Yeah, I got lucky when I had an accident that wasn't my fault because an actual accident reconstructionist saw the crash and gave a statement. The other driver's insurance gave up on the fault thing after that, though they still haggled and dragged out paying for over a year.

Before dashcams became big, I started mounting an old cell phone on my windshield to use as a dashcam. It came in clutch. A distracted 18 year old. Ran a red light while speeding at 55 miles an hour when she t-boned me. At least 6 to 10 other cars witnessed the accident, buy not a single one stayed. Her and her boyfriend told the police officer that I ran the red light and he was getting ready to write me a ticket. I made the mistake of showing him the footage right away.(He wrote her a ticket). I should have just gone along with it, and when it went to court, I could have gotten her charged for perjury and filing a false police report.

As an insurance adjuster, I would recommend getting yourself a 360 dash cam. You have no idea how many claims I get on a daily basis that are disputed with no witnesses, scene photos or other details to help prove what happened.

The Grand order is this. 1. Get all the information you can safely. Be mindful of any injuries you got while doing so. Even if it your fault, the more you have, the better your chances of not getting screwed by insurance. 2. Get to the Doctor. The adrenaline from the accident might hide any real pain. So get checked out. You don't want to suffer long term pain down the line later on if you can catch it early. 3. Talk to your lawyer. More then likely (90%), they know how to deal with this better then you do. And if they don't, they can recommend someone who can.

I had a really bad accident that was 100% the other person's fault (she failed to yield on a left turn on green) and her insurance tried this and then gave us the runaround when we didn't fall for it. The only reason they admitted fault and settled out of court was because the only witness who was willing to give a statement was an actual accident reconstructionist. I now have dash cams in my cars, as everyone should.

Got hit on my motorcycle a few years back, the driver of the car was blatantly at fault(illegal U-turn at a red arrow) Their insurance provider tried to call me for my statement claiming the police report wasn't clear enough. I read them my statement from the police report verbatim, and they thanked me for clearing up the "inconsistencies" in the report. They will do anything to keep from having to pay out.

That is why they try various shady tactics and often get painted as evil in the eyes of the public. I'm dealing with Progressive acting in bad faith right now after a not-at-fault accident. This rep, has never answered my phone calls. It takes her weeks to months to respond to my voicemails or emails I leave her. When she does respond, she gives me a deadline of a few days to reply which even she didn't even abide by. She ended up closing the case after I didnt respond within 4 days of her email after she ghosted me for 6 weeks straight. They even accepted fault, but she would never algive me a straight answer to my questions about how to handle the repairs.

I had a guy crash and I made the mistake of stopping and helping him out of his truck which he had flipped towing a trailer. I helped him out of the truck and pulled his dog out then made sure everyone was ok and left him my number in case he needed me to use my truck to tow him. Later I get a call from the state patrol and am asked to return to the scene of the crash which I do. He blamed me for the crash and said I pulled out in front of him and the state patrol believed him. I am a former Army medic and a EMT I stopped to help and ended up losing my license because the state patrol believed the guy and his insurance sued me. Last time I ever stop to help I am a disabled Army medic it took me 5 years to dig my way out of debt for helping that scumbag out.

Or have a dash cam. It cost me 40 dollars for a relatively cheaper one, but it did its job and saved me a lot of money. The old woman who merged into my lane when she was fully stopped in her lane completely forgot to check her blind spot. She literally tried get to get the officer to press charges against me when she was the one who snuck the front her vehicle into my lane without considering the repercussions. Dash cam revealed that she started to merge when she got frustrated at her lane for completely stopping and she quickly tried merging in while starting at 0 mph.

Lol I've worked in auto liability claims. Taken hundreds of statements. Fun fact. Adjustors don't care who is at fault. They just want the claims off their desks. If they only get one side of the story then its more likely the liability decision is with that side. Police reports are often wrong/lazily written. The job is to protect the insured not fudge the liability. A wrong liability decision ends up in arbitration or litigation better to get it right and pay what the insured is at fault for.

Get a dash cam. Seriously. Spend $100-$150 on a front and rear dashcam and it can save you thousands in the future. I bought the Viofo A129 Duo when i bought my first car, and it automatically records the front and rear view from my car. Not only does it provide proof in accidents, but it can show proof of insurance fruad when someone intentionally backs into you and claims you rear ended them, which is surprisingly common, and catch license plates if someone does a hit & run.

This was my dad after an accident. He lost his case even though he was not at fault. My brother told him to call the insurance company for his statement but instead of calling his insurance company he was calling the other driver’s insurance company which led to him to lose and the blame was placed on him even though the other driver admitted it was their fault due to the sun. We keep asking him why he was calling the other insurance company instead of his but was very stubborn and kept calling the other company.

Insurers in my country have tacitly agreed to split their costs somehow, instead of fighting each other in court against the interests of both parties in an accident. They found that settling in courts is more expensive than paying a customer in an unjustified case once in a while. But they will go after customers if they sniff scams or intention.

To be clear, if you hire an attorney they are going to take at least 1/3 of the settlement. What lawyers don’t want you to know is they are going to send you to extra treatment you don’t need and that money doesn’t go to you as it goes to the medical provider. Then the insurance company is going to pay what is recommended amounts. So in the end, If you get into a small accident, it’s not worth hiring an attorney as it won’t get you more money. Also if your claiming injury and you’re not injured, you’re an asshole and the reason why insurance companies are raising rates, for everyone, your self included!

My friend had one of this shit happened to him. The other guy ran a stop sign and t bone him. They offer him a grand and fix his car. And tell him not to hire an attorney. The good thing is that he never signed anything. 3 weeks went by and nothing happened. He told me what happened and I gave an attorney, told him don’t talk to them anymore. When it’s all set and done, he got $7k, his car fixed and all his hospital bills paid. They will fuck you over if you don’t get an attorney. That’s how they play the game

My insurance guy (GEICO) screwed me over a parking lot hit and run which isnt even my fault! I wasnt gonna report a claim as it was a minor incident and afraid that my premium might increase, they said there would be no change in my premium as it isnt my fault and would help me locate the other driver. Guess what, they never did an investigation. Although my premium remained same for few months, once I change my address and a new policy was written, my premium increased 120%.. on top of it my car value went down because of a claim (for which I never received a dime). Guess they helped to screw myself over! Never trust the insurance people!
