On August 10, 1946, Brigadier General Telford Taylor, American Prosecutor, commenced one of the most devastating cross examinations of the Trial. The focus was Manstein's actions as commander of the German 11th Army from Sept. 1941 until 1944. In this excerpt Taylor reads from an order of July 23, 1941 signed by Keitel. Reference was also made to the Commissar Order and a certain Order he signed. He had difficulty recalling these.

This is actually a very important cross-examination. The Commissar Order was to shoot any political officers out of hand and it came directly from Hitler. Manstein in his book wrote that he didn't follow the order and it was Corps-wide (or maybe Army Group North-wide) and that his focus was only the drive to the Dvinsk Bridgehead. But he also said that Commissars were so evil because they violated the laws of war and weren't "soldierly". So you can probably split the difference -- Manstein didn't enforce the Commissar Order but was too busy with armored operations to even have a second to worry if it wasn't.
@DonMeaker

Erich von Manstein made all the Allies' fieldmarshals look ridiculously stupid. It's obvious that if he had the Allies' manpower and resources, he would've won the whole war in a year or less. Not to mention that he had to lead the German Army while it was fighting on two fronts: East and West. U.S.S.R. wouldn't have had any chance if Germany had fought a war only against it. Even though there were 20 Russian soldiers for one German soldier, the brilliant German fieldmarshals and generals together with the superiority of the German weapons would have lead to a fast defeat of the Red Army. The American and British fieldmarshals were also mediocre compared with their German counter-parts. Can anyone compare Montgomery with Rommel without noticing the intellectual and analytical superiority of the latter ? The problem is that even if you are brilliant, when you have to fight against many stupid people, you can still loose the war, The stupid can just overwhelm you with all of your brilliance...

manstein is like the best thing that came out of the Prussian officer corp. he had an ability to manage logistics and the creativity device new strategies. this whole filth trail against such a special man is nonsense. people say overall that he had a brief idea of the atrocities taking place behind the frontline, but he stayed out of them and didn't intervene. PLEASE.... look lets be honest, he was a careerist and he wanted to win victories for Germany, and he played ball. sometimes you swallow a shitty pill to do what you bleieve is more important. let me for instance state that the americans supplied the russians with staggeringly massive aid in the fight against the germans. let me translate that into the nuremberg language -- the americans supported Stalin's genocidal ( 8 million Ukranian deaths) totalitarian regime, hell bent on occupying peaceful territories and disrupting the peace. I am american, i am not proud that my country helped the criminal regime of soviet russia. But in the end, we chose to turn a blind eye to achieve our greater goal (victory against a common enemy). Its not pretty. this is why these trails are utter filth. the only people responsible are the people way way way at the top.

Where are the German to English translation? If you want to see it in English to see how weak the cases were read the original transcripts. There are also several good books on the questionable practice of post facto law at Nuremberg. One might note that the WWII allies were created by Germany, who invaded Poland, Norway, Netherlands, France, Belgium, Luxembourg, Vichy France, Italy, Hungary, Yugoslavia, Greece Soviet Union, and declared war on USA. Oh, and after 21 German and 2 Italian submarines caused the sinking of 36 Brazilian merchant ships involving 1,691 drownings and 1,079 other casualties, the sinking of neutral Brazilian ships led to a declaration of war against the Axis by Brazil. Putting military commanders on trial (other than the SS who specialized in brutality) is an absurdity and the ex-post facto "justice" has no basis in law, or logic, it is simple vengeance. The only way it would ever be any kind of justice, would have been in all war ended in 1945, never to be waged again. And especially for the likes of, largely non-political soldiers like Von Manstein, Albert Kesselring, and Karl Doenitz, (who tried mightily, to the point of absurdity - he had u-boats actually taking life boats under tow at one point - to fight a "clean" war with regard to the Geneva conventions, but got 10 years in Spandau anyway). The catch-all they used was "the commissar order" and "the commando order" from Hitler, that ordered them put to death on capture by German forces. In truth even German commanders found the orders excessive and many commanders simply ignored one or both of them and refused to disseminate them. But as it turned out, even passing on the orders was enough for you to hang at Nuremberg (like Jodl and Keitel did)

