Nyamira woman not allowed to leave home until her husband is buried

The body of a former Nyamira County employee is lying in the morgue 8 months after his death due to a land tussle pitting two families. Kephar Nyachogo from Gesu-Rura-Nyamaiya village in Nyamira County, died in a road accident and just as plans to lay him to rest were underway, a court injunction stopped it. It is a situation that has complicated the life of Kephar's widow. According to their culture she is not allowed to leave her home until her husband is buried.

Someone please advise the widow and her family to seek legal advice concerning her detention in the compound. She should be at liberty to walk out. Pursuant to section 3(2) of the the Judicature Act (Cap 8), the court that is dealing with the land case is only guided by African customary law so far as it “is not repugnant to justice and morality or inconsistent with any written law”. The mentioned customary law is not only unjust, but also infringes upon the widow’s rights and fundamental freedoms under the Bill of Rights, Constitution of Kenya, 2010 which is the supreme law of the land. “Article 39 - Freedom of Movement and Residence (1) Every person has the right to freedom of movement. (2) Every person has the right to leave Kenya. (3) Every citizen has the right to enter, remain in and reside anywhere in Kenya.”
