I don't think this is how a murder client should be represented. You can't adduce details of the case before the trial begins, it's not the media that will deliberate the case so you don't need to convince them. This is a serious charge and your client has a heavy motive on her - you should be researching on how to get her off the hook. Wait for them in court

I absolutely agree with you. This 'smart lawyer' is either do this deliberately to get public sympathy or he is very much aware that the prosecution has strong evidence to close the case. Under normal circumstances, any homicide cases the immediate family members are becoming part of the suspect(s). In this case, the wife is suspect number one. I believe if the defence is having enough and concrete evidence they couldn't play this game.

1-nobody said Sarah is the one who put the cement. She was in custody but her workers were still there. And they had access to the premises without the cops being around. so they could have placed the cement for her. 2-the forensic team usually come equipped with torches so for them to have torches shouldn't be a issue. 3- All these are things you should wait and say in court because you don't know what the police found out that lead them to that area. Maybe somebody who helped in killing Tob told them where the body was. 4-She is still innocent until proven guilty.

We are a country govern by the rule of law. If you have studied law or know of law then it is a question of evidence and corroborating the same evidence as valid and true. Otherwise no case to be answered. In the court of law there is no presumptions and there is no emotions. This case need to be put together to know who did the killing and why. Listening to Phillip, something does not add up in this case. I hope justice is done eventually because murder is wrong, whatever you have done and whoever you are - it is wrong. A good killer who wants to hide it would have put heavy stuff on it to ensure it does not come to the surface, ever. There are many ways of 'disappearing' a body - this does not sound like one of those ways. It sounds like 'hiding for later use' not 'disappearing for ever' kind of putting away a body. Professional sleuths would have done such thorough work from day one - I don't feel it here but then again, I am not sleuth :-( I pray that justice may not only be seen to be done but be done. To Cohen and many other Kenyans who have been 'made history' just like that without a care in the world, RIP.

unfortunately kenya follows british criminal jurispudence and so its not a matter of proving who did it but proving who is most likely to have done it. its is not evidentiary based but proceduraly based. if i can prove that my procedures followed the law then i really dont need to prove beyond reasonable doubt i just need to prove conspiracy. But for murder we need a much higher standard. its obvious the body was either recently dead or well preserved. This means he was held somewhere for quite some time before being killed or was well in a freezer just after death or it could be both. Science can tell us this. It was obvious that without the body the police dont have a case. So Murgor is doing what he needs to do to discredit the polices use of body as evidence of murder. i think this is very good criminal defense strategy. the real issue that needs to happen is get the people who dumped the body. those people are probably the killers. the workers can help you with that. we can know when the concrete was laid so that we know when the dumping was done. Whether Sarah was party to it can be easily connected once the killers are caught. As it is she definately cannot carry such a heavy person.

So people pushing Cohen to get the divorce- the ones who went in posh cars to see the Nyeri hotel. Could be the real instigators of the falling out and also the murder.

This is like an episode of how to get away with murder. Sarah maybe innocent. The murderer knew that Sarah and her husband were estranged. Influenced the media to publicly incriminate her. Got her arrested. Distracted her defense team then planted the body... From wherever it was to that tank. Also the DCI was very unprofessional in how they handled the case. Why go to the media with evidence. Is the media the court of law or the judge. Lastly if really the body was in the tank all that time it would have been swollen and deformed how did the sister easily identify the body..??? That is if he didn't have any identification marks like birthmarks and tattoos. A thorough postmortem should be done with an uncorruptable doctor. Yes they exist. If and when Sarah is found to be innocent she should sue the press and the incompetent and obviously corrupted media. Also the Kenyan public are like sheep actually worse people can easily manipulate them to believing anything through the media. In developed countries even convicted murderers on death row are accorded a right to a lawyer. And even before their execution, the lawyers try to fight for the convicts' lives to be spared even if most executions still go ahead. Everyone has a right to their day in court. Are there no cadaver dogs in Kenya basic procedure I see in missing person cases especially where there are accusations of malicious intent towards the missing person, is to get cadaver dogs to the person's house and suspects house immediately, so that if there was any foul play in these houses its discovered immediately. Why does it take so long to search a very small area like that compound and what is the protocol for performing a search of house or particular area? Why search after several days have passed on a missing person's report when it's a well known fact that time is of the essence in missing persons cases, the more time elapses, the harder it gets to track and rescue a missing person in the event that they are being held and are still alive or are injured and maybe have escaped their captors. In fact the first place to look would logically be any dug or covered areas in and around the house. Where did the idea of cremation come from when this case started? The authorities stated in the news when this all begun that they suspected he had been cremated. Isn't that tantamount to building a case based on pure conjecture? Before even beginning the search for the body, it's said, the body is likely cremated? Meaning even if the body is not found, the case against the accused will carry on, on the assumption that the body was cremated. Meaning the man is dead and the wife killed him and it will be proven by any means possible. All this even before commencing a serious search for the missing person. Something is seriously wrong with this case. People have gone missing before. We have never seen such dramatic charging and innuendo with no evidence at all just suspicion and accusations. Is it because there was pressure from the Dutch government? Why would any Murderer hide a body in in their own compound which would be the first place that the police would look? This case just makes no sense at all. If several people were involved as is being alluded to, why would they kidnap the victim elsewhere only to bring the victim back to the victims own house and even hide the body there .It makes no sense. DCI needs to look more closely into this matter rather than jumping to the easiest conclusion to the matter. This is why most cases in Kenya can not pass the threshold of the burden of proof in a court of law. The evidence adduced makes no sense and can easily be insufficient to sentence anybody. There's more to this than meets the eye bwana DCI.Less media appearance and building air tight cases should be your focus. Can the FBI be involved? This woman is looking more and more innocent every day.
