Sir, I would just like to clarify that it has been laid down in several judgements passed by the Hon'ble Supreme Court, Hon'ble NCLAT and Hon'ble NCLT that proceedings under Insolvency and Bankruptcy Code, 2016 are not recovery proceedings and that for recovery a creditor can either file before civil courts or opt for arbitration.

Sir there is a Proviso to Section 43(3). Can anyone please explain me that proviso? Which says: "Provided that any transfer made in pursuance of the order of a court shall not, preclude such transfer to be deemed as giving of preference by the corporate debtor" It is a proviso but you have mentioned it as Exclusion. I'm a bit confused. Please help!

Sec 14 says "moratorium shall cease to have effect from the date of approval of resolution plan or passing of liquidation order"....but sec 33 says that "Once the liquidation order is passed, a moratorium is imposed on the pending legal proceedings against the CD"....why this contradiction?

Doubt: Liquidator's fee- no rank. But as per Question in May'19 and MTP Oct'20 they have given 1st Rank to fees to RP.