The US actually did have trials for US soldiers who committed criminal actions. Nuremburg trials were necessary because Germany didn't do that during the war, and Germany failed to prosecute German war criminals after first world war, as was their responsibility per the Versailles treaty. www.paperlessarchives.com/wwii-courts-martial-documents.html

Manstein knew all about the Einsatzkommando, Gruppe D, attached to the 11th Army. This interrogation strikes me as weak sauce, given the testimony of Einsatz that was available to the Allies by the time of Manstein's trial. Manstein, to his credit, never actually ordered any killings, but he enabled them by logistics and supply. The Wehrmacht and the SS and SD worked hand in hand on the Eastern Front. The myth that the Wehrmacht had "clean hands" is jut that, a myth.

You are right in saying Manstein knew of the Ensatz Gruppe D's actions. However, if you aware of the structure of the German Army of the time. It was the responsibility of the Army Group for which each Einsatzkommando was attached to supply weapons, ammunition, and other logistical support. By putting the blanket statement of the Wehrmacht does not have clean hands is a bit short sighted. Did some Wehrmacht officers and soldiers commit atrocities "YES". But did all of them "NO". Manstein is an interesting figure though. In the early years of Hitler Manstein vehemently defended Jewish German Soldiers acting or veterans almost to the point of his dismissal from the army. Was he an Anti-Semite I can't say. Evidence sometimes says no and sometimes says yes. But then again most of the world was Anti-Semitic at this time, so who can judge the few on trial.

Omen_Curse Forgot to mention that supply and logistics for each Army Groups Einsatz was from a direct order from the Fuhrer at the time. Manstein did not voluntarily supply the Gruppe's. It was forced on him.

+Chris Jefferson jeah but it is easy to say: " oh u knew all about this!"....i mean u have to be a realist. manstein had better things to do than looking at einsatzgruppen. his interest and work was holding the frontline and btw one must see that there were enormous amounts of partisans fighting behind the lines and interrupting the germans the whole time...booby traping evrything..destroying railway..supply lines....killing and sniping etc etc..... as a german soldier u HAVE to react to such things and as an example ; after "zitadelle" the soviet army launched the counter assault coordinated with about 200.000 partisans (here u have the bloody number of these guys). so beeing raped by partisans is just a nightmare and to deal with them is simply : death panalty . that sounds hard but thats "justice " in war. what is justice ? thats the question? i mean the U.S shot a lot of guys who retreated during the battle of the bulge. u see , in war or in special situations u have to use special methods to keep up moral, discipline or to keep civilians, partisans etc calm. There were a LOT of useless murder-actions from the einsatzgruppen - NO doubt! But there were also a LOT of actions wich are REACTIONS and methods to deal with threats. a possible way to understand the way a general or fieldmarshall could see this as a necessary method.

From the few things my husband, a two tour combat Vietnam Veteran (first tour included TET OFFENSIVE) Army Lieutenant (OCS grad), has told me, Vietnam was more than just war. Sometimes it was slaughter, sometimes merciful and sometimes genocide against anyone with slanted eyes, regardless of whose “side” they were SUPPOSEDLY on! POWs were given good, humane treatment MOST of the time. Chaos, necessity for IMMEDIATE information, frustration, fear to hysteria, rage, anger of the moment, & plain sadistic mean rotten “human” nature, at times had created what - given a stretch of time AFTER the battle - would/could be defined as war “crimes”. We have four wonderful, grown sons who are ALL US ARMY VETERANS. Two have multiple tours in Bosnia, Iraq, & Afghanistan. Our eldest was a corporal then WEST POINT Army Officer. Our youngest was an Army Staff SGT. Our youngest was wounded in Afghanistan. They have shared many of their war time experiences with my husband. He, however, has shared NONE of their experiences with ME. When my boys, like my husband in Vietnam, left for their first combat tours, they were young BOYS. When they returned, they were still young, but they were now MEN who had had terrible life altering experiences. As with my husband, my sons had lost forever that special twinkle of innocence in their eyes. Heartbreaking for ANY wife and mother.
