This man is hundred percent correct. In South Africa, we have separation of powers and courts cannot interfere with the statute, save to the extent of un constitutionality. Now, in the first place Mr. Zuma did not even face open justice, a court aquo. A very strange rule of law prevails in the apex court. This legal expert has misconstrued the judgment. First of all, the judgment has declared the medical parole unlawful, so when Zuma returns to jail, he will not be spending an extra time over his sentence. The judgment also contain a proviso ie only if the Commissioner is empowered by law. Come to think of it, there is no law that would allow the Commissioner to legitimize an unlawful decision. If the Commissioner were to consider the unlawful medical parole, the DA will probably bring on a new court application. The best advice for Zuma is go back to prison and seat out his term until he qualifies for a proper parole. The problem is that Zuma is being incorrectly advised.
