In Shridhar V. United India Insurance Company, the apex court was of view that where an accident is caused due to oil spilled on the road, negligence would be on the part of the driver only , not upon the owner , or the other . In such a circumstances, the insurer would not be liable, the computation of the liability shall be on the basis of no fault principle. you said they have to pay the compensation even if there's a negligence by the owner. so how in this case insurer is not liable?

You are quoting amount of sec 163A in sec 140. In sec 140 limits are 50K death and 25K injury as per rules upto 2019, although chapter X is deleted in 2019 mv amendment act.
