Anytime you're using unofficial hardware/software/firmware you run a risk I personally don't see an issue with this but that risk is still technically there. I read one article that stated they got banned because Nintendo was able to tell based off their cards read/write speed? I only saw the one comment, in the one article, so I don't know if that's true or not.
