This is why it is important to have a written agreement because terms can be interpreted any kind of way by either party. Face it, he was the landlord and she violated the terms of her lease, so she got served. She just needs to cut her losses and find somewhere else for her and her family to live. I have absolutely no sympathy for people that move like this. It was just a matter of time before her grace card would be revoked and rightly so. In my opinion, court is the last place she would want to be, as typically the transfer of property requires a written and not a verbal contract.
