@@Ajv516 Or when the property in question isn't even *part* of the HOA. Yes, it's happened, and while the victims usually win in court, it's still a massive amount of stress on the homeowner, especially if they had nowhere to go on short notice.

@Yue_Jin I heard that HOAs are actually the one thing keeping prospectors buying and renting out every house on the market, so that’s one good thing about them.

Be careful. They are on the rise and before you know if the community you live in turns into a HOA because they see profitability over what the people want. I’ve heard stories of hOA foreclosing homes on homes that are NOT even apart of the HOA. It’s HELL on earth - “utopia”

Ironic how the people complaining about HOA's (you, for example) are the very reason HOA's were started in the first place! Some people like quiet, clean common areas, no old toilet flower pots, no garages turned into man-caves for beer swilling fat men. There still are some cultured people who spend quiet evenings reading books. THAT'S why we had to create HOA's

The ONLY law that should be passed is a law forcing HOAs to be voluntary; not mandatory. Any member wishing to drop out should be allowed to do so.

HOA'S makes no sense to me. why would i pay a group to tell me what i can and cannot do to my house that i am making mortgage payments on and give that group permission to take my home if that group is not happy with the decisions i make for MY home? that's insane to me.

I think it's to protect other homeowners from living next to disrespectful neighbors that can devalue property (noise, trash, junk cars, RVs, boats, unkept lawns, weeds, leaving trash cans on the curb, old fences). There are plenty of neighborhoods that don't have HOAs. Mine sucks on enforcement. I don't think they should issue high fines, but at least give two warnings. I do wish they would allow border walls instead of wood fences. Already tired of the people with just enough yard to install a pool and the others with speakers outside when there is clearly a city noise ordinance and a noise clause in the HOA rules.

Have lived in an HOA community for the past decade and we love it. They are not strict like other communities. We like it since our community looks very nice and not having to worry about the house next door with crazy outgrown grass or junky front yards or even painting the siding part of the home a crazy color. We can have flags, have yard signs, etc. I guess everywhere is different.

We have a great HOA. Our subdivision has a pool and cabana, a basketball court, two playgrounds, paved nature trails, two stocked fishing ponds, etc. The HOA maintains all of it with our dues. The dues also include landscaping, street lights and garbage pickup. Plus, we don't have to worry about a neighbor having a car on blocks in their front yard. It really helps keep up the property and resale value. (I get that some HOAs can be a nightmare. Maybe we're just blessed? 🤷🏼‍♀️)

In California, there were cases of HOA rules conflicting with state law. While in a drought, you were very limited to how often you could water your lawn, which resulted in lawns often being a little brown. Then HOAs would fine homeowners for this, but the only way to avoid the problem was to violate state law and risk a fine from the state. That one went to the courts and the HOAs lost (of course).

The city of Glendale, CA required a person to cut the trees for fire hazard reduction and after they did it he city arborist fined them for cutting their trees. You can't make this stuff up.

​@@SimBir08 HOA's are for F'n snobs and control freaks. They want everything to look perfect. You can't have clunkers sitting in your driveway. You house can't be painted a conflicting color. You can't have dead trees. You must have functional exterior lighting. On and on, that's the benefit control freaks enjoy. Despite the many claims that HOA's ruin property values, they actually do the opposite, they maintain property values. I would never live in an HOA, F that S. As an example though. There was a house down a side street from me for sale and was next door to an A'hole who had his driveway looking like Sanford and Sons. All kinds of S from tires, a trailer, wood pallets, you name it he had it outside in his driveway. The house wasn't selling for several months and all the houses around here typically go quick, it's a desirable middle class neighborhood. I eventually saw the Sanford and Sons driveway being cleared out until it was completely empty. The house sold within a week after that. That F'd up A'hole inconsiderate piece of S neighbor was the cause of that house not selling. Well, needless to say, the junk started coming back and he also has a big A camper he parks there now. What a view every time you come and go from your house, a big massive RV a foot across from your own driveway. This is what HOA's look to protect, the atmosphere of the neighborhood. Keep some dillhole from moving in and turning their property in to a clusterF of madness and bringing all the property values around them down.

@@SimBir08 Supposedly up keeping the property values, I think. Making sure the homes/neighborhood looks good. So if you aren’t doing something right, you’re in trouble for it. But so many of them abuse this power and it’s honestly a scam. Some people are paying $1,000+ a month for this association.

I got pinched for - first, having a dry lawn - then later, pinched again for using too much water. Both by the city..... no HOA involved. I sold about a year later, left the state entirely. Oh, yeah..... it was in California. Surprised?

Definitely not a true statement. I live in a subdivision with a HOA and i pay $75 a year for it. they beautify the entrance to the subdivision and pay for a company to come out to salt the hill into the subdivision since the county will not do it. They also pay for new signage if old signage breaks or wears down, which is another thing the county wont do. You just have to do your research on what the HOA in the neighborhood you are considering to buy into does for what you pay the dues for.

