from where the two candidates had secured 719 and 718 number and therefore the reliability and integrity of the Result became seriously questionable and students raised voice against the same. 3-That NTA then vide its Public Notice dated 6-6-24 revealed that 1563 Students from Haryana, Delhi and Chhattisgarh who suffered some Loss of Examination Time were compensated as per formula given by apex court order dated 10-6-2018 in WP 551 of 2018 ,in compliance to the directions issued by honourable High Courts of Punjab& Haryana, Delhi and Chhattisgarh and it further informed that the 6 candidates who secured 720 and two candidates who secured 719 and 718 marks were from the same centre in Haryana and were all given Grace Marks. 4-That NTA never notified the examination centre wise name and Grace Marks of the candidates who found their favour but happily cancelled the Grace Marks with the condition that the that Grace Marks receiving candidates will have a chance to appear in Re-Examination. 5- That one Mr Yash Kataria informed that he received 78 Marks Grace and with that his total became 718 and likewise the candidate who secured 719 marks was also given 78 Grace Marks and it was discovered that all those who secured 720 at that centre were all given the same Grace Marks. 6- That as per the Formula given in the order dated 10-6-2018 of apex court the Loss of Examination Time, if any, was to be transformed to the Loss of Number of Attempted Questions and Correct Answers thereof calculated as per answering efficiency of each candidate but it is discovered that the candidates were given the Grace Marks in proportion to the assumed Loss of Time without any record of actual measurement of Los of Examination Time and without any reference to the Loss of Attempted Questions and Correct Answers thereof. 7- That as per the same orders of the honourable apex court representations for Loss of Examination Time if any were required to be invited from all the candidates through wide publicity but for obvious reasons NTA deliberately did not invite representations from any other candidate and quietly awarded the Grace Marks to the candidates of their choice in contravention to the direction of honourable apex court . 8-That the centre wise Number of candidates whose Grace Marks were cancelled and were allowed to appear in the Re-examination on 23-6-24 as published in some local News Paper is under: Examination Centre Eligible Candidates Absent, Appeared Chandigarh: 2 2 0 Chhattisgarh 602 311 291 Gujarat 1 0 1 Haryana: 494 207 287 Meghalaya: 464 230 234 Delhi 0 0 0 Total 1563 750 813 9-That as per Public Notice dated 6-6-24 reproduced below NTA informed that Grace Marks were awarded to candidates of certain centre of Examinations in Haryana, Punjab, Delhi and Chhattisgarh for compensations of Loss of Examination Time at those centres in compliance to the orders of High Courts of Punjab & Haryana, Delhi and Chhattisgarh only but as per above table a Candidate from Gujrat and 464 Candidates from Meghalaya were also awarded Grace Marks and surprisingly none of the petitioners of Honourable Delhi High Court are included in above 1563 . “2. Compensatory marks for loss of time : Few Writ Petitions were filed by the candidates of NEET (UG) 2024 before the Hon’ble High Court of Punjab & Haryana, Delhi, and Chhattisgarh, raising concerns of loss of exam time during the conduct of NEET (UG) 2024 on 05.05.2024, at few Exam Centres” 10-That award of Grace Mark without any direction of honourable Gujrat High Court is unauthorized. 11-That normally 400 to 800 candidates appear in test at any examination centre and accordingly the compensation for Loss of Time of Examination, if any, at any centre will apply equally to all candidates of the centre and hence award of Grace Marks to a SINGLE candidate in Gujrat and only TWO of Chandigarh and permission for Re-NEET thereto is either not on account of Loss of Examination Time or is violative of Principle of Equity and award of Grace Marks to a SINGLE candidate in Gujrat and only TWO of Chandigarh and permission for Re-NEET thereto due to any reason other than Loss of Examination Time is unauthorized. 12-That the above table of Eligibility of Grace Marks and for appearing in Re-NEET does not include any candidate from Rajasthan but the following table of Subject Wise and Over All Percentiles, and Ranks thereof for one Mr Devesh Joshi Roll No 3923460114 from Rajasthan abundantly proves that some Grace Marks have been added to his total of Subject Test Marks to make him 720 which brough his Over All Rank of 67. Subject Physics Chemistry Biology Over All Percentile 99.9679852 99.8618693 99.9089272 99.9971285 Rank 747 3,223 2,125 67 13- That Over All Percentile has to be less than the highest of the Subject Wise Percentile but his Over All Percentile 99.9971285 being higher than the Percentiles of Physics, Chemistry and Biology, clearly proves that the Over All Percentile has been determined by adding some extraneous Number to his total Subject Test Marks. 14-That he could receive the highest 720 Marks only if he received the highest 180 Marks in Physics and Chemistry each and 360 Marks in Biology and accordingly if his Subject Wise Percentiles and Ranks are correct then there should be at least 747, 3223 and 2125 candidates who secured 180,180 and 360 Marks respectively in Physics, Chemistry and Biology and in that case the number of candidates with 720 Marks should be at least 747 as against 67 declared by NTA. This undoubtedly proves that some serious fudging best known to NTA has been done in preparing the Results of the NEET-2024 15-That as per following table the Percentiles of Yash Kataria ,Vishakha and Devesh Joshi in Chemistry and Biology are exactly same and hence their marks in Chemistry and Biology are also same but the percentile of Devesh Joshi in Physics is more than Yash Kataria and Vishakha by 0.0000857 and 0.0000429 respectively and correspondingly his marks in Physics is more than them by 2333297* 0.0000857/100 =2 and 2333297*0.0000429/100=1 and accordingly his total Mark is 720 only because the total marks of Yash Kataria and Vishakha are 718 and 719 respectively . 16-That if total marks of Yash Katariya and Vishakha has become 718 and 719 by adding a Grace Marks of 78 , then the total marks of Devesh Joshi is 720 also because of adding a Grace Mark of 78 .
