When in 2002, Justice Mulenga set the standard on the freedom of expression, he did not imagine that in the future, with the advent of social media and the democracy of opinion, the right would come under heavy debate.
From Stella Nyanza, Author Kakwenza Rukirabashaija to lawyer Male Mabirizi and even legislator Francis Zaake, the debate remains open as to what can and cannot be protected under the freedom of expression
Do individuals have a right to use derogatory language, false claims and malicious attacks against those whom they vehemently oppose?
But do those seeking to regulate free speech have good intentions in the protection of public interest?
We hosted Kampala legislator Muhammad Nsereko who has proposed a law to regulate freedoms of expression online and Isaac Semakadde, a lawyer who defends those who toy at the edge of the freedoms of expression.

Wow this lawyer is such a brilliant, clever and an articulate in all his submissions. What should take our attention first, torture or abuse? If I may ask, is there any person who has ever bleed 🩸 due to abuses? I’m not trying to pardon abusing but rather we should choose our priorities well. Nsereko time will reveal whom you’re working for. Just watch the space.

Nsereko is a legislator and it's his duty and role to table bills he deems fit for the day, MPs will debate the bill and either pass it or reject it. Democracy is a competition of ideas not war. Let the best ideas win. Others are free to pursue anti torture laws also. Nsereko is working for his electorate and it's the reason we voted him overwhelmingly.

@ssempijja michael , so are you saying the MPs are paid your hard earned tax money so they can spend time debating each and every law whether it is useful or not? There is a reason there has to be surmountable cause for any law to be passed. Otherwise, an MP can pass a law that no dog should be allowed to eat a bone because his dog chocked on a bone and died!

I find Nsereko’s law really important. The case that’s bringing the question is what’s the problem with the current law we’re having?? Nsereko isn’t telling us the problem with the existing cyber laws. That rises doubts about his intentions.

The jurisprudence on free speech has already been established by mature democracies. There's nothing constructive Ugandan legislators or courts can add to the matter. People are free to express themselves without preemption or fear of punishment. The limitations on speech are limited to causing harm. Laws against defamation are already extant and sufficient. And incitement to commit crimes is also already against the law. Nsereko is mixing up issues.

I want to agree with Nsereko on the need for privacy and seeking one's consent Before using their images, voices, pictures or information. However the problem is lack of credibility by the government or through its agents like Nsereko who have totally lost public trust!! Counsel ssemakadde painfully knows that it's not about the laws but the unwillingness of the state to rightfully enforce existing laws but rather use it to suffocate divergent opinions!!

From the time the show started you could see the contempt he had for Isaac in a grandfather vs grandson capacity. He was talking of civility but even in his attempt not to be loud, he was not civil. Is this the modern day Uganda problem? Is anyone "younger" never allowed to speak in the presence of the "old"?

When Semakadde says “What happened to those people that were abused, did they die?”,🙄and when asked “Cant people be critical without being abusive?”. He literally starts citing Supreme Law cases. Laws don’t stand alone, they are made to protect citizens and in a generation where people are struggling with depression and a lot of mental heal issues, Cyber bullying and computer misuse are not issues the public should under look, much less the legislators. What makes a good legislator is seeing the lacuna in the law and finding solution to that. One aspect of the law is that its always changing to reflect the morals and values of the society we live in. We can’t be governed by a law that existed in 2014 when half of the population in Uganda didn’t understand social media or own smartphones. Times have changed and so should the law.

Nsereko Muhamad is a lawyer who understands the freedom of speech. Does he want to tell us that since Uganda came into existence, the judicial system in this court country has not been able to prosecute people who have been offending others by falsely using their freedom? I would like to believe that we have all the laws to protect the rights of all Ugandans. What we need now is to advocate for the rule of law in this country.