HOA....never again! Long story short, I impeached the president of the HOA. Took me a year. That whole group made my life hell. I caught him with a flashlight over my back gate at midnight. Said he was checking to see if my back yard was done, which it was. Not a smart thing to do to a single Mom with a little girl.

I just had my hearing last night with my HOA. I submitted my application to paint my house. The denied the first submission and approved the second. I painted my house and then claimed it’s not like the picture submitted online. The picture of the color sample was taken in my office on my desk. Of course a cell phone picture will not do justice or look exactly like the sample. The application requires paint name brand. Last night the BOD told me the based their decision off a picture because it is not the job of the ACC to go to Home Depot or even pull it up online because they are volunteers. You mean to tell me that they based a financial decision off of a picture. Where does it state in the law that the homeowner is responsible for cell phone camera & printer quality, lighting, resolution and pixelation?! I offered to repaint my house another color at their expense. They refused. I painted my home the color THEY APPROVED. Their next step is the HOA attorney. I am livid!!! The ACC clearly failed to do their due diligence. I need help…

I'm a contractor dealing with this with a client right now. This is my first time dealing with it, and we did the pictures with the old and new. I'm hoping whatever person in the HOA that deals with approving these knows that old colors fade, because we are literally using the exact same color. I'm losing time and money waiting for a response that we don't know how long will take. The whole thing is sooo stupid.

This is a very informative video. Prior to watching this I had the impression that HOMEOWNER ASSOCIATIONS (HOAs) were exactly like mafia money skimming operations. Now I know that there are at least three basic differences: 1: People volunteer to join the mafia. HOAs force homeowners to join. 2: The legal system actively goes after mafia gangsters. The criminal gangsters on HOA boards also skim money from the homeowners, but the legal system does not investigate them. 3: The process to move up in the mafia involves murdering their political opponents. People move up on HOA boards by hiring dishonest corrupt management companies to count the votes. This ensures that only board members who do the bidding of the management companies get elected to the board of directors. The mafia system is more violent but at least the competing candidates are on a more equal footing.

A small comment here. IF your property is not part of an HOA when you buy it, no one can MAKE you join one after the fact. If the house is already oart of an HOA BEFORE you buy it, you are SOL. Your neighborhood CAN decide it wants to form an HOA, but cannot MAKE anyone join. They could form one around you, but have no legal authority to do anything to you no fines, no fees, no control over you whatsoever.

The vast majority of HOAs are formed by the developer/builder long before the first home is built. The prospective buyer has a choice: buy, and become a member of the HOA, or move on to a different neighborhood. There is nobody forcing someone to buy a house in an HOA. The legal system acknowledge that, absent conflicts with national, state, or local laws, an HOA is a private corporation operated (hopefully) according to the bylaws of the corporation. The process to change anything in an HOA after it is created is outlined in the bylaws. Many bylaws are written in ways to make changes as difficult at possible, like requiring an in-person vote and a majority of 2/3 of lot owners voting to change. Think about this: if there are 100 lots in the HOA, 67 would have to be present to vote on an arbitrary date/time, and in favor of the change. Especially if the developer is still sitting on unsold lots/houses, no change will happen. The system is rigged, but it's rigged in full public view (prospective buyers are supposed to be provided with the CCRs and bylaws before they make an offer).

The problem with your, vote with your feet, concept is the first part of your initial sentence: "THE VAST MAJORITY. The vast majority of new homes have forced membership HOAs because the developer/builders who control them can suck more money out of the person buying a home. . This means that they not only receive money for the sale of the house but they also get the HOA fees. THIS IS A SCAM. The phony coverup for the scam is; once the homes are paid for, control of the HOA reverts to the homeowners. Homes are purchased with 30 year mortgages; do the math.

Crazy that HOA's has been against fences around pools. Where I live that's mandatory, doesn't have to be directly beside it but you need something to protect wildlife and curious kids who haven't learned to swim properly yet. If they're afraid of property values dropping, do they know what droops house prices really quickly? A dead child floating in the pool.

Paying HOA dues is extortion plain and simple because it's under duress or threat such as tacking on interest or even foreclosure. Residents need to be allowed to opt out from any HOA, again it's extortion if they don't get that choice.

@@marcuslinton310some cities require new housing developments to have an HOA. Most available housing is in an HOA-controlled neighborhood. In 2022, my wife and I bought the only house outside of a major city that wasn’t in an HOA because the original developer went belly up in 2016. The house is 8 miles from a grocery store, the local government is hot trash, and I have serious misgivings about the quality of the school district. Dealing with all of that to avoid the tyranny of an HOA is unacceptable. Your idea of “voluntarily” doesn’t match up with the reality for most people. If your only option to buy a home is to be extorted by a lawless non-governmental organization, or don’t own a home, that’s hardly a choice.

One of my major house hunting rules is NO HOAS. If the realtor I'm working with shows me a house I ask immediately if it's in an HOA. If the answer is yes, then that's a huge DEAL BREAKER. I will walk out without another word. I had a realtor try to trick me into buying a house in an HOA neighborhood. I really liked the house, too. Just when I was going to close the deal a woman knocked on the door. I was then informed that she had papers for me to sign. They were HOA contracts. I told both of them to eff off & I told the realtor that the deal's off because she lied. I had strictly told her NO HOAS & she did not listen. Luckily, I had not given any money at the time. I also told her boss & I let anyone & everyone know about how she sold houses. She lost her job.

HOA should be voluntary and non mandatory, these are houses not unit blocks so you shouldn’t be forced into a strata over land you own.

@@srobeck77 The monthly rates are much higher when the subdivision has unsold lots because the property developer cherry-picks the HOA agents. Quite often, the way the deeds are structured, until all lots are sold, the residents cannot secure control of HOA. And when they do, they generally don't have much choice except to continue with the same agents (but at a lower monthly rate). It is indeed a big mess that surprises most first time buyers.

HOAs are voluntary. Nobody forces anyone to buy a house within an HOA. And nobody can be forced to join an HOA that is newly forming in their neighborhood. So, anyone complaining about living in an HOA can go F themselves because they voluntarily bought the house and signed on the dotted line giving the HOA all the powers listed in the contract. @@srobeck77 Sheep, goats, chickens.. usually prohibited by either local ordinance or HOA rules... But nobody is forced to purchase a home in an HOA. Don't like them (and I don't)? Move on to properties not in HOAs. Understand that HOAs exist under the premise that they preserve home values by preventing or correcting homeowner actions that lower property values. What they really mean by this is "keeping out people not like ourselves." Back in the day that mean non-white Europeans.

In NSW Australia, there is a law that stipulates a “Model” set of Rules for what we call “Body Corporates” which are roughly equivalent to HOAs, of the Model, some can be amended and some can’t. Also, the HOA books have to be maintained in a set way AND audited annually by an external auditor.

What needs to be done by the State is to declare H. O. A.'s as quasi-government entities which must comply with the State's Constitution as well as all local Laws. Any changes in the by-laws must be approved by the members and the County Commissioner.

Strong wind had taken down the part of the retaining walls and fences behind a few homes. The HOA stated that the home owners were responsible for the repairs. Keep in mind the lots behind our homes had not been sold. Turns out the retaining walls and fences were now on our property.

While I was googling to find out about Texas fence laws, I ran across this, which is another problem we've had with a neighbor's 2 huge backyard trees (the house behind us) in the past: Can I cut my neighbor's tree branches in Texas? Cutting Encroaching Limbs from a Neighbor's Tree. It is common for Texas residents to question whether they have a legal right to remove a neighbor's tree limbs that hang over their property. Texas law generally allows you to remove encroaching branches, so long as you do not harm the health of the tree.

@@darrellcook8253 lol some people have vegetable gardens in their backyard, and if the tree's branches spread out enough, they can block needed sun from getting to the garden. I had to laugh when you mentioned needing airspace though...that was funny. 😂The neighbor in question (with the trees) has 2 very large oak trees whose branches span across 4 neighbor's yards. I have seen our next door neighbor trying to trim the branches that encroach on his yard yes.

There was 1 HOA that due to someone who was living in a garage (which was against the rules) demanded that all garage doors MUST be left OPEN. this was of course to see if anyone was living in the garage but you can't leave a garage door open ALL DAY! got sued and overturned but now before making everyone miserable for a few months

I felt sorry for people that live under HOA. Sounds worse then living in public housing. Those people stayed positive, did everything right went to college became successful, retired and thought they would spend the rest of their lives in peace, enjoying the company of their grand kids. But no they get harrassed and prayed on by a crocked corporation for the rest of their lives. They give them fines for any and everything just to make extra money off them and they really hope you don't pay the fines so that they can take your house from you and sell it to one of their members for a few dollars like they did this one Lady. Id rather live in a trailer park. $500 fine because the paint on your barn don't match your house.

The beauty about life is Change and I’m happy to see that someone has put the microscope upon home associations cause they have brutally violated mini of people over the years and have cheated people out of money and stolen money out of peoples pockets for their own personal gain. let’s keep an eye on the home association to the point where we won’t have to put eyes on them because they won’t no longer be available.!!!!!!!

Why would any HOA want to prevent fences around a pool? Pool fences are safety equipment. If the HOA refuses to allow a fence around your pool, then THEY can explain to the neighbors why their 3 year old fell in and drowned.

Awright, here's the thing. I'm glad they're finding ways to crack down on these thuggish HOAs. BUT, what gets me is nobody forced these homeowners to sign up for an HOA or to buy an HOA property. And nobody forced the renters to rent there either. When owners sign up for HOA they think they're getting control over others, but when the HOA bites them in the butt they cry foul. Grow up, people! Don't sign on the dotted line! Get your power and control fix elsewhere.
